Abstract

The research discusses: First, the existence of traditional law community and its regulation in Constitution 1945; second, the attempts that the traditional law community (MHA) must do as to preserve their values in a community; third, the relevance between theory and concept in preparing the development and making of the legal instrument for MHA values conservation. The literature study was conducted by collecting the primary and secondary materials to answer the research questions. The findings conclude that: First, the MHA position has been ratified as stipulated in Article 18B verse (2) and Article 28 verse (3) of Constitution 1945 and in other sectoral laws. Second, the MHA status and other traditional rights are not yet able to apply due to internal factors including the contradiction between the regulations of law related to MHA regulation and external factor, which is state institutions such as Ministry of Forestry and Ministry of Mining with formal evidence can easily turn down the MHA claim and its traditional rights. Third, the strengthening of MHA status and its traditional rights will increase if the Central Government describes them in the more concrete law.Key words : Conservation, MHA, constitutional rights

Abstract

This research was conducted to answer two problems: first, the counter measures for criminal acts in households, especially the acts related to two decrees, those are Decree No. 98/Pid.B/2007/PN.YK and Decree No. 273/Pid.B/2010/PN.SLMN. Second, the settlement taken related to those two decrees. The research used normative method. The findings show that: first, criminal acts in household scope especially ones related to Decree No. 98/Pid.B/2007/PN.YK and Decree No. 273/Pid.B/2010/PN.SLMN are countered by functionalize Article 41 verse (1) of Law No. 23 of 2004 on Domestic Violence Regulation. Second, the settlement of those two cases is conducted using repressive legal process that can prove that those two defendants had convincingly and legally conducted criminal act in form of violence against their wives. Consequently, District Court of Yogyakarta decided six-month imprisonment, and District Court of Sleman decided one-year imprisonment for the defendants.

Abstract

This research rises the problems as follows: First, which factors contribute to the ineffective implementation of border area development policy. Second, whether Cross Border Approach model as relevant policy alternative will be implemented in the border area development and what pre-requisites are needed. This research used field survey method with interview, observation, and literature study techniques. The analysis model was conducted interactively. The findings conclude: First, the factors used in the development policy model by the government is less relevant with the area characteristics, including bureaucracy culture which is still sectoral, weak authority of border management board, inconsistency between technical policy and the border development paradigm, and isolated geographical condition which needs extra-ordinary treatment. Second, cross border approach is quite strategic to be policy model alternative for border development with some of its strength, among many, the program discussed is beneficial for both parties, the program is interest-based and the implementation is responded quickly by the government without undergoing complicated sectoral level.

Abstract

This research studies: first, legal problem of Banking Guaranty Law in International Syndication Loan Collateral; second, mechanism of fixed collateral to cash collateral transmission which can be implemented in International Syndication Loan Collateral in Indonesia. Third, perspective of fixed collateral to cash collateral transformation in International Syndication Loan Collateral for the development of Civil Law in Indonesia. The method used was normative juridical using qualitative descriptive analysis method. The research findings conclude: First, the prevailing collateral law in Indonesia currently has not yet given assurance to the infrastructure project management to be trusted in channeling great amount of fund from International Loan Syndication. Second, Collateral Legal System in Indonesia is still unable to settle some problems, such as large amount of collateral value, small amount of collateral types which is not equal with the amount of loan limit, the relatively large value change of project, and loan execution involving other country’s legal system. Third, regulation perspective on the transformation and transmission of fixed collateral into cash collateral can be conducted in two alternatives.

Abstract

This research discusses: First, the practices of states in marine natural resources utilization by foreign countries. Second, regulation model of marine natural resources utilization by foreign countries to be able to give contribution for fishery industry in Indonesia. The method used in this research was normative juridical, The conclusions are first¸ the practices of coastal states in marine natural resources utilization by foreign countries have complied with the international sea law provisions considering some aspects, namely conservation, economic, and culture. Second, regulation and implementation models of natural resources implementation in Indonesia fishing area that can develop fishery industry in Indonesia are through an integrated fishing company by the establishment of a joint-venture company. Abstract

The legal status of Persero assets causes different interpretation of the definition of state finance in several regulations of law. This research studies: First, legal characters of Persero; second, legal status of Persero assets. This research is normative research referring to legal principles and norms stipulated in the regulations of law. The instruments used to collect the legal materials were literature and document studies. This research concludes that first, Persero is identical with Limited Liability Company. Persero is not public legal entity but private legal entity subject to private law. Second, all assets of a Persero belong to the Persero instead of state. State asset in the Persero is the shares owned.

Abstract

This research discusses: First, the juridical ratio of the position of People’s Consultative Assembly’s adjudication which re-enters the regulations of law hierarchy. Second, the position and legal status of the People’s Consultative Assembly’s adjudication based on Law Number 12 of 2011 on the Formulation of Regulations of Law compared with the position and legal status of the previous People’s Consultative Assembly’s adjudications. The research method used in this research was normative-juridical method. The approach used was historical and statute approaches. The research finding shows that: First, the position of People’s Consultative Assembly’s adjudication in the regulations of law hierarchy is condition sine quanon. Second, the legal status of the People’s Consultative Assembly’s adjudication based on Law Number 12 of 2011 is different from the People’s Consultative Assembly’s adjudications prior to the amendment of Constitution 1945 of the Republic of Indonesia. This is in regards with the fact that the People’s Consultative Assembly after the amendment of Constitution 1945 has the position as state high institution.

Abstract

The research focuses on the legal definition of land procurement for public use that caused many disputes in the past. The problem studied here is the understanding on public interest, land rights, and proper indemnification of the land owners and the land procurement acting authorities. This research is qualitative research with socio legal approach using constructivism paradigm. The research used data from field study and literature study. The findings conclude that the dispute on the land procurement for public use was caused by injustice because of legal understanding gap between the land owners who viewed law as traditions and values prevailing in society and the land procurement acting authorities who viewed law in form of regulations which was comprehended only in formal-textual context.
