Abstract

Kegiatan pendaftaran tanah bertujuan untuk menjamin kepastian hukum dan perlindungan hukum kepada pemegang hak atas tanah. Peraturan mengenai pendaftaran tanah di Indonesia mengacu kepada Undang Undang Nomor 5 Tahun 1960 Tentang Peraturan Dasar pokok-pokok Agraria yang diatur lebih lanjut dalam Peraturan Pemerintah Nomor 24 tahun 1997. Di Indonesia masih banyak masalah dalam bidang pertanahan, salah satunya adalah kepemilikan ganda atas tanah. Sengketa tanah dapat diselesaikan dengan berbagai cara seperti musyawarah, penyelesaian melalui badan peradilan, atau arbritase. Penelitian ini menganalisa mengenai permasalahan kepemilikan ganda atas tanah serta upaya untuk menghindari terjadinya masalah kepemilikan ganda dengan mempelajari kasus sengketa tanah Hj Sutiah alias Hajjah Sutiah dkk. dengan kantor Bandung dan putusan pengadilan Tata Usaha Negara Nomor 103/G/2016/PTUN-BDG. Cara menyelesaikan sengketa tanah sangatlah umum untuk diketahui dan dilaksanakan, namun bagaimana cara untuk mengatasi agar permasalahan yang sama tidak terjadi lagi. Keputusan Tata Usaha Negara menurut ketentuan Pasal 1 angka 3 UU 5/1986 adalah suatu penetapan tertulis yang dikeluarkan oleh Badan atau Pejabat Tata Usaha Negara yang berisi tindakan hukum Tata Usaha Negara berdasarkan peraturan perundang-undangan yang berlaku, yang bersifat konkret, individual, dan final, yang menimbulkan akibat hukum bagi seseorang atau badan hukum perdata. Berkaitan dengan sertifikat tanah, sertifikat tanah dikeluarkan oleh pemerintah, dalam hal ini Badan Pertanahan Nasional selaku Badan Tata Usaha Negara ditujukan kepada seseorang atau badan hukum (konkret, individual) yang menimbulkan akibat hukum pemilikan atas sebidang tanah yang tidak memerlukan persetujuan lebih lanjut dari instansi atasan atau instansi lain (final).

Abstract

The absence of explicit regulatory mechanisms governing transitional governance in foundations experiencing total vacancy of organs (vacuum of management) has created legal uncertainty, particularly concerning the authority of business unit managers operating under foundations. This normative gap becomes increasingly problematic when foundations manage high-value social assets, raising questions about the limits of managerial authority and the legality of actions undertaken without formally legitimate governing organs. This study addresses two main research questions: (1) how Decision Number 590/Pdt.G/2023/PN Bdg is assessed from the perspective of the Indonesian Foundation Law (Law No. 16 of 2001 as amended by Law No. 28 of 2004); and (2) how judicial law-finding (rechtsvinding) was conducted to resolve the vacancy of foundation organs and its implications for the legal standing of business unit managers. Employing normative juridical research, this study applies statute, case, and conceptual approaches, supported by qualitative analysis of primary and secondary legal materials as well as contextual interviews. The findings demonstrate that the court adopted a dynamic positivism approach, affirming formal ministerial ratification as the decisive criterion of legal legitimacy while simultaneously applying corporate organ theory to clarify the separation of authority between foundation organs and business unit management. The decision confirms that operational continuity does not confer representative authority and that legal legitimacy must remain grounded in formal structure. Academically, this research contributes to the reconstruction of normative boundaries between foundation organs and business unit managers in situations of organs vacancy, highlighting the need for clearer transitional regulatory mechanisms to strengthen legal certainty and protect the social function of nonprofit foundations.

Abstract

This article evaluates Indonesia’s progress towards its national goal of food security. To meet the Indonesian population’s right to food by formulating national policies and supporting regulations on agriculture for food sovereignty while conducting economic diplomacy utilizing its membership in the WTO Agreement on Agriculture and the G33 coalition. Normative juridical research and comparative legal analysis examine provisions concerning agriculture in Indonesia’s national legal instruments and WTO’s Agreement on Agriculture. The article finds that Indonesia has failed to attain either food security or food sovereignty, postponed by international negotiations where developed countries object to the developing and least-developed countries’ Special Products and Special Safeguard Mechanism. The provisions are imperative for supporting Indonesia’s economic growth to attain food security and eradicate poverty, considering the significant gap between developed and developing economies. This article suggests that Indonesia strengthen its bilateral economic relations with influential, more economically developed members of the WTO agreement to garner international support to meet national food security and exercise Indonesia’s right to regulate within its jurisdiction, leading to food sovereignty.
