Abstract

This study examines the legality of Bandung Administrative Court Decision Number 180/G/2024/PTUN.BDG concerning a dispute over the transfer of a civil servant position through the perspective of the General Principles of Good Governance. The research employed a non empirical normative juridical approach based on statutory analysis, case analysis, and conceptual analysis. Primary sources consisted of the court decision and relevant Indonesian administrative law regulations governing state administrative justice, government administration, and the state civil apparatus. The findings indicate that the disputed transfer decision was issued by a competent authority but contained significant procedural and substantive defects. The court identified the use of an expired technical recommendation, administrative error, insufficient objective justification, and non compliance with merit based personnel management standards. These deficiencies resulted in violations of legal certainty and due care principles that form essential components of good governance. The analysis further demonstrates that the General Principles of Good Governance function as substantive standards for reviewing administrative discretion beyond formal legality. The decision strengthens judicial oversight, promotes bureaucratic accountability, reinforces merit system implementation, and contributes to the development of governance oriented administrative law in Indonesia.

Abstract

This study examines the legal status of ghostwriters within copyright assignment agreements by analyzing the interaction between moral rights and economic rights under Indonesian copyright law. The research employs a non empirical legal method based on statutory interpretation, conceptual analysis, and doctrinal synthesis. Primary legal materials consist of Law Number 28 of 2014 concerning Copyright and representative ghostwriter contractual arrangements, while secondary materials include contemporary scholarship on authorship, copyright ownership, contractual transfer mechanisms, and moral rights theory. The analysis demonstrates that ghostwriters retain their legal position as original creators despite contractual concealment of their identities and the transfer of economic interests to clients. Copyright assignment agreements function primarily as instruments for transferring exploitation rights and commercial benefits rather than authorial status. The findings further reveal a persistent normative tension between freedom of contract and the inalienable nature of moral rights. Although clients may acquire extensive economic control over a work, rights of attribution and integrity remain legally connected to the ghostwriter. The study concludes that copyright law accommodates commercial transfer while preserving continuing legal protection for creators, thereby establishing a balanced framework between contractual autonomy and author centered copyright principles.
