Abstract

The development of digital technology has given rise to various application-based financial services, one of which is paylater and online lending services. The presence of these services provides convenience for society in conducting transactions and obtaining funds quickly without complicated procedures. However, behind this convenience, various problems have emerged, especially those related to interest practices, late payment penalties, and the potential existence of usury (riba) elements that contradict the principles of Islamic law. This study aims to analyze the practices of paylater and online loans from the perspective of Islamic law and to examine their impact on society. The research method used is qualitative research with a normative approach, namely by examining sources of Islamic law such as the Qur'an, Hadith, fiqh principles, and literature related to modern financial transactions. The results of the study indicate that the use of paylater and online loans is basically permissible as long as they fulfill sharia principles, such as clarity of contract, and do not contain riba, gharar (uncertainty), or elements of injustice. However, most conventional paylater and online loan practices still involve interest and penalties that fall into the category of riba, making them generally impermissible according to Islamic law. Therefore, it is necessary to improve Islamic financial literacy and strengthen supervision of digital financial services so that public transactions remain in accordance with the principles of Islamic sharia.

Abstract

AbstractIslamic criminal law (jinayah) is a part of Islamic sharia that regulates various acts classified as criminal offenses and their sanctions, with the aim of creating order, justice, and welfare in society. This study aims to examine the definition and scope of Islamic criminal law, explain the sources of Islamic criminal law derived from the Qur'an, Sunnah, and ijtihad of scholars, and analyze the principles of justice and the concept of qisas from a Qur'anic perspective. This study also aims to understand the purpose and wisdom of implementing Islamic criminal law in social life. The research method used is normative legal research with a statute approach and a conceptual approach. Data were obtained from primary and secondary legal materials collected through literature review and then analyzed descriptively and qualitatively using a content analysis approach. The results show that Islamic criminal law focuses not only on imposing sanctions but also emphasizes the protection of basic human rights, crime prevention, and moral development in society. The principle of justice in QS. Verse 58 of An-Nisa emphasizes the importance of enforcing the law fairly without distinction of social status, while the concept of qisas (retribution) in verse 179 of Surah Al-Baqarah demonstrates that the application of punishment aims to safeguard human life while creating social stability. Furthermore, Islamic criminal law has preventive, educational, and rehabilitative functions that are relevant in supporting the creation of a safe, orderly, and just society, including the implementation of the qanun (religious law) in Aceh as part of Indonesia's national legal system.AbstrakHukum pidana Islam (jinayah) merupakan salah satu bagian dari syariat Islam yang mengatur berbagai tindakan yang diklasifikasikan sebagai tindak pidana beserta bentuk sanksinya dengan tujuan menciptakan ketertiban, keadilan, dan kemaslahatan dalam kehidupan masyarakat. Penelitian ini bertujuan untuk mengkaji pengertian dan ruang lingkup hukum pidana Islam, menjelaskan sumber-sumber hukum pidana Islam yang berasal dari Al-Qur’an, Sunnah, dan ijtihad ulama, serta menganalisis prinsip keadilan dan konsep qisas berdasarkan perspektif Al-Qur’an. Penelitian ini juga bertujuan untuk memahami tujuan serta hikmah penerapan hukum pidana Islam dalam kehidupan sosial masyarakat. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan statute approach dan conceptual approach. Data penelitian diperoleh dari bahan hukum primer dan sekunder yang dikumpulkan melalui studi kepustakaan, kemudian dianalisis secara deskriptif kualitatif menggunakan pendekatan content analysis. Hasil penelitian menunjukkan bahwa hukum pidana Islam tidak hanya berfokus pada pemberian sanksi, tetapi juga menitikberatkan perlindungan terhadap hak-hak dasar manusia, pencegahan terhadap tindak kejahatan, serta pembinaan moral dalam kehidupan masyarakat. Prinsip keadilan dalam QS. An-Nisa’ ayat 58 menegaskan pentingnya penegakan hukum secara adil tanpa membedakan kedudukan sosial, sedangkan konsep qisas dalam QS. Al-Baqarah ayat 179 menunjukkan bahwa penerapan hukuman bertujuan menjaga kehidupan manusia sekaligus menciptakan stabilitas sosial. Selain itu, hukum pidana Islam memiliki fungsi preventif, edukatif, dan rehabilitatif yang relevan dalam mendukung terciptanya masyarakat yang aman, tertib, dan berkeadilan, termasuk dalam penerapan qanun di Aceh sebagai bagian dari sistem hukum nasional Indonesia.
