Abstract

This research is explain the cooperation done by Indonesia and the Netherlands in the effort of preventing smuggling of narcotics and distribution to Indonesia by transnational crime syndicate. The research method used in this research is qualitative method, descriptive research type of analysis, and through library data collection techniques. Analysis of cooperation was also conducted to test the follow-up of cooperation between the two parties, namely Indonesia and the Netherlands. Cooperation in this research is analyzed by using achievement approach and interest which can be elaborated with the framework of thinking that is realism paradigm, concept of bilateral cooperation, and interest concept. The results of this analysis then prove that the cooperation between Indonesia and the Netherlands implemented in the relationship JCLEC - CILC - Interpol, is a less effective cooperation because there are still many interests between the two parties. This is because the absence of an Indoneisa-Dutch extradition treaty is due to prosecute the defend Narcotics Crimes who escaped to the Netherlands can not be done even though there has been communication to both parties up to Interpol.

Abstract

TKI is foreign exchange hero for Indonesia. TKI send remittances to Indonesia about tens oftrillions rupiah. However, the contribution of remittances is not balanced with the guaranteeof TKI human rights protection. Informal workers sector or domestic workers was the mostvulnerable sector to human rights violations, including forced labour, such as unpaid wages,the job does not match with the contract of employment, confinement, and physical andpsychological violence. One of the major destination countries of TKI placement is SaudiArabia, where about 40% of the total number of TKI torture and deaths occur there. SaudiArabia is a member state that has ratified the International Labour Organization (ILO)concerning forced labor, which are the Forced Labour Convention (No. 29) and the Abolitionof Forced Labour Convention (No. 105). However, the practice of forced labor is still foundunresolved, including against informal sector workers. This study aims to find out why forcedlabour Saudi Arabia could have. In answering these objectives, this study uses constructivismparadigm and compliance theory. The method used in this research is qualitative method withdescriptive-analytical type through interviews and literature technics. Results from this studyis that there are three factors that cause forced labour in Saudi Arabia, they are Saudi Arabiahas not yet understand the provisions of the convention because of the applied domesticnorms there, then Saudi Arabia has limited capacity to conduct labour inspection, and theabolition of forced labor is not a priority interest of Saudi Arabia.

Abstract

Worldwide illegal drug trafficking has been constantly increasing. Many countries believethat drug crimes need a special penalization to give a deterrent effect to the perpetrators,one of which is in the form of capital punishment. Indonesia is one of the countries thathas been placing death penalty to the drug users as well as the traffickers. This widelycontroversial approach has been equally applied to many offenders regardless of theirorigins; locals and foreigners, including recently to the Brazilian drug traffickers. Thisresearch discusses the influence of Indonesian death penalty policy to the Brazilians drugtraffickers and how it effects the relations of Indonesia and Brazil. This study found thatthe death sentence policy in Indonesia has made quite an impact to the bilateral relations ofBrazil and Indonesia, where it particularly affects several aspects of economy, military,and especially political relations of the two countries. This research is carried out by usingdescriptive-explanative and qualitative method, focusing on the process and the actualevent of the case gathered from a number of sources and data. This study incorporates theframework of rational choice theory of the decision making policy as the conceptual basisof the research.

Abstract

Indonesia, Malaysia and Singapore formed cooperation to handle armed robbery in MalaccaStrait in 2004 named Malsindo. The type of this researchis analytic describtive usingqualitative method to apply neoliberalism theory. This research is aimed to know the reasonmeasures to combat armed robbery cases in Malacca Strait between 2004-2013. The result ofthis researchfinds that 11 September 2001 inUnited States had triggered fear among coastalstates about the potential attack to merchant ships in Malacca Strait, thus caused MalsindoCooperation had just formalized in 2004. This research also finds that measures taken by partsstates to combat armed robbery consists of Malacca Strait Sea Patrol (MSP) which waslaunched in 2004, Eyes in The Sky (EIS) which was launched in 2005 and MSP-IS in 2006.

Abstract

spread all over the country’s provinces. Those situations were realized by BNN as theprime government organization for Narcotic crime in Indonesia with the main source ofthis problems is China. So that, the Indonesia and Chinese Governments establishedMemorandum of Understanding (MoU) for eradication of illicit drug syndicates in 2012.The purpose of this research is to know the effectiveness of a relation between Indonesiaand China in eradicating illicit drugs syndicates. The research methodologies are withqualitative method, descriptive-analysis type of research, and the data collection ofinterview and literature review type. Since the MoU activated in 2012, a qualitativeanalysis of effectiveness did in purpose of testing the relations between Indonesia andChina based on three parameters, which are: communication intensity, result of eradication,and appreciation. Results from the analysis based on the parameters will prove that thecooperation between the nations are effective and can be refer to ‘Golden Triangle’. Thereason of this results are because there were an increasing number in disclosure of the caseand people arrest that affected to the reduction of the drugs users in 2014.

Abstract

Indonesia is one of the country with a high level of corruption. One issue that stands out isBLBI (Bank Indonesia Liquidity Assistance). This problem then developed to complexwhen the suspects fled to neighboring countries, namely Singapore. To overcome this, in2007 Indonesia - Singapore conclude an extradition treaty. But after that Indonesia delaythe extradition treaty, because Singapore input this agreement in DCA (DefenseCooperation Agreement). By using the theory of realism and globalization to see thatthreatened state security and corruption offenses be transnational crime, as well asqualitative methods, this study analyzes why Indonesia postponed the extradition treatybetween Indonesia and Singapore 2007-2014, particularly in cases of corruption. The studyfound that although the delays Indonesia to ratify the extradition treaty, which leads to thedifficulties of law enforcement for criminals who flee to Singapore, Indonesia will remainin his stance by not ratifying the extradition. Abstract

The increasing rate of fish consumption in the world has made some countries flocking tofulfill their needs of fish. In the process of fulfilling their needs of fish, they are doingeverything they can, both legally and illegally, in these case through Illegal UnreportedUnregulated Fishing. The act of these IUU fishing has caused a lot of damage and losses tothe affected countries and also could ruin the ecosystem of the affected sea. Indonesia as acountry with plenty of fish resources has became an appealing target for these act. One of theneighbouring countries who has been caught doing these act was Vietnam. To reduce thefrequencies of these illegal act and lessen the damages and losses, Indonesia cooperated withVietnam by making a Memorandum of Understanding or MOU. These cooperation betweenIndonesia and Vietnam ended with a good result, thankfully. This research was done in orderunderstand the factors of the successful cooperation against IUU fishing between Indonesiaand Vietnam. In accordance to achieve the goal of these research and solve the problem thatoccured, it was done by using theory of international cooperation, analyzing the indicators ofsuccess of the cooperation, concept theory of foreign policy and theory of cooperation inliberalis-paradigm, These research was done in qualitatif method with descriptic-analythicalway through journal research and interview. Results of the study are the success ofIndonesia's cooperation with Vietnam in dealing with IUU fishing due to the proximity offactor, communications, law enforcement.

Abstract

South Korea and Japan are often involve in dynamics relationship which’s effected by thepast issue that bind both of them. That issue is about the existence of Yasukuni Shrine, theshrine became controversy because South Korea believe that the shrine represent Japan’sbrutality during World War II and colonialism were happened. The existence of theTemple stoked tensions and a critcism response from South Korea. Through this issue,South Korea want all of the problem that involve Japan in the past such as ComfortWomen, history text books, and the ownership of Dokdo / Takeshima to be settled. Thepurpose of this study are to compare the foreign policy of Lee Myung Bak and the ParkGeun Hye as the President of South Korea towards the issue of Yasukuni Shrine as asymbol of war crimes. Writer uses neo realism perspective for the theory. For the methodof research writer uses descriptive analytic and qualitative data analysis. The result of theresearch explain the similarity of foreign policy by President Lee Myung Bak andPresident Park Geun Hye and also the difference of foreign policy towards YasukuniShrine Issue as the symbolistic of war crime.

Abstract

Indonesia’s marine fisheries become targets of fishery crime because of the abundant fisheriesand marine resources. One of the fishery crimes that occurred is the practice of IllegalUnreported Unregulated (IUU) Fishing which mostly conducted by foreign vessels comingfrom neighboring countries such as Thailand. Indonesia seeks to cooperate with Thailand toaddress the practice of IUU fishing in Indonesian waters because of the losses incurres as aresult of IUU Fishing. One way to do is to establish bilateral agreements in the form of aMemorandum of Understanding on Fisheries Cooperation that took place in 2002-2006. Thecooperation has ended, and both countries are seeking to carry out a new partnership in 2013.But in fact the signing of the agreement has been delayed. The problem that arises is what thefactors that cause delay such cooperation are. This research aims to determine the factors thatled to postponement of the signing agreement. This research found that the Indonesia-Thailand cooperation has been delayed because there are some obstacles in the process ofsigning the agreement document such as factor the counter draft from each party and factor ofThailand political instability.
