Abstract

This research is motivated by the case of talak 1000 (a husband declaring divorce 1,000 times) which once occurred during the time of the Prophet Muhammad. Sayyid Sabiq, in Fiqh al-Sunnah Volume 2, mentions a case in which a man divorced his wife 1,000 times, and this was ruled as a triple divorce (talak tiga). The researcher also directly encountered a similar case of talak 1000. The practice of pronouncing 1,000 divorces outside the court raises legal issues, as there are differing scholarly opinions some maintain that repeated declarations count as a single divorce, while others uphold that they constitute three. Religious leaders in Banjar Regency express divergent views: some consider talak 1000 to amount to three divorces, while others believe it depends on the husband's intention at the time. The phenomenon of talak 1000 carries educational value for husbands but also creates legal confusion in society. This study aims to explore the perspectives of religious leaders in Banjar Regency regarding the case of talak 1000 as discussed in Fiqh al-Sunnah, and to examine the perceived positive and negative impacts of this practice according to their views.

Abstract

The concepts of sakinah, mawaddah, and rahmah (SAMAWA) constitute important objectives of marriage within Islamic family law. However, SAMAWA tends to be understood primarily as a normative-theological ideal, while its translation into relational ethics between husbands and wives has received insufficient attention. This study aims to reconstruct the concept of SAMAWA through Taha Abdurrahman’s I’timaniyya paradigm and formulate it as a framework of relational ethics in Islamic marriage. This study employs a qualitative approach using library research through normative and conceptual analysis. The sources include Qur’an Surah al-Rum (30): 21, exegetical literature and studies on SAMAWA, Taha Abdurrahman’s works on the I’timaniyya paradigm, and relevant previous studies. The data were analyzed using qualitative content analysis by comparing the conceptualization of SAMAWA in Islamic family law with the ethical principles of I’timaniyya. The findings indicate that the I’timaniyya paradigm enables SAMAWA to be reconstructed from an ideal objective of marriage into a relational ethic grounded in amanah (trust), moral responsibility, and ethical reciprocity. Sakinah is understood as relational tranquility and security, mawaddah as an ethical commitment to nurturing the relationship, and rahmah as the practice of caring for one’s spouse. This reconstruction expands the understanding of SAMAWA from a normative dimension toward relational practice without abandoning its theological foundation. The findings contribute to the development of Islamic family law, as well as premarital education and family counseling, although their practical application still requires empirical testing.
