Abstract

This article discusses about family law reform in the moslems countries. This study shows that the reform methods are intra-doctrinal and extra-doctrinal reform, regulation and codification. There are three typical of the Islamic law reform in the moslems countries. They are the countries which use the Islamic law as the traditional fiqh, the countries which adopted the west law, and the countries which establish the Islamic law that combine the methods and procedures from the west law. The reform aspects of the Islamic family law in the moslems countries are the limitation the marriage age, the control to the polygamy, court procedure in the divorce, while in the inheritance law there is the wasiat wajibah concept.[Tulisan ini membahas tentang pembaharuan hukum keluarga di negara-negara Muslim. Dari pembahasan ini diketahui bahwa metode pembaharuan dilakukan dengan metode intra-doctrinal dan extra-diktrinal reform, regulasi dan kodifikasi. Dari sini, terdapat tiga tipologi negara Muslim berdasarkan pembaharuan hukum Islam yang dilakukan, yaitu negara Muslim yang menggunakan hukum Islam sebagaimana dalam (fiqh) tradisional; negara muslim yang mengadopsi hukum Barat; dan negara Muslim yang menerapkan hukum Islam dengan menggunakan metode dan prosedur layaknya hukum Barat. Adapun aspek pembaharuan hukum keluarga di negara-negara Muslim diantaranya adalah pembatasan usia perkawinan, kontrol terhadap poligami, dalam hal perceraian dari suami dan isteri dengan prosedur pengadilan, dalam bidang waris terdapat wasiat wajibah.]
