Abstract

The practice of vote-buying has been prohibited by law, but it remains a problem in the conduct of elections in Indonesia. Normatively, vote-buying is classified as a criminal offense, yet its persistence highlights a tension between the ideal of electoral justice and transactional political practices. This study aims to analyze the regulation of money politics as a criminal offense in Law No. 10 of 2016 and to examine its normative relevance to the concept of risywah as well as ta‘zīr sanctions in Islamic criminal law. This study employs a normative legal approach using descriptive-analytical and qualitative research methods, incorporating legislative, conceptual, and comparative legal approaches through an examination of legislation, legal doctrine, and fiqh al-jinayah literature. The research findings indicate that money politics substantially shares similar characteristics with bribery, as both involve the provision of material benefits to unlawfully influence choices or decisions. Furthermore, the sanction provisions in Law No. 10 of 2016, which grant judges discretion through minimum and maximum sentencing limits, demonstrate conceptual alignment with ta‘zīr in Islamic criminal law. This normative alignment confirms that both positive law and Islamic criminal law regard vote-buying as a prohibited act because it contradicts justice, the public interest, and the integrity of the democratic process.

Abstract

ABSTRACTThe Consumer Dispute Resolution Agency (BPSK) was established as an alternative institution for resolving disputes between consumers and businesses outside of court. One of the mechanisms used is arbitration, which aims to provide legal certainty for the parties involved. However, in practice, the enforcement of BPSK arbitration awards often faces legal obstacles that affect their effectiveness. This study aims to analyze the effectiveness of consumer dispute resolution through arbitration at the BPSK as well as its legal certainty based on the Consumer Protection Act (UUPK). Using a normative legal research method, this study examines secondary data and primary and secondary legal materials through a qualitative juridical approach. The results of the study indicate that although Article 54(3) of the UUPK states that BPSK awards are final and binding, there remains a legal loophole in Article 56(2) of the UUPK that allows for appeals to the courts. This situation creates legal uncertainty and undermines the effectiveness of BPSK arbitration awards in resolving consumer disputes. The conclusion of this study emphasizes that the regulations governing the BPSK require refinement to provide stronger legal certainty for consumers. Harmonization of relevant regulations is necessary to ensure that BPSK arbitration awards truly possess effective enforceability in Indonesian legal practice. ABSTRAKBadan Penyelesaian Sengketa Konsumen (BPSK) dirancang sebagai lembaga alternatif dalam penyelesaian sengketa antara konsumen dan pelaku usaha di luar pengadilan. Salah satu mekanisme yang digunakan adalah arbitrase, yang bertujuan untuk memberikan kepastian hukum bagi para pihak. Namun, dalam praktiknya, implementasi putusan arbitrase BPSK sering kali menghadapi kendala hukum yang memengaruhi efektivitasnya. Penelitian ini bertujuan untuk menganalisis efektivitas penyelesaian sengketa konsumen melalui arbitrase di BPSK serta kepastian hukumnya berdasarkan Undang-Undang Perlindungan Konsumen (UUPK). Dengan menggunakan metode penelitian hukum normatif, penelitian ini mengkaji data sekunder dan bahan hukum primer serta sekunder melalui pendekatan yuridis kualitatif. Hasil penelitian menunjukkan bahwa meskipun Pasal 54 ayat (3) UUPK menyatakan bahwa putusan BPSK bersifat final dan mengikat, masih terdapat celah hukum dalam Pasal 56 ayat (2) UUPK yang memungkinkan upaya keberatan ke pengadilan. Kondisi ini menimbulkan ketidakpastian hukum dan melemahkan efektivitas putusan arbitrase BPSK dalam menyelesaikan sengketa konsumen. Kesimpulan penelitian ini menegaskan bahwa regulasi yang mengatur BPSK memerlukan penyempurnaan agar dapat memberikan kepastian hukum yang lebih kuat bagi konsumen. Harmonisasi peraturan terkait diperlukan untuk memastikan bahwa putusan arbitrase BPSK benar-benar memiliki daya eksekusi yang efektif dalam praktik hukum di Indonesia.
