Abstract

This study aims to analyze the shift in the Aceh regional government system following the enactment of Law Number 11 of 2006 on the Government of Aceh (LoGA) through a normative legal approach complemented by a sociological reading of the transformation of local political habitus. It also examines the implications of this legal transformation for the distribution of authority among the Aceh Government, the Aceh House of Representatives (DPRA), and the Central Government. This research employs a normative legal method using both the statutory approach and the conceptual approach. The analysis is based on primary legal materials, including relevant legislation, and secondary legal materials such as books, scholarly articles, and previous studies. These materials are analyzed qualitatively through the perspective of the sociology of law using Pierre Bourdieu's theory of habitus. The findings reveal that the LoGA has not only restructured Aceh's governance system by strengthening special autonomy and redistributing governmental authority but has also transformed local political habitus from a conflict-oriented and resistant disposition into a bureaucratic habitus characterized by institutional governance and democratic political participation. Furthermore, the redistribution of authority has reinforced the roles of the Aceh Government and the DPRA in regional governance while maintaining the supervisory and harmonization functions of the Central Government within Indonesia's national legal framework. This study concludes that the transformation of Aceh's governance system extends beyond formal legal reform, encompassing broader sociological changes that reshape political practices and power relations. Therefore, the effectiveness of Aceh's special autonomy depends not only on the legal authority granted but also on the capacity of governmental institutions to exercise that authority democratically, accountably, and in accordance with the principles of peacebuilding and the Unitary State of the Republic of Indonesia.

Abstract

Sinkronisasi antara perencanaan pembentukan undang-undang dalam Program Legislasi Nasional (Prolegnas) dengan perencanaan pembangunan nasional dalam Rencana Pembangunan Jangka Menengah Nasional (RPJMN) merupakan prasyarat penting bagi terwujudnya kepastian hukum dan efektivitas pembangunan. Secara normatif, penyusunan Prolegnas dan RPJMN harus dilakukan secara simultan dan saling terkait, mengingat hukum berfungsi sebagai sarana untuk mengarahkan dan mendukung pencapaian agenda pembangunan nasional. Namun, dalam praktiknya, kedua instrumen perencanaan tersebut masih sering berjalan secara parsial dan belum terintegrasi secara optimal. Penelitian ini bertujuan untuk menganalisis sinkronisasi antara perencanaan pembentukan undang-undang dalam Program Legislasi Nasional (Prolegnas) dengan perencanaan pembangunan nasional yang tertuang dalam Rencana Pembangunan Jangka Menengah Nasional (RPJMN), khususnya pada periode 2020–2024. Penelitian menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual melalui pengkajian bahan hukum primer dan sekunder yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa meskipun secara normatif penyusunan Prolegnas dan RPJMN harus dilakukan secara simultan dan saling berkaitan, dalam praktiknya masih terdapat ketidaksinkronan. Dari 37 kebutuhan regulasi yang tercantum dalam Kerangka Regulasi RPJMN 2020–2024, hanya 19 RUU atau sekitar 51,3% yang masuk ke dalam Prolegnas prioritas tahunan selama periode 2020-2024. Ketidaksinkronan tersebut menimbulkan berbagai implikasi berupa inefisiensi sumber daya, tidak optimalnya implementasi agenda pembangunan, fragmentasi kebijakan, ketidakpastian hukum, serta terhambatnya reformasi regulasi. Untuk mengatasi permasalahan tersebut, diperlukan integrasi kelembagaan antara Kementerian Hukum dan Bappenas dalam proses perencanaan hukum, serta penguatan mekanisme penelaahan dan filterisasi RUU berdasarkan kesesuaiannya dengan kebutuhan pembangunan nasional.

Abstract

This study provides a comprehensive and in-depth examination of how the law protects children born out of lawful marriage. Its primary focus is on the provisions contained in Law Number 1 of 1974 concerning Marriage and the reinforcement provided by Constitutional Court Decision Number 46/PUU-VIII/2010. The main issue highlighted in this research is the persistent uncertainty regarding the legal status and civil rights of children born out of lawful marriage, particularly when their parents’ marriage has not been officially registered. To address this issue, the study employs a normative legal research method, using a written regulation approach combined with case studies. This enables an analysis of how the law is applied in practice concerning the status of children born out of wedlock, through examination of court decisions and relevant legal provisions. The findings indicate that Constitutional Court Decision Number 46/PUU-VIII/2010 brought significant changes to the Indonesian family law system. The decision expands recognition of the legal relationship between children born out of wedlock and their biological fathers, provided that strong evidence is available, such as DNA test results. Consequently, the ruling emphasises the importance of respecting the fundamental rights of every child, regardless of their birth status, and encourages the state to guarantee children’s rights to identity and legal status through mechanisms such as itsbat nikah (marriage validation) and the determination of parentage in court. Overall, this study confirms that legal protection for children born out of wedlock represents a concrete application of the principles of substantive justice, legal certainty, and non-discriminatory treatment as mandated by the constitution and the national legal system of Indonesia.

Abstract

The rapid spread of hoaxes and defamation in the digital age has become a destructive phenomenon, causing serious consequences that include not only material losses, but also significant non-material damages such as ruined reputations, loss of public trust, and profound psychological suffering for both individuals and corporations. This condition creates a crucial juridical problem because positive law in Indonesia, despite having instruments like the ITE Law, has not yet provided clear boundaries (limitations) or objective, measurable parameters for assessing and quantifying such non-material damages within the judicial system. This research utilizes a normative legal method employing a statute approach and a conceptual approach, qualitatively analyzing primary legal sources such as the Civil Code, Criminal Code, the ITE Law and its amendments, as well as secondary legal sources through a comprehensive literature review. The results and discussion demonstrate that the forms of non-material damage, as recognized in Article 1365 of the Civil Code and legal theory, encompass a broad spectrum ranging from damage to honor (eer) and good name (goede naam) to psychological suffering (trauma and stress); however, the legal boundaries in Indonesia are dominantly penal-centric, focusing only on punishing the perpetrator (deterrence) rather than restoring the victim. This strong penal orientation in the ITE Law is proven to create systemic fragmentation separating the criminal and civil processes and a legal vacuum (rechtsvacuüm) in non-material remediation mechanisms, thereby necessitating a paradigm shift towards restorative justice supported by Supreme Court Guidelines (PERMA) to provide clear parameters for judges to assess non-material damages fairly and proportionally.
