Abstract

This paper aims to reveal the concept of maqasid sharia-finding method according to Tahir ibn Ashur. It argues that Ibn Ashur’s approach to search for maqasid sharia revolves around three methods. The first is inductive method. This method can be done through the induction of many ‘illat (reasons) that have the same hikmah (goals) and the induction of many dalil (provisions) that have the same ‘illat (reasons). The second is al-bayan al-nashshi method. This method refers to understanding of explicit provisions (dalil) in the Qur'an as they leave no room for alternative interpretations according to Arabic language traditions. The third is sunnah mutawatirah method. This method is divided into mutawatir ma’nawi and mutawatir 'amali. Mutawatir ma'nawi is an inference resulted from testimonies of many shahaba (the Prophet's companions) concerning a Prophet's particular action. Actions that are considered mutawatir ma'nawi include those that are clear, bright and axiomatic in nature (ma'lum min al-din bi al-dharurah), or at least close to ma'lum min al-din bi al-dharurah. Meanwhile, mutawatir ‘amali is an inference resulted from a testimony of one shahaba concerning actions always repeated by the Prophet.

Abstract

The global pandemic Covid-19 that occurred in Indonesia made people experience a difficult situation that requires assistance in terms of support, material and financial. Zakat as a source of social funds in Islam has a strategic role to meet these needs. This study examines the importance of zakat for tackling the Covid-19 pandemic. This research is a library research and data collection technique carried out through library studies, using Islamic legal philosophy approach, and results in the conclusion that zakat may be given to Covid-19 affected parties, both for medical teams, corona patients and one of citizens who family has confirmed positive corona, people affected by PHK due to phsycal or social distancing implemented by the government to minimize the transmission of Covid-19, etc

Abstract

Aset produktif (mustaghallat) adalah harta yang tidak termasuk dalam jenis harta yang wajib dizakati, tetapi memiliki potensi keuntungan yang dapat melebihi harta zakat. Ulama fiqh klasik umumnya membatasi kewajiban zakat pada komoditas tertentu yang telah dijelaskan oleh Nabi Muhammad, yaitu emas dan perak, hasil pertanian, ternak (unta, sapi, dan kambing), harta perniagaan, rikaz (harta temuan) dan ma'adin (produk pertambangan). Sementara itu, para ulama fiqh kontemporer berbeda pendapat mengenai kewajiban zakat atas aset produktif, nishab dan tata cara pembayarannya. Artikel ini mencoba membahas pendapat ulama kontemporer dan menyimpulkan bahwa harta produktif wajib dikeluarkan zakatnya jika keuntungan yang dihasilkan telah mencapai batas nishab emas setelah perputaran tahun (haul) sejak keuntungan tersebut dihasilkan.

Abstract

Based on the underlying approach, in general, two types of research can be distinguished, namely research with a qualitative approach and research with a quantitative approach. The two approaches have different assumptions, goals, characteristics and procedures. The aim of this article is to understand conceptually the various fundamental characteristics of each approach. The method used in writing this article is literature study by collecting library sources and reconstructing them. The result is that the qualitative approach makes all aspects of human life the object of study. For this reason, the qualitative approach has become very synonymous with the field of human sciences. Meanwhile, the quantitative approach describes natural (and also social) phenomena using numbers, which requires measuring the level of certain characteristics of an observed phenomenon. The different paradigms of quantitative and qualitative approaches cause the research processes and results of the two approaches to be different.
