Abstract

This study examines the implementation of the maqasid sharia principles in the Free Nutritional Meals (MBG) policy in Indonesia, a government program aimed at improving the quality of health and education by providing nutritious meals for students. Despite its noble objectives, numerous cases of mass poisoning have demonstrated weaknesses in governance and quality control, raising questions regarding its compliance with Islamic ethical principles, particularly the protection of the soul (ḥifẓ al-nafs) and the protection of the mind (ḥifẓ al-‘aql). Previous studies have focused primarily on the socio-economic impacts of the MBG, but few have examined it from an Islamic public policy perspective, creating a research gap that needs to be filled. This study employed qualitative methods with a library research approach and content analysis of policy documents, fatwas, and related scientific literature. The results demonstrate the importance of strengthening regulations, transparency, and public participation so that the MBG policy is not only socially effective but also aligns with the principles of welfare and Islamic governance ethics.

Abstract

The expansion of Sharia-based e-commerce has given rise to consumer protection mechanisms, such as free return guarantees, that require examination from the perspective of Islamic commercial law. This study aims to analyze the implementation of the khiyar concept in Shopee Barokah’s Free Return Guarantee mechanism from the perspectives of classical Islamic jurisprudence (fiqh al-muʿāmalāt) and contemporary regulatory frameworks. This research employs a normative library approach by examining classical fiqh literature, DSN–MUI fatwas, and Shopee Barokah’s internal regulations and policies, with data analyzed descriptively to assess their conformity with Sharia principles. The findings demonstrate that the Free Return Guarantee mechanism substantively reflects the implementation of khiyar al-sharṭ through a specified return period, khiyar al-ʿayb through remedies for defective or damaged goods, and khiyar al-ruʾyah by allowing buyers to inspect goods after delivery and rescind transactions when appropriate. These mechanisms are consistent with the principles of justice, transparency, and consumer protection in Islamic economic law. This study contributes by integrating classical fiqh, DSN–MUI fatwas, and Sharia-compliant e-commerce regulations into a unified framework for analyzing digital return guarantees. However, the study is limited to normative analysis, and future research should incorporate empirical approaches to evaluate the practical implementation and effectiveness of khiyar mechanisms in digital marketplaces.

Abstract

Penelitian ini bertujuan untuk menganalisis peran sinergi digitalisasi dalam memperkuat ekosistem ekonomi dan keuangan syariah di Indonesia. Melalui pendekatan kualitatif berbasis kajian kepustakaan, penelitian ini mengkaji bagaimana kolaborasi lintas lembaga—seperti Bank Indonesia (BI), Otoritas Jasa Keuangan (OJK), Komite Nasional Ekonomi dan Keuangan Syariah (KNEKS), perbankan syariah, dan lembaga sosial Islam berkontribusi terhadap penguatan inklusi dan literasi keuangan syariah melalui pemanfaatan teknologi digital. Hasil penelitian menunjukkan bahwa digitalisasi melalui inisiatif seperti e-wallet syariah , zakat dan wakaf digital, serta festival ekonomi syariah (FESyar, ISEF, SEMESTA FEST, dan Sultra Maimo) berhasil meningkatkan efisiensi transaksi, memperluas akses pembiayaan, dan memperkuat sinergi antaraktor ekonomi syariah. Meski demikian, tantangan berupa rendahnya literasi (39,11%) dan inklusi keuangan (12,88%), serta ketimpangan infrastruktur digital masih menjadi tantangan utama. Penelitian ini menyimpulkan bahwa digitalisasi merupakan strategi jangka panjang dalam memperkuat daya saing industri keuangan syariah nasional dan mendukung visi Indonesia sebagai pusat ekonomi syariah global.
