Thisresearch used literature study based of construtivism theory and correspondence with thestakeholder. Based on construtivism AICHR succeed to construct norms of human rights inASEAN region. Furthermore AICHR could not implemented the works plan in child soldierscase in Myanmar because of the hard mechanism to carried out that case. The mechanismrequire both representative of AICHR and Myanmar to carried out that case in AICHRsummit. Another reason for the failed implementation are the existence of non-interventionprincipal and weakness of protection function of AICHR.

Abstract

TKI is foreign exchange hero for Indonesia. TKI send remittances to Indonesia about tens oftrillions rupiah. However, the contribution of remittances is not balanced with the guaranteeof TKI human rights protection. Informal workers sector or domestic workers was the mostvulnerable sector to human rights violations, including forced labour, such as unpaid wages, the job does not match with the contract of employment, confinement, and physical andpsychological violence. One of the major destination countries of TKI placement is SaudiArabia, where about 40% of the total number of TKI torture and deaths occur there. SaudiArabia is a member state that has ratified the International Labour Organization (ILO)concerning forced labor, which are the Forced Labour Convention (No. 29) and the Abolitionof Forced Labour Convention (No. 105). However, the practice of forced labor is still foundunresolved, including against informal sector workers. This study aims to find out why forcedlabour Saudi Arabia could have. In answering these objectives, this study uses constructivismparadigm and compliance theory. The method used in this research is qualitative method withdescriptive-analytical type through interviews and literature technics. Results from this studyis that there are three factors that cause forced labour in Saudi Arabia, they are Saudi Arabiahas not yet understand the provisions of the convention because of the applied domesticnorms there, then Saudi Arabia has limited capacity to conduct labour inspection, and theabolition of forced labor is not a priority interest of Saudi Arabia.

Abstract

Taiwan holds a significance position for Indonesian economy, one of which can be seenfrom the large number of Indonesian Migrant Workers who work in the country. On theother hand, due to the One China Policy, Indonesia does not have diplomatic relations withTaiwan because Indonesia prefers to recognize the sovereignty of the People's Republic ofChina. Related to these facts, this research aims to determine and analyze the implicationsof the One China Policy toward the protection of Indonesian Migrant Workers in Taiwanbetween 2010 until 2014. Research frameworks used in this analysis are the concept ofhuman security, multi-track diplomacy and rational choice. The method of this research isqualitative with explanative type of research. From this research, it is known that theabsence of diplomatic relations between Indonesia and Taiwan, which are the consequenceof the One China Policy, has weakened the human security protection of the IndonesianMigrant Worker in Taiwan provided by the Government of Indonesia. In addition, inadequate protection of Indonesian Migrant Workers in Taiwan is also caused byspineless bargaining power possessed by Indonesia compared to Taiwan, especially inrespect to imbalance economic relationship between the two.
