The development of internet, undeniably, has multidimensional implications and specific characters of cyberspace. In fact, mostexisting laws have been provided and created for there alworld. There fore, the questions are whe therornot the laws  for realworld provide for cyberspace? Should laws for cyberspace differ from those for realworld? Is it a must to have a specific Cyberlaw? On August 1, 2001 the government ratified Law No 14 2001 concerning Patent in place of the previous Law. in fact, the reisnothing wrong with Indonesian Patent Law. Unfortunately,the implementation of such law still face various obstacles. The following article will high light problems in implementing patent in Indonesia, and efforts to establish an effective, genuine, and realistic patent system.

Abstract

A number of controversial policies taken by President Abdurrahman Wahid, for example,concerning the discharge of the head of Indonesian police (Kapoiri), have brought about strong reaction and critic from Legislative Assembly /People's Consultative Council.The conflict bet vifeen two institutions had become worse when President Wahid issued a decree on July 23, 2001 which, eventually, made him loose his power (mandate) in thespecial session of People Consultative Council. The special session or President's policyto fire Kapoiri, if examined from the constitutional law point of view, caused polemic among society, especially in respect to the basis of law employed byeach party.This incidents how edhow vulnerable thes ystem established by constitution is, because some important problems in the constitutional law have not been set up clearly andexplicitly in the constitution. There fore, the constitutional reformationisan urgent agenda which must be finishe das soon as possible.

Abstract

As a correction of local govemmerit regulation according to Law No. 5 1974 which is centralistic in nature, the advent of Law No. 22 1999 isexpected to blow the wind of change In the substance and the paradigm of the real autonomy. That is, the mechanismof decentralization system which guarantees (respects) the existence of local government Independence in regulating and arranging their home affairs and the dispersion ofnational revenue to local government for the even distribution of social justice. Never the less, the problems rises when the content of Law No 22 1999 runs against the amendment ofthe Constitution45, especially concerning article 18, article 18A, and article 18B. Namely, the confusion of decentralization which is placedas "principle/basic" in the (autonorhous)system of local government whereas in the oryitisa "process". The second is related to article 8(2) which gives privileges structurally to local government, while, on the otherhand, it can endanger the integrityof NKRI. To review the substance of Law No 221999 is a wise step in of fering solutions.

Abstract

The progress of modem technology recently makes the transformation of Information and mode of communication among human beings become easy and direct, especially in the world of trade. In deed, the business facilities which can be obtained easily through e- commerce gives some advantages, but, at the same time, it also gives birth a number of crucial legal problems. First, the substantive problem swhich include problems of data massage authenticity, electronic signature, validity, privacy or confidentiality, security, and availability. Second,the procedural problems which are related to jurisdiction or forum. To solve such problems, weneed to prepare certain instruments which support the establish ment ofsafe, effective and beneficial e-commerce transaction for all parties involved. In addition, we have toper form reformation and uniformity of law by referring to UNCITRAL Model Law as a fundamental guidance.

Abstract

The following article examines the possible reformation of the contract law Inrelation to the rising use of online  contract in commercial business activities. It'sgenerally recognizedthat the conventional contract law has been unable to over come various legal problems stemming from on line contract. There are three ways to reform such a contract law, namely:(1) through legislation by adopting some existing model sof law; (2) through the establishment of customary law like lexmer catoria; (3) through cases law. Though the arrangement through legislation is do nepartially, but the substance mustbe integrative so that It can run to ward a cyberspace.

Abstract

The following essay tries to address some issues related to patent right in Indonesia. It is found out from the study that the conception of patent right is not recognized in Indonesian traditional community. Demands for admitting and respecting the existence of  patent right have to do with the influence of legal ide as from the Schoolor Doctrine of Natural-Law which heavily stresses on human factors and the use of mind which have been familiar and well known'in the system of civil law in European Continents. The conceptof patent right, including its law protection in Indonesia, still faces various obstacles, specially cultural ones.

Abstract

The Problem of legal security and certaintyis a negative effect of e-commerce development. The efforts togive legal protection to customers canbe done by using The Most Characteristic Connection Theory. Indonesian contract law can only be applied if thesuppliers of internet payment service are in Indonesia. In spite of the fact that Indonesian authentication law has been unfamiliar with digital signatureas written evidence, the emerging controversy can be settled by using conventional ADR or on line ADR agency.

And even though press products can be qualified as consumption goods (such as information), the legal protection is based on the provisions of Press Act.
