Abstract

Aturan hukum merupakan produk penyelenggara Negara yang diharapkan dapat menyelesaikan permasalahan, menciptakan keadaan tertentu yang diinginkan oleh pembentuknya. Dalam kerangka berfikir yang demikian, maka situsai dan kondisi yang melatarbelakangi proses terbentuknya aturan hukum mempunyai pengaruh besar atas substansi pengaturannya. Pemikiran tersebut dapat dibuktikan, dengan mengungkapkan berbagai aturan yang pernah ada dalam sistem hukum Indonesia sejak masa kemerdekaan hingga saat reformasi telah digulirkan.The purpose of the rules that compose by the state organ is to solve the problem and create definite situation trough the creator idea. Base on the reason, the background (situation and condition) of law making process will be influence the substance of the output (rules). This idea can be proof by description most of the rules form the beginning of the Indonesian independence till the reformation.

Abstract

Konsep komunal religius merupakan salah satu hasil penuangan hukum adat sebagai bahan utama dalam pembentukan UUPA, di samping  asas-asas, dan lembaga hukum serta sistem pengaturan yang menjadi isi politik Hukum Tanah Nasional. Dalam hukum adat mengenai tanah, konsep komunal religius mengandung makna, bahwa tanah ulayat diyakini sebagai anugerah dari kekuatan gaib dan sebagai milik bersama. Hak milik pribadi hanya berlaku dalam pengertian hak memperoleh dan mengurus atau mengelolanya. Konsep ini kemudian diimplementasikan dalam UUPA dengan bentuk penguasaan tanah secara individual, dengan hak-hak atas tanah yang bersifat pribadi, sekaligus mengandung unsur kebersamaan (Pasal 16 jo Pasal 20, Pasal 6 UUPA). Jadi regulasinya direfleksikan untuk lebih diarahkan pada pendaftaran hak perorangan atas tanah. Dampaknya status “ayahan” yang awalnya melekat pada tanah-tanah adat yang dikuasai secara individu akan hilang karena tanah tersebut telah didaftarkan melalui konversi.The concept of communal religious is one of the pouring of customary law as the main ingredient in the formation of the BAL, in addition to the principles, institutions and legal and regulatory system that became the political content of the National Land Law. In the customary law of the land, the concept of communal religious meaning, that the lands believed to be the gift of supernatural powers and as belonging together. Private property is only valid in the sense of rights to obtain and administer or manage. This concept is then implemented in the BAL with the form of individual land ownership, with rights over land that is private, as well as an element of togetherness (Article 16 in conjunction with Article 20, Article 6 BAL). So regulation is reflected to be more focused on individual rights to land registration. The impact the status of “ayahan” which was originally attached to the customary lands which are held by an individual will be lost because the land has been registered through the conversion.

Abstract

Dinamisasi penormaan dalam hukum Islam tergantung pada perbedaan dalam penerapan dan perkembangan Islam. Hal ini juga dipengaruhi oleh kondisi perkembangan hukum Islam di berbagai Negara. Hukum Islam merupakan hukum yang hidup yang inherion dalam kehidupan umat Islam. Oleh karena itu Norma Islam tidak lagi dirasakan sebagai norma yang dipaksakan dari luar oleh umatnya. Perkembangan hukum Islam di Indonesia, ditandai perbedaan seru yang melakukan dua teori Receptio in competen dan teori receptive.Dynamic naming dependent differences in Islamic law for the implementation and development of Islam. It is also influenced by the development of Islamic law in various countries. Islamic law is the law of life that inherion in the lives of Muslims. Therefore the Islamic norms are no longer perceived as the norm imposed from the outside by his people. The development of Islamic law inIndonesia, marked differences which make the two theories exciting receptio in compten and receptive theory.

Abstract

Warga binaan dalam lembaga pemasyarakatan mempunyai kedudukan yang rentan terhadap pelanggaran Hak Asasi Manusia. Oleh karena itu pejabat atau petugas lembaga pemasyarakatan perlu memahami dan mengimplematasikan UU No. 12 Tahun 1995, serta UU No. 39 Tahun 1999. Lembaga pemasyarakatan dalam melaksanakan fungsinya mendasarkan pada asas pengayoman, persamaan perlakuan dan pelayanan pendidikan serta penghormatan harkat dan martabat manusia, karena warga binaan sebenarnya hanya kehilangan kebebasan sementara, tetapi mereka tidak kehilangan hak-hak yang lainnya.Inmates in correctional institutions has a vulnerable position against human rights violations. Therefore, officers or prison officers need to understand and mengimplematasikan Law. 12 of 1995, as well as Law. 39, 1999. Correctional institutions in carrying out its functions based on the principle aegis, equality of treatment and education services as well as respect for human dignity, because the inmates actually lost only temporary freedom, but they do not lose the rights of others.

Abstract

Perempuan mempunyai kedudukan mewaris dari harta bersama, menurut Hukum Adat Sasak, karena dalam perkawinan mempunyai andil besar dalam mengumpulkan harta bersama dengan suami, mulai dari mencari, memutuskan membeli barang, mengelola, dan pengalihan barang yang sudah dibeli Yang berhak menerima warisan dari harta bawaan suami, istri, atau harta bersama sebagian besar menjawab anak. Domain hukum adat, yaitu; Pertama, tempat (desa), waktu (kala), dan keadaan (patra), yang mempengaruhi pembagian warisan. Kedua, Laki-laki yang memperoleh bagian warisan yang besar, kurang memahami arti “bagian besar” yang diterimanya, “bagian yang besar” berbanding lures dengan kewajiban yang dipikul. Ketiga, Kenyataan di lapangan menunjukkan, perempuan yang merasa kurang diuntungkan dengan pembagian warisan yang sudah dilakukan dengan jalan musyawarah, tidak banyak yang menuntut pembagian warisan dari harta bersama, karena takut di lepaskan dari kekerabatan.The women have right to inherit from the marital properties based on the Adat Sasak Law because they have the importance role in collecting those properties with their husbands in fraying, deciding, managing and transferring those property, the children are beneficaries of their parents who most enttitle to bequeth the individual and the marital properties of their parents, the barrier faced by the women beneficiaries in Adat Sasak Law are: (1) the domein of adat law, namely space (desa), time (kala), and circumstances (patra) affecting in deviding those inheritance; (2) the men (in the case the sons) obtaining the larger share are not understand the sense of the larger share. In Adat Sasak Law the larger share are linear to the duties and liabilities for those men; (3) the reality in the field shows the women obtaining the unadvantege share decided by unanimous decision did not appeal to this decision because the fear to be alienated from their clans.

Abstract

Bank syariah salah satu tujuannya ialah profit oriented sebagai intermediary finansial institution di samping sebagai lembaga baitul maal Bank syariah bisa  menerima dana yang berasal dari zakat, infak, sedekah, hibah, atau dana sosial lainnya yang diantaranya berasal ta’zir. Bank syariah juga menyalurkannya dana sosial yang berasal dari wakaf uang kepada pengelola wakaf (nadzir) sesuai dengan kehendak pemberi wakaf (wakif). Pelaksanaan fungsi sosial harus sesuai dengan ketentuan UU Pengelolaan Zakat dan UU Wakaf.Bank of  Moslem law one of its target is profit oriented as financial institution intermediasi beside as institute of baitul maal. Bank of Moslem law can accept the fund coming from zakat , infak, alms, hibah, or other social fund  which among other things come the ta’zir. Bank of Moslem law also channel it  social fund coming from communal ownership of money to communal ownership organizer (nadzir) as according to will ;desire of communal ownership giver (wakif). social Function execution have to pursuant to Statute of Management of Zakat  and Statute of Wakaf.
