Abstract

This study examines the legal protection of property ownership for couples in unregistered (siri) marriages and compares it with the legal framework governing officially registered marriages. Unregistered marriages often lead to legal uncertainty, particularly regarding shared property in cases of divorce or inheritance. The absence of official registration weakens the legal standing of such unions, increasing the risk of injustice, especially for women. Existing legal provisions do not explicitly regulate property protection in unregistered marriages, leaving their resolution largely dependent on law enforcement interpretation or case-by-case court decisions. This research adopts a normative-empirical approach by analyzing statutory regulations and collecting empirical data from field observations and interviews. The findings indicate that marriage registration is crucial for ensuring legal protection of jointly acquired property. Isbat nikah (marriage validation) and the principles of contract law serve as alternatives for gaining legal recognition. This study aims to contribute to the development of a more just and adaptive legal protection system for couples in unregistered marriages.

Abstract

Islamic inheritance law regulates the distribution of a deceased person's estate among eligible heirs based on established principles of faraid. Indonesia and Malaysia both apply Islamic inheritance principles, but their implementation is influenced by differences in national legal systems, institutional structures, and administrative mechanisms. This study aims to analyze and compare the regulation of inheritance distribution under Islamic law in Indonesia and Malaysia, particularly regarding the legal basis, heirs' shares, institutional mechanisms, and administrative procedures. This research uses a library research method by collecting and analyzing secondary data from books, scientific journals, legislation, official documents, and previous studies. The data were analyzed descriptively and comparatively to identify similarities and differences in inheritance regulations in both countries. The findings show that Indonesia and Malaysia share fundamental principles in determining the shares of children, spouses, and mothers based on Islamic inheritance provisions. However, differences are found in the legal structure, institutional mechanisms, administrative procedures, and particularly the position and share of the father in certain inheritance situations. These differences indicate that the implementation of Islamic inheritance principles is shaped by each country's national legal system. The study contributes to understanding how Islamic inheritance principles are integrated into different national legal frameworks.
