Abstract

This paper is entitled Considerations of the Banyumas Regency Minimum Wage Amount by the Banyumas RegencyWage Council. This study aims to determine the process of implementing the Banyumas Regency minimum wage in2023. This research is a sociological juridical research with the subject of study by the Banyumas RegencyManpower, Cooperatives and SMEs Service. The aim of this research is to build synergy between the BanyumasRegency Wage Council and the obstacles in determining the minimum wage in Banyumas Regency. Wages areincome received by workers in the form of money, which includes not only wages/salaries, but also overtime andallowances received on a regular basis, excluding holiday allowances which are annual, quarterly, and otherallowances which are not routine. Wages are all kinds of payments arising from work contracts, regardless of thetype of work, which are a form of income received by workers as compensation for the work they do. To determinethe district minimum wage in accordance with community standards, the district minimum wage is determined bythe government, namely the district Department of Manpower, Cooperatives and Small and Medium Enterprises.Keywords: Wages, Wage Council, Banyumas Regency

Abstract

This study aims to find out the implementation of Banyumas Regency Regional Regulation Number 19 of 2014concerning Protection and Services for Persons with Disabilities (Especially the Protection and Fulfillment of HealthRights for Persons with Multiple Disabilities), and to find out the obstacles faced in the implementation of thefulfillment of the right to Health for persons with multiple disabilities. This research uses sociological juridicalresearch methods. The collection of research data was carried out by means of field interviews and observationssupported by literature studies. Data analysis in this study is descriptive qualitative. Based on the results of researchand discussion, it can be concluded that Iimplementation of Banyumas Regency Regional Regulation Number 19 of2014 concerning Protection and Services for Persons with Disabilities (Especially Protection and Fulfillment ofHealth Rights for Persons with Multiple Disabilities) has been implemented by The Banyumas Social and Communityand Village Empowerment Office (Dinsospermasdes) with the existence of social rehabilitation and communityparticipation of the Paguyuban Peduli Disabiltas Ganda (PPDG) through its work program that handles 95 peoplewith multiple disabilities with a percentage of 11% of the number of people with multiple disabilities in BanyumasRegency. In the implementation of the fulfillment of health rights, there are obstacles that must be faced, namely thelimited professional or competent human resources owned, data on persons with disabilities in Banyumas Regencyhave not been updated thoroughly, the limited budget available for the implementation of the fulfillment of the rightto k health of persons with disabilities, lack of family awareness of the rights of persons with disabilities due toshame and they prefer to hide their children, limited access to information from and for people with disabilities

Abstract

This study aims to determine how the implementation of the Generation Planning Forum in BanyumasRegency for the period 2020 - 2022 in overcoming juvenile delinquency. And how are the efforts of the localgovernment of Banyumas Regency in promoting the Banyumas Generation Planning Forum so that theprograms and objectives that have been prepared by the Banyumas Planning Generation Forum can beachieved. To achieve this goal, this study uses a sociological legal researchmethod, with the specifications ofobservational research. In this study, the data source used is secondary data which is supported by primarydata. The data presentation method in this thesis is presented in the form of a structured and systematicdescription. This research was conducted at the Department of DPPKBP3A Banyumas Regency. Based on theresults of research and discussion, it can be concluded that it can be seen that the Implementation of theGeneration Planning Forum in Banyumas Regency in tackling juvenile delinquency has been carried outproperly in accordance with the Work Program that has been formed in the Decree of the Head of the Office ofPopulation Control and Family Planning,Women's Empowerment and Child Protection. Banyumas RegencyNumber 476/497/2020, but there are several programs that have not been implemented dueto the Covid-19pandemic. The efforts of the Banyumas Regency Government in promoting the Banyumas GenerationPlanning Forum by coordinating the Banyumas Generation Planning Forum with relevant agencies, namelyall sub- districts in Banyumas Regency in the form of monitoring so that it can assist the BanyumasGeneration Planning Forum in achieving the stated goals.

Abstract

This study aims to determine the Consumer Protection Civil Servant Investigator (PPNS-PK) on the distribution of cosmetics thatare not registered at the Food and Drug Supervisory Agency (BPOM) Central Java, to find out the Constraints of ConsumerProtection Civil Servant Investigators (PPNS-PK). PK) on the circulation of cosmetics that are not registered with the Food andDrug Supervisory Agency (BPOM) of Central Java, to find out the efforts of the Consumer Protection Civil Service Investigator(PPNS-PK) in overcoming the circulation of cosmetics that are not registered with the Food and Drug Administration (BPOM).BPOM) Central Java. The method used is normative juridical, namely legal research carried out by examining library materialsor data as basic materials for research to be carried out by tracing regulations and literature related to the problems studied.Research Results: The role of Civil Servant Investigators for Consumer Protection in supervising cosmetics that are not registeredwith the Food and Drug Supervisory Agency of Central Java, which is in accordance with article 59 paragraph (1)-(4) of Law no.8 of 1999 concerning Consumer Protection, Constraints of Consumer Protection Civil Servant Investigators in the circulation ofcosmetics are not registered with the Central Java Food and Drug Administration, namely business actors do not have clearaddresses for cyber patrol officers assistance, Civil Servant Investigator Efforts Consumer Protection in overcoming thecirculation of cosmetics that are not registered with the Food and Drug Supervisory Agency of Central Java, namely by providinga complaint channel through digital media.

Abstract

Parking is one of the components or inseparable aspects of the needs of the transportation system, because every trip by private vehicle generally always starts and ends at the parking lot. Basically parking is a public need that initially functions to serve. In accordance with this function, parking space is adjusted according to demand in line with the needs of people who drive to be in or access a place. Regarding parking, it has been regulated in Article 1 of Law Number 22 of 2009 concerning Road Traffic and Transportation, which reads: "Parking is when the vehicle stops or does not move for a while and is left by the driver. Problems arise when Parking Guidance and Determination of Parking Facilities are not carried out properly, this is where the government is required to be able to solve existing problems, to fulfill these objectives through Cilacap district regional regulation no. 6 of 2018 concerning the implementation of transportation, Article 26, Article 27 and Article 35, it is hoped that the Cilacap Regency Transportation Service can work optimally in its implementation. Coaching is a process, manufacture, method of coaching, renewal, efforts and actions or activities carried out in an efficient and effective manner. The approach method in this study is the approach method used in the research is normative juridical, namely an approach that uses a positivist-legislative conception. The concept of positivist legislature is written norms made and promulgated by authorized officials and views law as a normative system that is independent, closed and detached from real community life

Abstract

Abstrak . Banyumas Regency is one of the regencies that received the highest ranking for corruption prevention. According to the Corruption Eradication Commission's Monitoring Center for Prevention (MCP) corruption prevention instrument, Banyumas Regency is ranked sixth at the national level with an index of 95.79. This research was conducted to find out the strategies of the Banyumas Regency Regional Government in preventing corruption of the Regional Budget (APBD) in Banyumas Regency and the obstacles of the Banyumas Regency Regional Government in implementing strategies to prevent corruption of the Regional Budget (APBD) in Banyumas Regency. The research method used is normative juridical using secondary data sources and primary data sources in the form of data from interviews with the Banyumas Regency local government consisting of the Regional Secretariat of the Legal Section and the Banyumas Regency Regional Inspectorate. Based on the results of the study, that the strategies and effective efforts of the Banyumas Regency local government in preventing corruption of the Regional Budget (APBD) in Banyumas Regency can be done through the establishment of regulations, handling conflicts of interest, fostering the State Civil Apparatus (ASN), using the Monitoring Center for Prevention (MCP), using the Whistleblowing System (WBS), using complaint stalls, conducting investigative audits, implementing the Government Internal Control System (SPIP), and carry out the duties and functions of local government on the regional revenue and expenditure budget (APBD). The obstacles of The Banyumas Regency Regional Government in preventing Corruption in the Regional Budget (APBD) in Banyumas Regency include delays in the implementation of activity schedules, the effectiveness of regulations, and the incompatibility of public complaints. Abstract

The aim of this research is to determine the process of applying military law to military members who commit the crime of desertion based on the military criminal code and to find out the obstacles to military law against military members who commit the crime of desertion based on the military criminal code. The type of research in writing this thesis is normative juridical research, and the approach method used is law, analytical and case approaches with clinical legal research writing of a perspective nature. The data collection technique was a literature study. The results show that the application of military criminal law to members of the Indonesian National Army who are proven to have committed a criminal act of desertion is the authority of the military court to try them, then the stages are in the form of investigations carried out by the Military Police on the orders of a superior who has the right to punish (Ankum). Then the investigation file is given to the military prosecutor to be studied, then the military prosecutor makes the indictment to be submitted to the military court, after the court feels that the files from the military prosecutor are sufficient, the military court will try military personnel accused of desertion. Furthermore, the constraints in law enforcement related to the crime of desertion are viewed from 4 interrelated aspects, namely concerning the substance of the law, the legal structure itself, facilities or infrastructure, and society. Settlement of cases in military justice is currently well regulated, however, it is hoped that all those who play a role in the military case settlement process carry out all these stages based on Justice and Positive Law. Abstract

This study aims to find out how the implementation of population administrationservices for making birth certificates at the Department of Population and CivilRegistration of Banyumas Regency and to find out how the obstacles or obstaclesfaced and the efforts made by the Office of Population and Civil Registration ofBanyumas Regency, it can be concluded that the implementation of servicespopulation administration making birth certificates at the Department ofPopulation and Civil Registration of Banyumas Regency in accordance withRegional Regulation Number 18 of 2015 concerning Population Administrationin Banyumas Regency where the service has fulfilled the quality of service well allaspects in the service are based on applicable regulations and have standardprocedures in carrying out properly according to applicable regulations.However, the implementation of the service has not been optimal, there are stillobstacles in its implementation, there are several obstacles and problems thatmust be improved, such as the ability of employees to update the system andHuman Resources for the Department of Population and Civil Registration ofBanyumas Regency.

Abstract

Penulisan ini bertujuan untuk mengetahuifaktor-faktor apakah yang mempengaruhiPolitycal will (kemauan politik) pemerintah dalammerumuskan kebijakan dalam pembangunanhukum perburuhan Indonesia. Denganmendasarkan bahan kepustakaan sebagai bahankajian utama, penulis mencoba menganalisisfenomena empiris dalam pelaksanaan hukumperburuhan Indonesia dengan teori-teori hukumyang dikemukakan oleh beberapa sarjana sebagaipisau analisanya. Dasar pijakan yang digunakanoleh penulis adalah pemikiran bahwa hukummerupakan produk politik, sedangkan politikmerupakan kendaraan kepentingan. Dengandemikian korelasi antara kepentingan dengansebuah produk hukum sangatlah dekat.Pergeseran hukum perburuhan dari privat menjadibersifat publik, menyebabkan materi hukumperburuhan sepenuhnya berada di tanganpemerintah. Sebagai pembentuk hukum, makapemerintah juga sebagai pemegang kekuasaanpolitik dalam bidang hukum, sedangkan dalammerumuskan kebijakan hukum pemerintah akandipengaruhi oleh banyak kepentingan di luarkepentingan hukum. Abstract

Sampah telah menjadi masalah serius bagi lingkungan, yangmerugikan kehidupan masyarakat. Dampak negatif terhadap lingkungandapat berupa gangguan terhadap kualitas air, udara, tanah, dankenyamanan lingkungan. Permasalahan pengelolaan sampah salahsatunya terjadi di Tempat Pembuangan Akhir (TPA) Kaliori, KecamatanKalibagor, Kabupaten Banyumas. Faktor-faktor yang menyebabkanterjadinya sengketa antara Pemerintah Daerah Kabupaten Banyumasdengan masyarakat di sekitar kawasan Tempat Pembuangan Akhir(TPA) Kaliori adalah pencemaran air (bocornya penampungan air lindi),yang menyebabkan air sumur menjadi kecoklatan sehingga tak dapatdikonsumsi, selain itu sawah juga tercemar sehingga tidak bisa lagiditanami. Penelitian ini bertujuan untuk mengetahui apakah dampakpenutupan TPA Kaliori terhadap pengelolaan sampah di KabupatenBanyumas dan bagaimanakah peran Dinas Lingkungan Hidup (DLH)Kabupaten Banyumas dan masyarakat dalam penyelesaian sengketapengelolaan sampah yang terjadi di Tempat Pembuangan Akhir (TPA)Kaliori. Penelitian ini termasuk ke dalam tipe penelitian hukum empiris.
