Abstract

Ne bis in idem principle is very important to protect individuals not to be punished more than once for the same offence. However,international practice shows that the application of this principle can be ruled out if the crime has linkage jurisdiction between two or more countries. Similarly, the International Criminal Court (ICC) can also override this principle and has the authority to prosecute or try a repetitive justice to the perpetrators of serious human rights crimes in the territory of contracting parties of the Rome Statute. This article discusses that the override of this principle may affect the jurisdiction of a country and directly “intimidates" its legal sovereignty.

Abstract

One of local authority of central government which is delegated to the village shall be tourism affairs. Pecatu Village has numerous marine tourism destinations. Pecatu Village is affirmed as marine tourism area as it is supported by its natural potential of the sea. Thus, local government is expected to conduct a strategic effort that the community can benefit from the development of the tourism sector in the region of Pecatu Village. This paper aims to understand and comprehend concerning marine tourism management authority by the government in the Pecatu village and also to identify supporting factors and obstacles in the management of marine tourism in the Village of Pecatu. This paper applies empirical methods of judicial writing. Rural authority in the management of marine tourism shall include : Management of tourist attraction in the village excluding from the tourism master plan, management of recreation and public entertainment places in the village, recommendation on issuance of licenses of cottage in the urban tourism sector. Implementation of the management of marine tourism in the Village of Pecatu shall be influenced by supporting factors from both internal and external aspects, and there are also the obstacles in the implementation of the management itself.

Abstract

For the purpose of accelerating integration among ASEAN member countries in ASEAN Community, it has been agreed on “Master Plan on ASEAN Connectivity” in order to create connectedness of ASEAN region. There are three important elements for the implementation the program, one of which is the construction of facilities and infrastructure namely ASEAN Physical Connectivity. This development will have a major impact for the territory of Indonesia as a country that has a strategic area for the traffic ASEAN regional trade. It reminds about enforcement the territorial jurisdiction of Indonesia (Republic of Indonesia) as an absolute value for the Indonesian Nation. This paper will explain the consequences and remidies that can be done to uphold the sovereignty of the territorial jurisdiction of Indonesia.

Abstract

At first, the Land Office of Badung Regency has provided the information services manually which was difficult for people who live far from the office to access the information needed. Therefore, this Land institution has made serious efforts toimplement better public services. The data is collected by implementing the normative research method. The purpose of developing this journal is to find out the implementation of public services by the Land Office of Badung Regency in order tocreate a good governance and to find out the implementation of the Instruction of the Head of Land Institution of Indonesia Number 2/Ins/VI/2013 about the services applied in Land institution in Badung regency through SIMTANAS (National Land Management Information System)by SMS (Short Message Service) system to the phone number 081999220666. People are able to question about the progress of their land authority process by sending short message to the number above and is automatically responded by the Land Office of Badung Regency.

Abstract

A visa is a document issued by a State in order to give permission to someone to enter its territory, within a particular period and purpose. Visa is divided into several types, depends on its functions. However, in practice in Indonesia, it is often found casesregarding the misuse of visa by foreigners, as they use it to live and work in Indonesia. This paper will discuss the violation of visa visit by foreign nationals in Indonesia. This paper will also discuss the Indonesian government's efforts to solve this legal issue.

Abstract

In the diplomatic relations between States, it has been generally developed the mechanism for collecting information legally through official diplomatic channel, in order to support the national interest of each State. But, secretly gathering the information is considered as a violation against the sovereignty of a State. The practice of espionage is a term used to describe the act of collecting information secretly in an international relations. International Law has actually prohibited any State for doing practice of espionage against other countries. Besides classified as an intervention to the sovereignty of the State, such action also violates the principle of cooperative relations based on good faith.

Abstract

Customs Acquisition of Land and Building (BPHTB) is one type of tax potential in the Badung regency especially with the tourism industry and the utilization of very developed land and buildings. Based on the Act No. 28 Year 2009 on Regional Tax and Levies, hence it the district/city in this paper especially Badung regency has the authority to levy BPHTN. With the methods and approaches of writing normative law, this paper describes the arrangement of BPHTB and also the authority of Badung regency to levy BPHTB conducted by Revenue Office of Badung regency.

Abstract

Solid waste is the waste material from household activities , markets , offices , lodging houses , hotels , restaurants, industries , puingan building materials and scrap - iron former motor vehicle . Efforts made by the government in the handling of garbage in violation of the provisions set in the lawNo. 18 of 2008 concerning waste management while Denpasar Government waste problems in regulation set in the area of Denpasar No. 3 of 2000 on hygiene and public order in the city of Denpasar , increasing the number of residents in the city of Denpasar with high growth rates result in increasing the volume of the garbage .This article usine empirical legal . Empirical legal is to conduct research through field observation ,which concluded Lack of community participation in the management of hygiene is not maximized , so it needs to be further enhanced through the implementation of socialization .
