Abstract

Hukum perdata di Indonesia menetapkan Akta Jual Beli (AJB) tanah yang dibuat oleh Pejabat Pembuat Akta Tanah (PPAT) sebagai alat bukti autentik yang kuat dalam proses pembuktian. Praktik di lapangan menunjukkan bahwa AJB sering kali disusun berdasarkan dokumen yang ternyata palsu, seperti sertifikat, identitas pihak terkait, atau surat kuasa. Kondisi seperti ini dapat menimbulkan permasalahan hukum yang berkaitan dengan keabsahan akta, perlindungan hukum pada pihak yang beritikad baik, dan tanggung jawab hukum PPAT. Penelitian ini bertujuan merekonstruksi konsep keabsahan AJB yang didasarkan pada dokumen palsu dalam sistem hukum perdata Indonesia. Pada penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual, dan studi kasus. Hasil dari penelitian menunjukkan bahwa regulasi mengenai keabsahan AJB berbasis dokumen palsu masih tersebar dan menimbulkan ketidakkonsistenan penerapan antara hukum perdata, hukum administrasi pertanahan, dan hukum pidana. Rekonstruksi konsep keabsahan perlu menekankan asas itikad baik, prinsip kehati-hatian PPAT, serta perlindungan hukum terhadap pihak yang dirugikan sebagai dasar utama dalam menilai keabsahan akta. AJB yang dibuat berdasarkan dokumen palsu tidak otomatis batal demi hukum, melainkan harus diuji berdasarkan kesalahan, pengetahuan, dan kehati-hatian pihak terkait serta PPAT. Pendekatan ini diharapkan mampu menciptakan kepastian hukum, keadilan, dan manfaat dalam penyelesaian sengketa pertanahan di Indonesia. Civil law in Indonesia recognizes a Deed of Sale (AJB) for land, drawn up by a Land Deed Officer (PPAT), as strong authentic evidence in legal proceedings. However, legal practice demonstrates that Sale and Purchase Deed are frequently prepared on the basis of documents that are later proven to be forged, such as land certificates, the identities of the parties, or powers of attorney. Such circumstances give rise to legal problems concerning the validity of the deed, legal protection for parties acting in good faith, and the legal liability of the Land Deed Official. This study aims to reconstruct the concept of the validity of Sale and Purchase Deed based on forged documents within the Indonesian civil law system. This research employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that regulations governing the validity of Sale and Purchase Deed based on forged documents remain fragmented and lead to inconsistencies in their application across civil law, land administration law, and criminal law. The reconstruction of the concept of validity should emphasize the principle of good faith, the precautionary principle applicable to Land Deed Official, and legal protection for aggrieved parties as the primary foundations for assessing the validity of deeds. Sale and Purchase Deed made on the basis of forged documents are not automatically null and void by operation of law, but must instead be assessed by examining the fault, knowledge, and level of prudence of the relevant parties and the Land Deed Official. This approach is expected to promote legal certainty, justice, and utility in the resolution of land disputes in Indonesia.

Abstract

Tujuan penelitian menelaah efektivitas Undang-Undang Nomor 1 Tahun 1974 jo. Undang-Undang Nomor 16 Tahun 2019 tentang Perkawinan dalam pelaksanaan nikah sultan pada masyarakat Wandan Desa Banda Ely, Kabupaten Maluku Tenggara dalam perspektif pluralisme hukum. Penelitian ini menggunakan metode empiris dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui wawancara dan studi pustaka. Hasil penelitian menunjukkan bahwa pelaksanaan nikah sultan merupakan bentuk pluralisme hukum karena memperlihatkan adanya interaksi antara beberapa sistem hukum secara bersamaan. Masyarakat Wandan lebih menempatkan hukum adat dan hukum agama sebagai legitimasi utama perkawinan daripada pencatatan perkawinan oleh negara. Tradisi nikah sultan juga merupakan living law yang tetap dipertahankan karena dianggap tidak bertentangan dengan syariat Islam. Undang-Undang Perkawinan belum berjalan efektif, terutama masalah pencatatan perkawinan, karena dipengaruhi oleh faktor hukum dan nonhukum. Oleh karena itu, harmonisasi hukum urgen diciptakan agar kepastian hukum dapat tercapai tanpa menghilangkan identitas budaya masyarakat adat. This study aims to examine the effectiveness of Law Number 1 of 1974 on Marriage in conjunction with Law Number 16 of 2019 on Marriage in the implementation of Sultan marriage within the Wandan community of Banda Ely Village, Southeast Maluku Regency, from the perspective of legal pluralism. This research employs an empirical method using statutory and conceptual approaches. Data were collected through interviews and library research. The results show that the practice of Sultan marriage reflects legal pluralism because it demonstrates the interaction of several legal systems operating simultaneously. The Wandan community places customary law and religious law as the primary sources of legitimacy for marriage rather than state marriage registration. The Sultan marriage tradition is also regarded as a form of living law that continues to be maintained because it is considered consistent with Islamic law. The Marriage Law has not been effectively implemented, particularly concerning marriage registration, due to both legal and non-legal factors. Therefore, legal harmonization is urgently needed so that legal certainty can be achieved without eliminating the cultural identity of indigenous communities.
