Abstract

Fenomena penerapan hukuman mati telah lama menjadi isu kontroversial di berbagai belahan dunia, terutama terkait dengan individu yang memiliki gangguan mental. Penelitian ini bertujuan untuk menyelidiki hubungan antara penerapan hukuman mati, kondisi kesehatan mental, dan peran psikologi forensik dalam proses evaluasi terpidana, dengan menggunakan metode Systematic Literature Review (SLR) untuk mengkaji studi-studi terkait gangguan mental pada narapidana hukuman mati dan pengaruh evaluasi psikologis terhadap keputusan pengadilan. Hasil penelitian menunjukkan bahwa gangguan mental, seperti skizofrenia dan gangguan kepribadian, sering kali mempengaruhi kapasitas mental terpidana dalam memahami dan menerima keputusan yang dihadapi, namun kondisi ini seringkali tidak dipertimbangkan secara memadai dalam proses hukum. Temuan ini menekankan pentingnya evaluasi psikologis yang akurat dan konsisten untuk memastikan tercapainya keadilan, serta tantangan dalam penerapan standar hukum yang jelas dan konsisten untuk kasus-kasus tersebut. Implikasi penelitian ini menunjukkan perlunya peningkatan sistem perawatan kesehatan mental di lembaga pemasyarakatan dan pengembangan prosedur hukum yang lebih sensitif terhadap kondisi mental terpidana, guna mencegah ketidakadilan dan memastikan proses peradilan yang lebih manusiawi dan adil.

Abstract

Domestic violence against women often results in profound psychological trauma, such as post-traumatic stress disorder (PTSD) and depression. The criminal justice system is often insensitive to the trauma experienced by victims, which worsens their condition during the legal process. This study aims to examine the relationship between psychological trauma due to domestic violence and the response of the criminal justice system, as well as the role of forensic psychology in supporting victim recovery. The research method used is a literature study, by analyzing relevant articles on domestic violence, psychological trauma, and the application of forensic psychology in the criminal law system. The results of the study show that the integration of forensic psychology in handling domestic violence cases can help understand the psychological impact of victims and improve the treatment of them in the legal process. The implications of this research are the importance of reforms in the criminal law system that are more responsive to the psychological trauma of victims, as well as the need for training for law enforcement officials to handle domestic violence cases with a more sensitive and humane approach.

Abstract

This research explores the critical role of habitual behavior in shaping future criminal conduct, particularly within forensic psychology. Habitual behavior, which involves repeated actions that become ingrained over time, significantly increases the likelihood of recidivism, particularly among offenders engaged in violent or drug-related crimes. The study aims to examine how habitual patterns of criminal behavior contribute to the persistence of criminal activity and how forensic psychology can offer insights for effective intervention. A systematic literature review was conducted using databases such as PubMed, PsycINFO, and Scopus, focusing on peer-reviewed articles related to habitual behavior, recidivism, and psychological intervention. The findings reveal that habitual offenders are at a heightened risk of re-offending due to entrenched behavioral patterns and the reinforcing effects of addiction and social environments. The research emphasizes the importance of rehabilitation programs, including cognitive-behavioral therapy, that target these ingrained behaviors to reduce recidivism. The study underscores the need for a more comprehensive approach to criminal rehabilitation, focusing on the psychological, social, and environmental factors that perpetuate habitual offending.
