Abstract

This study aims to analyze the Islamic legal perspective on the practice of buying and selling land without plants growing on it, as well as the views of the Hanafi school of thought on this matter. The questions are: First, what is the Islamic legal perspective on the practice of buying and selling land without plants growing on it? Second, how is the Hanafi school of thought analyzing the Hanafi school of thought on buying and selling land without plants growing on it? This study used a qualitative approach with textual study (Library Research) and normative and phenomenological analysis. The results show that, from the Hanafi school of thought, the sale of land without plants growing on it can be explained as follows: First, in the practice of buying and selling land that includes plants, according to Islam, the plants are sold along with the land. This is based on the understanding that plants are part of the land, so that ownership of the land and plants is transferred to the buyer. This is also in line with the customary practice ('urf) of society, which considers plants to be an inseparable part of the land, unless the contract stipulates otherwise. Second, according to the Hanafi school of thought, plants growing on land do not automatically become part of the land sale unless expressly stated in the contract. This view emphasizes the importance of clarity regarding the object of the contract in a sale and purchase transaction. Therefore, although the majority of scholars believe that the land sold includes the building and the plants on it, it is advisable to state the ownership of the plants in official documents, such as a land certificate or a deed of sale, to avoid future disputes and maintain prudence (iḥtiyāt).

Abstract

  Nowadays, we find various forms of jewelry accessories that use human body parts such as hair, nails, and umbilical cords as accessories. This unique jewelry has become a fashion trend among today's society. This study aims, First, to understand the process of making jewelry accessories that are added to them with human body parts such as hair, nails, and umbilical cords. Second, to analyze the law of buying and selling jewelry accessories that are added to them with body parts of the buyer such as hair, nails, and umbilical cords from the perspective of Islamic jurisprudence. This study uses a qualitative research type with library research methods and uses normative and phenomenological approaches.The results of this study: First, the process of making jewelry accessories is done manually by hand. Samples of hair, nails and umbilical cord belonging to the buyer are sent to the seller, then the seller makes the jewelry accessories by cutting the hair, nails and umbilical cord of the baby into small samples and then arranged in a jewelry pendant that has been poured with resin liquid to harden and become crystals or gemstones in the jewelry pendant. The time required is approximately 2 to 4 weeks to produce this unique jewelry. Second, the majority of scholars agree that the sale and purchase of human body parts is haram based on the evidence from the Quran and the Sunnah. Therefore, the sale and purchase of jewelry accessories that store body parts such as hair, nails, and umbilical cords is invalid or haram. The implications of this research are expected to become literature in the academic world and serve as a positive reference for the wider community, especially entrepreneurs, craftsmen, and economic actors.   Abstrak Saat ini kita menemukan beraneka ragam bentuk aksesori perhiasan yang menggunakan bagian tubuh manusia berupa rambut, kuku dan tali pusar sebagai aksesorinya. Perhiasan unik ini menjadi tren mode di kalangan masyarakat saat ini. Penelitian  ini bertujuan, Pertama, untuk mengetahui proses pembuatan aksesori perhiasan yang ditambahkan padanya bagian tubuh manusia seperti rambut, kuku dan tali pusar. Kedua, Untuk menganalisis hukum jual beli aksesori perhiasan yang ditambahkan padanya bagian tubuh pembeli seperti rambut, kuku dan tali pusar perspektif fikih mumalah Penelitian ini menggunakan jenis penelitian kualitatif dengan metode penelitian kepustakaan (library research) dan menggunakan metode pendekatan normatif dan fenomenologis. Hasil penelitian ini: Pertama, proses pembuatan aksesori perhiasan dilakukan secara manual dengan tangan. Sampel rambut, kuku dan tali pusar milik pembeli yang dikirimkan kepada penjual, kemudian penjual membuat aksesori perhiasan tersebut dengan cara memotong rambut, kuku dan tali pusar bayi menjadi sampel kecil kemudian disusun dalam bandul perhiasan yang telah dituangkan cairan resin agar mengeras dan menjadi kristal atau batu permata dalam bandul perhiasan. Waktu yang dibutuhkan sekitar 2 hingga 4 minggu untuk menghasilkan perhiasan unik ini. Kedua, Jumhur ulama bersepakat bahwa jual beli bagian anggota tubuh manusia  haram berdasarkan dalil-dalil dari al-Quran dan al-Sunnah  sehingga jual beli aksesori perhiasan yang disimpan padanya bagian tubuh pembeli dari rambut, kuku dan tali pusar tidak sah atau haram. Implikasi penelitian ini diharapkan menjadi literatur dalam dunia akademisi serta menjadi bahan rujukan positif bagi  masyarakat luas khususnya para pengusaha, pengrajin dan para pelaku ekonomi.
