Abstract

Tindak pidana penganiayaan berat yang dilakukan oleh anak memerlukan penanganan khusus dalam sistem peradilan pidana anak karena pelaku tetap berhak memperoleh perlindungan hukum sesuai peraturan perundang-undangan. Salah satu perkara tersebut diputus dalam utusan Pengadilan Negeri Makassar Nomor: 37/Pid.Sus-Anak/2025/PN Mks. Penelitian ini bertujuan menganalisis pertimbangan hakim serta bentuk perlindungan hukum terhadap anak yang berhadapan dengan hukum. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan kasus, bersumber pada KUHP, UU nomor 11 tahun 2012 tentang sistem peradilan pidana anak, serta putusan terkait, didukung bahan hukum sekunder. Hasil penelitian menunjukkan bahwa hakim mempertimbangkan aspek yuridis, filosofis, dan sosiologis, serta menerapkan sanksi yang berorientasi pada pembinaan, sehingga putusan tidak hanya memberikan kepastian hukum tetapi juga menjamin perlindungan bagi anak. Serious child abuse crimes require special handling in the juvenile criminal justice system because the perpetrators still have the right to receive legal protection in accordance with statutory regulations. One such case was decided in the Makassar District Court Decision Number: 37/Pid.Sus-Anak/2025/PN Mks. This study aims to analyze the judge's considerations and forms of legal protection for children in conflict with the law. The study uses a normative legal method with a statutory and case approach, sourced from the Criminal Code, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, and related decisions, supported by secondary legal materials. The results of the study show that the judge considers juridical, philosophical, and sociological aspects, and applies sanctions that are oriented towards development, so that the decision not only provides legal certainty but also guarantees protection for children.
