Abstract

Polygamy remains one of the most debated issues in Islamic law, particularly amid growing demands for gender justice and the transformation of modern family structures. Although studies on polygamy from the perspective of maqasid al-shariah have expanded considerably, most prior research treats the concepts of rukhsah and maslahah in isolation, leaving a gap in integrated evaluative frameworks for assessing the substantive validity of polygamy on a case-by-case basis. This article aims to address that gap by analyzing polygamy through the conceptual relationship between rukhsah (legal dispensation) and maslahah (hierarchical public interest), and evaluating it against the five objectives of maqasid al-shariah, with specific reference to Islamic family law regulation in Indonesia. The study employs a qualitative-normative approach through library research, utilizing comparative analysis (muqaranah) of classical and contemporary usul al-fiqh sources alongside recent socio-legal studies. Three principal findings emerge: first, polygamy holds the status of a conditional rukhsah ibahah - a cause-bound legal dispensation, not a self-standing textual permission; second, the maslahah arguments advanced in support of polygamy operate only at the hajiyyah (secondary) level, while the potential mafsadah it produces - psychological neglect, economic instability, and domestic conflict - threatens interests at the daruriyyah (primary) level, rendering generalized justifications hierarchically untenable; third, Indonesia's regulatory framework is structurally consistent with the maslahah hierarchy, yet persistent implementation gaps - most notably the prevalence of unlicensed polygamy - critically undermine the realization of substantive maslahah. The principal contribution of this article lies in unifying the rukhsah-maslahah framework as a single evaluative lens, shifting the central question from "is polygamy permissible" to "under what conditions and through what institutional verification mechanisms may its rukhsah status legitimately be activated?"

Abstract

Donor ASI saat ini semakin mudah dilakukan, terutama dengan hadirnya platform seperti Lactashare yang mempertemukan ibu pendonor dengan bayi yang membutuhkan. Di balik manfaat medisnya, praktik donor asi ini menyimpan persoalan dalam hukum Islam dan juga terkait dampaknya terhadap hubungan mahram jika bayi menyusu kepada wanita lain. Penelitian ini bertujuan untuk mengkaji hukum donor ASI melalui bank ASI dalam perspektif fiqih dan implikasinya terhadap hubungan mahram berdasarkan prinsip radha’ah. Penelitian ini menggunakan metode kualitatif dengan pendekatan library research berdasarkan hasil analisis dari kitab fiqih klasik, pendapat ulama kontemporer, fatwa lembaga Islam dan juga jurnal akademik yang relevan. Hasil kajian menunjukkan bahwa ulama berbeda pendapat, ada yang membolehkan dengan syarat ketat dan ada juga yang melajarang karena khawatir kekacauan nasab. Fatwa MUI No. 28 Tahun 2013 membolehkan donor ASI asalkan indentitas pendonor dicatat dengan jelas agar tidak terjadi pernikahan antara saudara sepersusuan. Penelitian ini menyimpulkan bahwa donor ASI diperbolehkan asalkan syarat-syaratnya terpenuhi, khususnya kejelasan identitas pendonor demi menjaga nasab dan hubungan mahram.

Abstract

The rapid development of digital technology, particularly deepfake technology based on Generative Adversarial Networks (GANs) capable of producing highly realistic synthetic visual content, has raised significant legal and ethical questions within the Islamic scholarly tradition. This study aims to analyze the legal status of deepfake technology according to Islamic jurisprudence and provide normative guidance for the Muslim community in responsibly addressing the challenges of the digital age. Using a library research method with a normative-analytical approach, this study is grounded in verses of the Qur’an, hadith, and the framework of maqasid al-shar’iyah to categorize the use of deepfakes. The findings indicate that the use of deepfakes involving deception (tadlis), the deliberate spread of falsehoods (ifk), and distortion of meaning (tahrif al-ma’na) is deemed haram because it violates the principles of sidq (truthfulness) and amanah (trustworthiness), and causes widespread social harm (mafsadah ‘ammah). Conversely, the transparent and non-deceptive use of deepfakes, specifically for genuine educational purposes, can be justified based on the principle of maslaḥah mursalah. This study proposes the concept of fiqh al-asalah al-raqamiyyah (digital authenticity jurisprudence) as a contemporary normative framework for evaluating artificial intelligence based on Islamic values.
