Abstract

Guarantee legal certainty and economic stability is very important to keep the movement of the economy of a country. The formulation of the problem formulated a point of issue is how the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. The purpose of this study was to determine the environmental law enforcement in Indonesia on a case study of forest fires in Indonesia and How to influence environmental law enforcement to economic growth in Indonesia. This research could be useful in a practical and theoretical. The method used by the researchers are using a normative juridical approach. The results of the study Enforcement of Environmental Law in relation to the Criminal Law which is related substance of Law in Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management includes about a ban on land clearing by burning and action against the perpetrators for enforce the law and environmental law enforcement to economic growth in Indonesia affected by three (3) aspects, namely Products of law, justice system and political risks are always changing. Conclusions of law enforcement carried out by the legislation in force and the factors that influence economic growth is necessary to be noticed is the commitment of the highest officials responsible to the reciprocation of a country. Recommendation law enforcement must be carried out according the legislation without seeing the background of the company or individual that legal certainty to invest guaranteed and the reformulation of Article 69 paragraph (1) letter H Law No. 32 of 2009 on the Protection and Environmental Management.

Abstract

AbstractLaw enforcement is an interesting issue to be studied because it deals with the implementation of applicable laws and regulations, enforcement of environmental law is closely related to all aspects of human life because the environment is a buffer of life on this earth. The formulation of the research that the researcher formulated is how to regulate the law enforcing environmental law enforcement in mining sector in kuningan Regency and Implementation of environmental law enforcement in mining sector in kuningan regency. The purpose of this study is to find out the legislation regulating the enforcement of environmental law in the mining sector in Kuningan Regency and To know? Implementation of environmental law enforcement in mining sector in Kuningan regency. The research approach method is empirical juridical. The result of the research is the Regional Regulation of Kuningan Regency Number 7 Year 2014 on the Management and Protection of the Regional Environment and Implementation of environmental law enforcement in mining sector in Kuningan Regency through the making of regulation related to environment and mining, law enforcement through repressive and persuasive Increasing the role of the community in accordance with the mandate of the law. The conclusion of this research is that law enforcement in mining sector is done through persuasive and repressive approach.Keywords: Implemetation, Enforcement, Law, Environment, Mining. Abstrak Penegakan hukum merupakan isu yang menarik untuk diteliti karena berkaitan dengan implementasi peraturan perundang-undangan yang berlaku, penegakan hukum lingkungan sangat berkaitan dengan semua aspek kehidupan manusia karena lingkungan merupakan penyangga kehidupan mahluk hidup di bumi ini. Rumusan penelitian yang peneliti dirumuskan adalah Bagimana pengaturan perundang-undangan yang mengatur penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan dan  Implementasi penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan. Tujuan penelitian  ini adalah untuk mengetahui pengaturan perundang-undangan yang mengatur penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan dan Untuk mengetahui ? Implementasi penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan. Metode pendekatan  penelitian adalah yuridis empiris. Hasil penelitian yaitu adanya Peraturan Daerah Kabupaten Kuningan Nomor 7 Tahun 2014 tentang Pengelolaan dan Perlindungan Lingkungan Hidup Daerah dan Implementasi penegakan hukum lingkungan pada sektor pertambangan di Kabupaten Kuningan yaitu  melalui pembuatan peraturan perundangan yang berkaitan dengan lingkungan hidup dan pertambangan, penegakan hukum melalui represif dan persuasif serta peningkatan peran masyarakat sesuai dengan amanat peraturan perundangan. Kesimpulan penelitain ini adalah penegakan hukum pada sektor pertambangan dilakukan melalui pendekatan persuasif dan represif.Kata kunci : Implemetasi, Penegakan, Hukum, Lingkungan, Pertambangan.

Abstract

AbstractPublic awareness of the importance of a healthy and good environment continues to grow. The formulation of the problem is how the influence of government policy in conserving water resources on environmental awareness of the community in kuningan regency. The purpose of this research is to know how the influence of government policy in conserving water resources to environmental awareness of community in kuningan regency. This research can be practical and theoretical. The research method used by the researcher is using empirical juridical approach. Result of research The policy of local government in conserving water resources contained in Local Regulation of Regency of Kuningan Number 12 Year 2007 about Conservation of Water Resources to arrange society in the direction as desired by government of this blood start proved with existence of society awareness in environmental conservation that is with angry Community of kuningan district with logging tree in cilimus market. The conclusion of local government policy in conservation of water resources has been effective to increase public awareness in environmental conservation. Recommendations to increase awareness of the community hence the innovations needed to increase the awareness of the community through hygiene contests both at the sub-district or village level and explore the potential for increased environmental awareness through the excavation of local wisdom.Keywords: Influence, Policy, Environmental Awareness.Abstrak Kesadaradaran masyarakat akan pentingnya lingkungan hidup yang sehat dan baik terus berkembang. Adapun rumusan masalah adalah bagaimana pengaruh kebijakan pemerintah dalam konservasi sumber daya air terhadap kesadaran lingkungan masyarakat di kabupaten kuningan. Adapun tujuan penelitian ini adalah untuk mengetahui  bagaimana pengaruh kebijakan pemerintah dalam konservasi sumber daya air terhadap kesadaran lingkungan masyarakat di kabupaten kuningan. Penelitian ini dapat berguna secara praktis dan teoritis. Metode penelitian yang digunakan oleh peneliti adalah menggunakan pendekatan yuridis empiris. Hasil penelitian Kebijakan pemerintah daerah dalam konservasi sumber daya air tertuang dalam Peraturan Daerah Kabupaten Kuningan Nomor 12 Tahun 2007 tentang Konservasi Sumber Daya Air untuk mengatur masyarakat ke arah seperti yang diinginkan oleh pemerintah darah ini mulai terbukti dengan adanya kepedulian masyarakat dalam pelestarian lingkungan hidup yaitu dengan marahnya masyarakat kabupaten kuningan dengan penebangan pohon yang berada di pasar cilimus. Kesimpulan kebijakan pemerintah daerah dalam konservasi sumber daya air sudah efektif untuk meningkakan kesadaran masyarakat dalam pelestarian lingkungan hidup. Rekomendasi untuk meningkatkan kesadaram masyarakat maka diperlukan inovasi-inovasi untuk peningkatan kesadaran masyarakat tersebut melalui lomba-lomba kebersihan baik di tingkat kecamatan ataupun desa dan menggali potensi-potensi peningkatan kesadaran lingkungan melalui penggalian kearifan lokal.Kata kunci : Pengaruh, Kebijakan , Kesadaran Lingkungan.
