Abstract

Zakat is the property that must be set aside by a Muslim or body owned by a religion in accordance with the provisions to be given to those who deserve it. As Allah SWT. Meaning: “Those who believe do righteous deeds, to establish regular prayers and practice regular charity, they mendaoat Tuhanya rewarded. And there shall no fear come upon them neither shall they grieve “(Q.S. Al-Baqarah: 277). Zakat also has the function of a very high socioeconomic, relating to the prohibition of usury, zakat directed us not to accumulate treasures-stacked. Zakat is a means of educating for human possessions or material that is not the purpose of life and not a right of absolute property of the man who has it, but it is a surrogate of God, which should be used as a tool to control yourself to God and as a human being to run the commands of God in all aspects. If the potential of the Muslims in the empowerment of zakat are properly managed in an integrated and optimized, then the zakat funds can overcome the problems of poverty and reduce social disparities akam certainly capable of reducing poverty. However, this is no different than fire as far roast. Not according to what most people expected. In practice for the management of zakat is done individually but only a few institutions, the management of zakat implemantasinya not well ordered based on the principle of pilgrims, so that its collection is relatively small due to scattered everywhere without good management.

Abstract

Restrictions study area in this article, the starting point of three scholarly foundation, the foundation of ontology related to the object of study, epistemological ground with regard to the method used in the study and axiology berkaiatan foundation with the purpose or significance of the study. The object of study in this article is the competence of the Religious Court in the interpretation of Islamic family law in Indonesia, covering permasalahn Interpretation of Family Law Islamic Religious Courts Indonesia, procedures Interpretation of Family Law Islamic Religious Courts Indonesia, Judgment of Religious Courts in Indonesia there Interpretation Law and competent in the interpretation of Islamic Family Law in Indonesian Religious Courts. The method used, the study included a kind of normative legal studies approach to the blade, then the method of analysis, there are three, namely; (1) political approach; (2) statue approach; (3) analytical approach. The data source materials normative, ie competence Religious Court of Indonesia and all sources of Islamic family law that is set in the regulations and legislation arranged in hierarchical. Data collection techniques to study the document. This study, including qualitative assessment of normative, the analytical descriptive analysis (explanatory). Theoretical framework used,, ie at the level of grand theory using the theory of ijtihad, the middle level of theory using the theory of law and society and on the plains applied theory using the theory of Islamic Sharia judicial system. While the significance of this study is to find the source of the law, the legal function and purpose of law. The results in this study, which was to find the nature of legal interpretation, legal interpretation procedures, problems that are interpreted in the Religious and who are competent to interpret the Islamic family law in Indonesian Religious Courts.

Abstract

During this wakaf has always identified with the Waqf land, but as the birth of Act No. 41 of 2004 about the endowments, has made the concept of Waqf contains a very broad dimension that includes not only the treasure does not move but also the treasure moves, i.e. including the Waqf money which their use is very extensive is not limited to the establishment of places of worship and social kegamaan. The presence of this legislation is projected as a means of social engineering, doing changes mind, attitude and behaviour of the Muslims as well as to empower of Waqf which is one instrument in building socio-economic life of the Muslims. Beside that, also as momentum permberdayaan wakaf productively in accordance with the Islamic Shari’ah breath.

Abstract

Pada perkembangan zaman saat ini yang semakin maju, dan kebutuhan ekonomi yang semakin mendesak, sehingga saat ini banyak muncul sengketa wakaf, yakni gugatan atas barang yang diwakafkan oleh ahli waris orang yang mewakafkan. Munculnya gugatan atas barang wakaf, tentu akan mengganggu bagi pemanfataan barang wakaf tersebut. Munculnya sengketa wakaf ini dikarenakan masih banyaknya perbuatan hukum wakaf yang dilakukan dengan asas saling percaya, secara lisan, dan tidak didukung dengan adanya tertib administrasi. Adanya gugatan sengketa wakaf ini, tidak hanya merugikan bagi nadzhir, pihak yang memperoleh manfaat dari benda wakaf, maupun wakif sendiri.

Abstract

urely Allah commands Zakat is not just carried out according to the size and content of its provisions to the people who deserve (mustahiq), but more than just obligations to be implemented. Zakat is not only a divine dimension (hablum minallah) but also has a social dimension of humanity (hablum minannas). Therefore charity is a necessity indeed a servant of God who gifted fortune to share with his fellow creatures. Commandments of zakat in the Qur’an has a very profound message of social sensitivity of humanity as well as foster the spiritual values that can shape the character of humanity filled with concern for the environment. With a Muslim charity will be met in a tangle of Islamic brotherhood is a close, and with zakat, a man believed to have a more worldly perspective ascetic (ascetic) that makes a person no longer has the heart to the world’s dependence excessive, so be a better person thanks and happy in various situations and conditions.Keywords : Zakat, Mustahiq, social dimension

Abstract

Zakat is one of five major pillars to strengthen the Islamic religion. As a way to worship Allah it has some uniqueness as a worshiping that relates mankind to their God and also mankind to others in term of social responsibility that could be assumed as a religion tax. On today’s’ development of zakat Professional zakat appears on its controversies and potential power to an economy as whole. Professional zakat seems to be a good tool that classified into a source of zakat. For its founder professional zakat is derived from the figuration of agricultural zakat; due to its new existence, it comes with tough debate and controversies among some ulama’. This writing tries to examine some controversial element of professional zakat and how it finally becomes one of potential source of zakat in Indonesia that will also influence national’s economy by several mechanisms. In the end of the writing there will a compiled figure that project the contribution of zakat for Indonesian economy.

Abstract

Beginning of the emergence endowments can be seen from two assumptions. The first assumption states that the Kaaba was built by Adam, and the pillars established by the Prophet Ibrahim and Prophet Ismail, and then preserved by the Prophet Muhammad, it is thus the Kaaba is the first endowments known to man and used for religious purposes. While the second assumption states that the Prophet Abraham who built the Kaaba, it means endowments began in the time of Prophet Ibrahim, who has brought the teachings of monotheism. Endowments ordered by the Prophet comes from the prophetic vision and not follow the example of the implementation of the endowment implemented ancient Egyptians and Greeks and Romans. Later, the endowment was established in the community is carried out dynamically from a tradition that is to be amplified by the regulation, as practiced in Muslim countries. Regulation waqf positive impact for the wider benefit such as health care, education, social. Economic and others. Health services are provided through endowments-waqf hospital. Management of waqf with contextual regulation can also be used to develop the productive waqf property through commercial efforts and the results for social purposes.

Abstract

The role of the Waqf is very strategic for the development of the muslim community throughout both concern education, health, and well-being. But the unfortunate developments that have been achieved so far are still struggling on the field of worship, education, and health alone, while the field of economics that are the pillars of modern life has not been touched wide.
