Abstract

Idealnya, pengelolaan wakaf modern dijalankan secara profesional, produktif, transparan, dan terintegrasi dengan perkembangan teknologi serta pembangunan ekonomi umat. Namun realitasnya, sebagian besar pengelolaan wakaf masih didominasi pola tradisional dengan kapasitas manajerial nazhir yang terbatas, lemahnya tata kelola kelembagaan, serta rendahnya optimalisasi aset wakaf produktif. Penelitian ini bertujuan untuk menganalisis transformasi peran nazhir dari pola tradisional menuju nazhir profesional dalam pembangunan ekosistem wakaf modern. Penelitian ini menggunakan jenis penelitian pustaka (library research) dengan pendekatan kualitatif-deskriptif melalui metode analisis isi (content analysis) terhadap berbagai literatur ilmiah, regulasi wakaf, dan dokumen kelembagaan terkait. Hasil penelitian menunjukkan bahwa profesionalisasi nazhir menjadi faktor strategis dalam penguatan tata kelola wakaf modern melalui peningkatan kompetensi manajerial, penerapan good waqf governance, pengembangan wakaf produktif, serta integrasi teknologi digital dalam pengelolaan wakaf. Transformasi tersebut menempatkan nazhir sebagai aktor penting dalam pembangunan Islamic social finance yang produktif, inklusif, dan berkelanjutan.

Abstract

This study aims to analyze the concept of had punishment for perpetrators of group theft in Islamic law based on primary sources (the Quran, Hadith, and the opinions of jurists from various schools of law), to identify differences in scholarly views regarding the criminal liability of each member of the group, and to assess the relevance and challenges of its application within the context of contemporary law. This article constitutes library research employing a qualitative approach with a descriptive-analytical methodology. The findings indicate that there are significant differences among Islamic legal schools in determining the had punishment for group theft. Some scholars argue that the punishment of hand amputation applies to all group members if all are directly involved and the legal requirements are fulfilled. Others, however, distinguish between the principal offender (muqtarin) and accomplices, while also considering elements such as coercion or lack of knowledge. The study further reveals that, in the contemporary context, the enforcement of had punishment for group theft is often associated with the principles of syubhat (legal doubt), restorative approaches, and human rights protection, thereby necessitating adaptive ijtihad without neglecting the principles of justice and the objectives of Islamic law (maqashid al-shariah).

Abstract

This community service program aimed to enhance community legal literacy regarding the legal protection of cyberbullying victims based on Indonesian positive law and the perspective of Islamic criminal law, while identifying the need for legal assistance for victims in Kampung Durian, Rantau District, Aceh Tamiang Regency, Indonesia. The program employed a participatory educational approach through legal awareness seminars, interactive discussions, legal consultation, and evaluation involving 35 participants, including community members, village officials, community leaders, and parents. Program evaluation was conducted using a descriptive approach based on observation, legal consultation, and a comparison of participants’ knowledge before and after the intervention. The findings indicate a substantial improvement in participants’ understanding of cyberbullying, victims’ rights, reporting mechanisms, and the importance of preserving digital evidence for legal proceedings. The program also revealed limited public awareness of legal protection procedures and identified a cyberbullying case that resulted in psychological distress, social exclusion, disruption of the victim’s right to education, and the need for legal assistance. This community service contributes to strengthening community legal awareness by integrating Indonesian positive law with the Islamic legal principle of ḥifẓ al-'irḍ within maqāṣid al-sharīʿah as a normative foundation for protecting the dignity and rights of cyberbullying victims.
