Abstract

Perkawinan Anak masih menjadi persoalan serius di Kota Metro, ditandai dengan tingginya permohonan dispensasi nikah dan meningkatnya kasus kehamilan pranikah pada remaja. Masalah ini berimplikasi luas pada aspek pendidikan, kesehatan reproduksi, psikologis, ekonomi, hingga pembangunan manusia berkelanjutan. Melihat posisi strategis orang tua dalam pengasuhan dan pencegahan risiko remaja, pengabdian ini dilakukan untuk memberdayakan orang tua anggota Organisasi Muslimat sebagai mitra utama dalam upaya pencegahan Perkawinan Anak. Kegiatan menggunakan pendekatan Participatory Action Research (PAR) melalui tahapan riset bersama, perencanaan partisipatif, pelaksanaan workshop dan sesi edukasi, serta evaluasi reflektif. Hasil pengabdian menunjukkan peningkatan pemahaman peserta mengenai regulasi perkawinan, risiko kesehatan reproduksi, dan dampak sosial-psikologis pernikahan dini. Selain itu, ditemukan perubahan sikap dan peningkatan keterampilan komunikasi orang tua dalam mendampingi remaja, termasuk keberanian membahas isu sensitif terkait pubertas dan kesiapan menikah. Program juga memperkuat peran Organisasi Muslimat sebagai agen edukasi keluarga di tingkat komunitas. Secara keseluruhan, kegiatan ini menunjukkan bahwa pemberdayaan orang tua merupakan strategi efektif dan relevan untuk menekan praktik Perkawinan Anak serta mendukung tercapainya tujuan pembangunan keluarga dan perlindungan anak.

Abstract

The concept of harta gono-gini (joint marital property) constitutes a fundamental pillar of Indonesian family law, reflecting principles of economic justice and shared responsibility between spouses. This study aims to comparatively analyze the regulation and implementation of joint property within three major legal systems operating in Indonesia, namely Indonesian Civil Law, Islamic Family Law, and Javanese Customary Law. Using a normative legal research method supported by limited empirical data, this research examines statutory provisions, legal doctrines, court decisions, and living customary norms related to marital property.The findings reveal that all three legal systems substantively recognize joint property as assets acquired during marriage through the mutual contribution of husband and wife. However, significant differences emerge in their philosophical foundations and mechanisms of distribution. Indonesian Civil Law emphasizes formal legal certainty and tends to apply an equal division principle, while Islamic Family Law prioritizes proportional justice based on both economic and non-economic contributions. Meanwhile, Javanese Customary Law focuses on social harmony, moral values, and contextual fairness, often resolving disputes through family deliberation rather than formal litigation.The coexistence of these legal systems illustrates Indonesia’s legal pluralism, which creates both opportunities for contextual justice and challenges in the form of legal disharmony and jurisdictional overlap. This study concludes that legal pluralism in joint property regulation should be viewed as a legal asset rather than an obstacle. Therefore, an integrative approach to harmonizing national family law is necessary to ensure legal certainty while accommodating substantive justice aligned with Indonesia’s socio-cultural diversity.

Abstract

This research is motivated by the importance of Islamic financing in supporting the growth of micro, small, and medium enterprises (MSMEs), particularly through the Murabahah contract, which is the flagship product at BMT Asy-Syafi’iyah Kota Gajah. Murabahah financing is considered capable of providing affordable, transparent, and Sharia-compliant capital solutions, thus requiring an evaluation of its implementation effectiveness for MSME actors. This study aims to determine the extent to which Murabahah financing contributes to business development, ease of access to financing, and the suitability of fund usage with business needs. The research method used is a qualitative approach with a descriptive design. Data were collected through in-depth interviews, observation, and documentation, with informants consisting of the head of BMT, account officers, and Murabahah financing customers. Data analysis was conducted through reduction, presentation, and conclusion drawing, with triangulation as the validation technique. The results show that Murabahah financing at BMT Asy-Syafi’iyah Kota Gajah effectively increases business turnover, expands production capacity, and facilitates working capital for MSME actors. Easy application procedures, direct mentoring, and the alignment of funds with business needs are the main supporting factors for the effectiveness of this financing. Thus, Murabahah financing is proven to play a positive role in empowering MSMEs sustainably
