Abstract

This study aims to analyze the disharmony between normative regulation and the implementation of the protection of Persons with Mental Disorders (ODGJ) in Indonesia, especially at the regional level, by integrating the perspectives of national law, human rights, and Islamic law. The method used is normative legal research (doctrinal legal research) enriched with a socio-legal approach. The research approach includes the statute approach, conceptual approach, and case approach, with theoretical frameworks in the form of legal functionalization theory, legal protection theory, and maqāṣid al-syarī'ah which emphasizes the protection of the soul (ḥifẓ al-nafs) and the principle of non-discrimination. The results of the study show that the failure of ODGJ protection does not stem from weaknesses in legal norms, but from structural failures in implementation. The disharmony of regulations is reflected in weak coordination between agencies, limited resources for mental health workers, and the lack of operational and applicable regional regulations. In addition, the legal culture of the community that is still full of stigma and discrimination exacerbates the ineffectiveness of legal protection for ODGJ. This study concludes that the effectiveness of ODGJ protection requires an integrative model that incorporates a human rights approach and the values of maqāṣid al-syarī'ah in an implemented manner. The main findings confirm that the main problem lies in structural and cultural aspects, not normative; Therefore, it is recommended to strengthen implementing regional regulations, increase institutional capacity and mental health services, and social interventions based on public education to remove stigma, in order to realize an inclusive, effective, and equitable ODGJ protection system.

Abstract

This study examines the legal uncertainty arising from the disharmony between Law No. 5 of 1986 on Administrative Courts, Law No. 30 of 2014 on Government Administration, and PERMA No. 6 of 2018 on Guidelines for the Settlement of Government Administrative Disputes. The overlapping norms in these three regulations have caused confusion regarding the mandatory nature of administrative efforts, the finality of decisions, and the procedural consequences for citizens' rights to sue. This study uses a normative legal method with a legislative, conceptual, and comparative approach. The analysis was conducted qualitatively using a legal hermeneutic model to find the compatibility between norms and government practices. The results show that the administrative appeal system in Indonesia does not yet guarantee procedural certainty and substantive justice because it lacks uniform national standards regarding objection mechanisms, deadlines, and the independence of reviewing officials. The system is reconstructed by combining the theories of Administrative Justice and the Legal Certainty Framework, which emphasize the principles of norm clarity, proportionality, and procedural accountability. The proposed design includes a digital one-stop portal, written justification requirements, independent oversight, and the establishment of nationwide implementing regulations. The results of this study provide a conceptual contribution to the reform of Indonesian administrative law while strengthening the rule of law through fair, efficient, and transparent administrative efforts.

Abstract

Penelitian ini mengkaji pengaturan dan implikasi hukum terkait pelanggaran royalti musik dalam performing rights di Indonesia dengan menyoroti dinamika regulasi, kelembagaan, serta praktik penegakannya. Fokus utama diarahkan pada analisis kewajiban pembayaran royalti terhadap pemanfaatan musik dalam ruang publik, baik secara langsung maupun melalui media digital, sebagaimana diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta serta Peraturan Pemerintah Nomor 56 Tahun 2021. Kajian normatif yang digunakan menelusuri ketidaktegasan pengaturan tentang pihak yang bertanggung jawab, dualisme kewenangan antara LMK dan LMKN, serta kelemahan prosedural seperti kewajiban mediasi yang kerap diabaikan. Analisis terhadap beberapa kasus menunjukkan bahwa pelanggaran performing rights dapat menimbulkan konsekuensi perdata, administratif, dan pidana, yang seluruhnya bertujuan menjaga nilai ekonomi karya serta memberikan perlindungan yang layak bagi pencipta. Pengaruh perjanjian internasional, terutama Konvensi Bern, TRIPS, dan WIPO Copyright Treaty, menjadi landasan penting yang memperkuat urgensi harmonisasi regulasi nasional dengan standar global. Kajian ini menegaskan perlunya reformasi menyeluruh terhadap tata kelola royalti musik untuk mencapai sistem yang adil, transparan, dan adaptif terhadap perkembangan industri kreatif.
