Abstract

After the establishment of Asian Charter, the agenda to which Asian countries shall address is that its implementation urgently requires a strong political will and the sufficient supporting framework. For Indonesia, the prospect and challenge for the implementation of this charter is mostly in the form of the reformation of the law pertinent to the law of international organization. From international perspective, the position of Indonesia as the hosts of the Asian headquarter may significantly affect the development of international law, especially on he law of international organization.

Abstract

Terdapat perbedaan signifikan pada konsep akad murabahah antara Indonesia dan Malaysia. Perbedaan yang paling besar terletak pada adopsi bai’ ail-inah di Malaysia yang tidak dapat diaplikasikan di Indonesia. Lembaga Shariah Nasional di Indonesia menegaskan bahwa jenis perjanjian tersebut adalah haram (fraudulent) sehingga di larang untuk diaplikasikan.  Dalam hal ini, akad dibagi menjadi dua bagian, yaitu dari bank untuk nasabah dan dari nasabah untuk bank. Jelaslah bahwa ini adalah riba yang terselubung. Berkenaan dengan keamanan rasa percaya (dhaman), tidak terdapat perbedaan antara ke dua negara. Alasan untuk mengadopsi keamanan ini hanya karena didasarkan prudensialitas dalam pembiayaan yang dikucurkan kepada nasabah.Keywords : contract, Murabahah, ba’I al-Inah, Dhaman

Abstract

There are significant differences in the practice of murabahah scheme between Indonesia and Malaysia. The most distinct feature between them is in the adoption of bai’ ail-inah in Malaysia wich is not applicable in Indonesia. National Shariah Council of Indonesia condemns such contract as fraudelent, and hence is fobiddento apply. Here, the contract is designated to be two folds, namely from the bank to customers and from the customers to the bank. Clearly, this a disguised riba. In respect to the fiduciary security (dhaman), there is no difference between the both countries. The reasons for the adoption of the security is for the sake of prudentiality in financing disbursed to the customers.Keywords: Akad, Murabahah, Ba’i al-Inah, Dhaman

Abstract

This research is intended to identify the regulation and institution related to management of coastal area. Regarding the subject matter of this study, this research is a normative legal research. It employed several approach, i.e. conceptual approach and statutory approach.From this research, find out that (1) the authority of coastal area management can be found in sector regulation such as tourism, environmental, land, mining, forestry regulation, etc. It consequence that many institution will take about the coastal authority, (2) From the Institutional view, the activities of cross sector, overlapping and potentially creating a conflict of authority, all of this, need the institutional system with integration and coordinating priority, (3) The institutional approach by clear authority, strong institution and good procedure, can be increased effectively by the management of sustainable coastal area.Keywords: Institutional Approach; Effective Management of Coastal Area

Abstract

This article seek to discuss the concept of the state’s properties which are included in the state enterprises (BUMN), especially those which are in the form limited liability companies  (Persero). From legal perspective, state’s properties which are placed  in a limited liability companies  are separated properties. The inclusion of such properties in a limited liability company brings about a legal consequence, namely, such properties are then legally belong to the company instead of the state. A limited liability company is an independent entity, and hence, physically, the said state’s properties are then deemed as the share. It suffices to conclude therefore, that the state can not in any way in possession of the company as a whole, but rather merely on the limited amount of share.Keywords: State Enterprise, Limited Liability Company,  separated state’s properties.
