Abstract

The development of digital technology has increased the utilization of songs and musical works through digital platforms, while simultaneously giving rise to various royalty disputes that affect the protection of the economic rights of copyright holders. This study aims to analyze legal protection for song and music copyright holders in royalty disputes in the digital era and to examine the weaknesses of the existing legal system. This research employs a normative legal research method using statutory, conceptual, and case approaches. The results indicate that legal protection of digital royalties in Indonesia still faces several obstacles, including weak supervision, a lack of transparency in royalty distribution, a suboptimal role for Collective Management Organizations (CMOs) and the National Collective Management Organization (LMKN), and low public legal literacy. Therefore, strengthening regulations and developing technology-based royalty management systems, such as blockchain and smart contracts, are necessary to establish effective, transparent, and equitable legal protection in the digital era.

Abstract

This article analyzes the legal construction of money laundering from environmental crimes from the perspective of the National Criminal Code and the strengthening of criminal accountability that needs to be built to answer the challenges of its enforcement. The background of this research is based on the increasingly complex of environmental crimes with an economic dimension, where the results of crimes are often disguised through various financial instruments to appear legally legitimate. The research uses normative legal methods with a statutory and conceptual approach, sourced from primary legal materials in the form of regulations related to money laundering and the environment, as well as secondary legal materials in the form of scientific journals and previous legal literature. The results of the study show that environmental crimes have not been explicitly and consistently recognized as the predicate crime of money laundering, while the investigative authority that has been expanded through the Constitutional Court's decision still faces obstacles in inter-institutional coordination. The research recommends strengthening the harmonization of norms between the National Criminal Code and money laundering regulations, accompanied by the consolidation of cross-sectoral investigation authority, so that the countermeasures against money laundering resulting from environmental crimes can run more effectively and responsive to the dynamics of natural resource-based economic crimes in Indonesia.

Abstract

This article analyzes the legal construction of money laundering from gambling in the perspective of the National Criminal Code and the criminal policies built against these economic crimes. The purpose of this study is to examine the synchronization of norms between the National Criminal Code and the Money Laundering Law, as well as evaluate the effectiveness of its criminal policies. The research uses normative legal methods with a statutory and conceptual approach, sourced from primary legal materials in the form of two main regulations and secondary legal materials in the form of previous scientific journals. The results of the study show that gambling has been explicitly categorized as a predicate crime in both regulations, so that the existing norms are textually harmonious. However, the effectiveness of its enforcement is still constrained because criminal policies tend to be reactive, oriented towards penal strategies only, and have not yet reached new modus operandi and transnational character of this crime. The research recommends strengthening integrative criminal policies, combining penal and non-penal strategies, accompanied by strengthening cross-border legal cooperation so that the prevention of money laundering from gambling can be more responsive to the dynamics of digital-based economic crimes in Indonesia.
