<![CDATA[ABSTRACTThe testator had instructed that the inheritance should be divided equally between the daughters and sons. It was the duty of heirs to adhere to their wishes. However, during a dispute that was resolved in court, it was found that the judges disregarded the testator's will and divided the inheritance with the sons receiving twice as much as the daughters. The research is a normative juridical study with two objectives: 1. to understand the considerations of the judges in disregarding the testator's will; 2. to determine if all court decisions are in accordance with KHI. Research findings: 1. Testator's will disregarded due to principle of ultra petitum, limited to the claims submitted, and conflicting with hadith; 2. All decisions are in line with KHI.Keywords: Testator’s Wish; Islamic Inheritance; KHI; Abandonment.ABSTRAKPewaris pernah berwasiat agar kelak harta warisan dibagi rata antara bagian anak perempuan dan laki-laki. Sepeninggal pewaris, sudah seharusnya isi wasiat dilaksanakan oleh ahli warisnya. Namun, saat terjadi sengketa hingga berakhir di persidangan ternyata majelis hakim dalam memutus perkara mengabaikan wasiat pewaris dan justru membagi harta warisan dengan bagian anak laki-laki sebesar dua kali lipat bagian anak perempuan. Penelitian ini adalah yuridis normatif. Tujuan Penelitian adalah untuk: 1. Mengetahui pertimbangan majelis hakim yang mengabaikan wasiat pewaris dalam memutus perkara; 2. Mengetahui apakah seluruh putusan Majelis Hakim telah sesuai KHI. Hasil penelitian: 1. Pengabaian wasiat oleh Majelis Hakim disebabkan adanya Asas Ultra Petitum sehingga hanya dapat memutus sebatas gugatan yang diajukan dan karena isi wasiat bertentangan dengan hadist; 2.
