Abstract

This paper are the result of research that aims to find about formulation of the Marriage Law of Islam in Indonesia that are gender responsive. This normative juridical research method with the approach of legislation, conceptual and historical. Analysis of legal materials using prescriptive analysis, by interpretation, argumentation and legal logic. The results showed that, gender relations in Islam Marriage Law in Indonesia, as stipulated in Law No. 1 of 1974 on Marriage and the Compilation of Islamic Law, was still gender bias. This is evidenced by still many chapters to be scrutinized, particularly Article 31 paragraph (3) and Article 34, concerning husband-wife relationship patterns unequal gender. Therefore, the need for a reformulation of Islamic Marriage Law to make it more gender responsive. Legal issues are problematic in Marriage Law of Islam, namely concerning the minimum age of marriage, the marriage guardian, polygamy and nushuz also need reformulated, based on three basic values of law as an analysis, by considering the concepts of Islamic law, in order to study on the legal that are gender responsive acceptable by the people.Paper ini merupakan hasil penelitian yang bertujuan untuk menemukan tentang formulasi mengenai Hukum Perkawinan Islam di Indonesia yang responsif gender. Penelitian yuridis normatif ini menggunakan pendekatan perundang-undangan, konseptual dan historis. Analisis bahan hukum menggunakan preskriptif analisis, dengan penafsiran, argumentasi dan logika hukum. Hasil penelitian menunjukan bahwa, relasi gender dalam hukum perkawinan Islam di Indonesia, yang tertuang dalam Undang-Undang RI Nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam, masih bias gender. Hal ini dibuktikan dengan masih banyaknya pasal-pasal yang perlu dikritisi, khususnya Pasal 31 ayat (3) dan pasal 34, mengenai pola relasi suami-isteri yang tidak setara gender. Oleh karena itu, perlu adanya reformulasi Hukum Perkawinan Islam agar lebih responsif gender. Isu hukum problematis dalam Hukum Perkawinan Islam, yaitu tentang batas usia menikah, wali nikah, poligami dan nusyūz juga harus direformulasi, berbais tiga nilai dasar hukum sebagai analisa, dengan mempertimbangkan konsep-konsep hukum Islam, agar kajian tentang hukum yang responsif gender,diterima oleh masyarakat.

Abstract

The global pandemic Covid-19 that occurred in Indonesia made people experience a difficult situation that requires assistance in terms of support, material and financial. Zakat as a source of social funds in Islam has a strategic role to meet these needs. This study examines the importance of zakat for tackling the Covid-19 pandemic. This research is a library research and data collection technique carried out through library studies, using Islamic legal philosophy approach, and results in the conclusion that zakat may be given to Covid-19 affected parties, both for medical teams, corona patients and one of citizens who family has confirmed positive corona, people affected by PHK due to phsycal or social distancing implemented by the government to minimize the transmission of Covid-19, etc

Abstract

The study aims to explain that contemporary zakat literacy is able to become one of the methods of zakat therapy, considering the results of the zakat literacy index conducted by the BAZNAS strategic study center related to public understanding of zakat, in general, are still at a moderate level and very low in advanced understanding including in understanding related to contemporary zakat. Contemporary zakat has the potential to be utilized in the benefit of the existing mustahiq zakat, considering the various kinds of contemporary zakat. The more muzakki who spend their wealth to pay zakat, the more mustahiq zakat that can be eradicated from poverty too. The study used a qualitative descriptive approach. The results of this study indicate that a person's level of understanding regarding contemporary zakat greatly influences the potential for greater zakat, so that contemporary zakat literacy can become one of the methods of zakat therapy. Contemporary zakat literacy can be a therapy for prospective muzaki to carry out zakat obligations from something that they do not know much about the existence of contemporary obligations on assets. Zakat therapy makes a person calm, feel the blessing of wealth and is able to cleanse the soul from all kinds of heart diseases. Zakat awareness is raised by carrying out zakat literacy, especially contemporary zakat literacy so that more people understand the contemporary concept of zakat and pay zakat sincerely and wholeheartedly.

Abstract

Maulid Nabi is one of the most developed traditions in Indonesian society. Almost all regions have their own characteristics in the tradition of celebrating the Prophet's Maulid. The celebration of the Prophet's Maulid in various regions is held every 12 Rabiul Awwal as gratitude for the birth of the Prophet. However, there is something unique about one of the traditions in Tegal, namely the Tekuinan Tradition. This tradition aims to welcome the birthday of the Prophet, but its implementation is not on the 12th but on the 8th of Rabiul Awwal. In fact, this tradition also has its own meaning for the local community and scholars. Through a phenomenological approach, this paper discusses the Tekuinan tradition at the Al-Munawar mosque, Kejambon Village, Tegal City. The results of which state that it is a Living Hadith because basically this tradition is inspired by a poem in the Barzanji book, which is mostly sourced from hadith. In this paper, we will discuss the understanding of the community and scholars towards this tradition and also what traditions are brought to life in the Tekuinan tradition.

Abstract

Artikel ini mengupas tentang pelaksanaan pengabdian masyarakat dilaksanakan untuk tujuan meningkatkan literasi hak-hak reproduksi perempuan di kalangan kader PAC Fatayat NU Pecalungan. Pengabdian ini dilatari oleh rendahnya pemahaman dan literasi terhadap fikih kewanitaan dan hak reproduksi perempuan yang dapat berdampak pada berbagai problem keagamaan, medis maupun psikologis. Metode pengabdian yang digunakan adalah service learning yang terbagi dalam tiga tahap: pra-implementasi, implementasi, dan pasca-implementasi. Temuan menunjukkan adanya kekurangan pemahaman pada beberapa aspek krusial, seperti identifikasi darah haid, qadla’ shalat, perbedaan antara darah haid dan darah istihadlah, serta masalah kesehatan reproduksi seperti kanker payudara dan endometriosis. Melalui kegiatan FGD dan lokakarya, upaya ditempuh untuk meningkatkan pemahaman masyarakat terkait hak-hak reproduksi perempuan, baik dalam aspek fikih maupun non-fikih. Evaluasi secara berkala dilakukan untuk memastikan kelangsungan dan efektivitas program ini dalam memberikan dampak positif pada masyarakat, dengan melibatkan kajian rutin yang dipimpin oleh Tim Pengabdi.

Abstract

Penelitian ini bertujuan untuk memahami strategi pengembangan fasilitas wakaf masjid di Indonesia, dengan fokus pada Masjid Nurul Falah yang berlokasi di Desa Pedawang, Kecamatan Karanganyar, Kabupaten Pekalongan. Dalam konteks sejarah panjang wakaf di Indonesia, masjid-masjid sering dibangun di atas tanah wakaf dan memiliki peran penting dalam kehidupan sosial keagamaan masyarakat. Penelitian ini menempatkan diri sebagai studi kualitatif dengan metode deskriptif, yang membahas bagaimana pengurus Masjid Nurul Falah mengembangkan fasilitas wakaf secara produktif. Data dikumpulkan melalui wawancara, dokumentasi, dan observasi, lalu dianalisis secara deskriptif. Hasil utama penelitian menunjukkan bahwa Masjid Nurul Falah memiliki keunggulan strategis, tidak hanya dari sisi lokasi, tetapi juga peran sosialnya yang aktif melalui berbagai kegiatan pendidikan dan dakwah. Strategi pengembangan yang diterapkan mencakup optimalisasi fasilitas, pemanfaatan lokasi strategis, serta peningkatan kualitas sumber daya manusia melalui program-program keagamaan yang berkelanjutan. Penelitian ini menyimpulkan bahwa pendekatan partisipatif dan pengelolaan yang terstruktur menjadi kunci dalam pengembangan masjid wakaf produktif.
