Abstract

The Constitutional Court's decision Number 46/PUU-VIII/2010 concerning the status of children born out of wedlock is a revolutionary decision made by the Constitutional Court. The decision stated that children born out of wedlock not only have a civil relationship with the mother and their mother's family, but also have a civil relationship with their biological father and biological father's family which can be proven based on the development of science and technology. The changes that occur in Article 43 paragraph (1) have implications for Islamic family law in Indonesia. The new law is interesting if reviewed using maqāṣid syarī'ah analysis with library research, with documentation data collection techniques, and uses two data sources, primary and secondary. The results showed that according to the maqāṣid syarī'ah analysis, the Constitutional Court's decision did not violate the the rules of syara', because it contained maṣlaḥah (goodness) and did not contain elements of ḍarar (damage) in the decision. This decision is also in line with the principles of maqāṣid syarī'ah, namely the principles of ḥifẓ al-dīn (protection of faith or religion), ḥifẓ al-nafs (protection of life), ḥifẓ al-‘aql (protection of intellect), ḥifẓ al-nasl (protection of lineage or ancestry) and ḥifẓ al-māl (protection of property or wealth). The implication of this decision is that children born out of wedlock have the same rights as children born from legal marriages, namely the right to lineage to their biological father, to earn a living, inheritance and equality before the law.

Abstract

The position of women is clear both in terms of Islamic perspective and in terms of state policies in the form of laws and regulations that have placed women in a dignified position that can develop themselves in carrying out their roles, duties and functions. On the other hand, participating in maintaining a balance between family responsibilities and work outside the household without neglecting roles in the household and maintaining social and religious culture values. The existence of women workers cannot be denied, both on a large scale role in the development of the nation and state as well as on the scale of status and family welfare by working outside the home (productive work) or social activities in irder to actualize themselves. This research seeks to find a tangent point between Islamic teachings and state policies in providing protection for the reproductive rights of female workers. The results of the study show that the concepts contained in Islamic teachings and state policies have many tangent points related to the obligation to provide protection for workers, especially female workers and the fulfillment of their rights for the benefit of mankind as a whole.

Abstract

New issues and phenomena that require legal certainty also develop along with the development of the times and the social context. The Qur'an and Sunnah, which only contain legal issues implicitly, require mujtahids to dig up the law with several methods, one of which is maslahah mursalah or istislah. This research tries to explore matters related to istislahi reasoning, starting from the concept, and limitations, to its implementation in the application of Islamic family law in Indonesia. This research uses a descriptive method with a critical review. The research results show that maslahah mursalah is basically based on preserving the purpose of syariah by taking benefits and rejecting harm (mafsadah). The limitations of this maslahah are: it is not merely conjectural so that it must produce benefits and reject harm (mafsadah), it is general, and it does not conflict with the principal rules of syara'. Thus, the application of the istislahi method in the formation of law is very necessary to face new problems and phenomena that require legal certainty.

Abstract

The theoretical study of the contradictions that exist in the hadiths of the Prophet s.a.w. has begun since the 2nd century Hijri. The existence of mukhtalif (contradictory) hadiths regarding a particular problem, practically can cause confusion in taking certainty of the teachings (legal provisions) that regulate the problem, which of them must be followed and practiced. In order not to be trapped in understanding hadiths that appear to be contradictory, it is necessary to discuss a study of hadith, namely the Mukhtalif al-Hadīth and its resolution. Mukhtalif al-Hadīth is a science that seeks to bring together (talfīq al-hadīth) several hadiths that contradict their meaning. Included in the definition of mukhtalif hadith are hadiths that are difficult to understand because of the existence of difficult-to-understand words. This article attempts to explore matters relating to the Mukhtalif al-Hadīth as well as its approach and method of solution so that readers can draw conclusions not to rush to reject hadiths that are considered contradictory before actually conducting in-depth verification.

Abstract

This article evaluates Indonesia's Islamic economic policies during the 2019–2024 period across four key sectors: Islamic banking, halal industry, sukuk and Islamic financing, and Islamic fintech. Adopting an explanatory sequential mixed-methods design, the study integrates descriptive quantitative analysis of secondary data from OJK, KNEKS, BPJPH, DJPPR, BPS, and the SGIE Report 2024/2025 with qualitative content analysis of policy documents, including MEKSI 2019–2024, RP3SI 2023–2027, POJK 2/2024 on Sharia Governance, and the Republic of Indonesia Green Bond and Green Sukuk Framework. The findings indicate that government interventions—including the merger forming Bank Syariah Indonesia, the issuance of green sukuk reaching a cumulative USD 7.7 billion through 2025, the digitalisation of halal certification via SiHalal, and the institutionalisation of KNEKS and 31 provincial KDEKS—are associated with measurable improvements: Indonesia's third place in the Global Islamic Economy Indicator, total Islamic financial assets of IDR 2,756.45 trillion as of June 2024, and rising Islamic financial literacy from 9.14% in 2022 to 43.42% in 2025. However, persistent challenges remain, namely a banking market share stuck at 7.72%, halal exports concentrated in non-OIC markets, and weak fintech governance. The study is limited to secondary data and does not include expert interviews. Future research should incorporate in-depth interviews and micro-level welfare assessments to strengthen causal interpretation.  Artikel ini mengevaluasi kebijakan ekonomi syariah Indonesia selama periode 2019–2024 pada empat sektor utama: perbankan syariah, industri halal, sukuk dan pembiayaan syariah, serta fintech syariah. Penelitian menggunakan desain explanatory sequential mixed-methods yang memadukan analisis deskriptif kuantitatif atas data sekunder OJK, KNEKS, BPJPH, DJPPR, BPS, dan laporan SGIE 2024/2025 dengan analisis konten dokumen kebijakan, antara lain MEKSI 2019–2024, RP3SI 2023–2027, POJK 2/2024 tentang Tata Kelola Syariah, dan Republic of Indonesia Green Bond and Green Sukuk Framework. Temuan menunjukkan bahwa intervensi pemerintah—mencakup merger pembentukan Bank Syariah Indonesia, penerbitan green sukuk dengan akumulasi USD 7,7 miliar hingga 2025, digitalisasi sertifikasi halal melalui SiHalal, dan pelembagaan KNEKS bersama 31 KDEKS provinsi—berasosiasi dengan perbaikan indikator yang dapat diukur, antara lain peringkat ketiga Indonesia dalam Global Islamic Economy Indicator, total aset keuangan syariah Rp2.756,45 triliun per Juni 2024, dan kenaikan literasi keuangan syariah dari 9,14% pada 2022 menjadi 43,42% pada 2025. Akan tetapi, tantangan struktural masih membayangi: pangsa pasar perbankan syariah bertahan di 7,72%, ekspor halal masih terkonsentrasi pada pasar non-OKI, dan tata kelola fintech syariah belum kuat. Penelitian ini terbatas pada data sekunder dan tidak menyertakan wawancara pakar. Penelitian lanjutan disarankan menambahkan wawancara mendalam dan kajian kesejahteraan tingkat mikro untuk memperkuat interpretasi kausal.

Abstract

The concept of nafkah (spousal maintenance) in classical fiqh is generally understood as the sole obligation of the husband, reinforcing male dominance within the household structure. This view is rooted in normative interpretations shaped by a patriarchal context, which tend to overlook contemporary social dynamics and the active economic role of women in family life. This article seeks to re-examine the legal construction of nafkah through a Systematic Literature Review (SLR) of both classical and contemporary fiqh literature, with particular emphasis on integrating the principles of maqasid al-shari‘ah and gender justice perspectives. The findings reveal that classical fiqh structurally reproduces gender inequality through textual readings that lack contextual sensitivity. In contrast, the thought of contemporary Muslim scholars and academics offers more egalitarian approaches, emphasizing collaboration and justice in household relations. This study recommends revising the fiqh al-munakahat curriculum, reforming Islamic family law regulations, and updating fatwas to be more responsive to social change. Thus, a reinterpretation of the concept of nafkah can contribute to the development of a more just, inclusive, and contextually relevant Islamic legal system.
