Abstract

This article examines the formulation of legal education for prospective judges through a comparative analysis of the Common Law and Civil Law traditions. The study draws institutional insights from Harvard Law School and Utrecht University School of Law as representative models of two major paradigms of global legal education. Using a library research approach with a juridical-comparative orientation, the research analyzes contemporary academic literature and studies on judicial education to explore epistemological and methodological differences in the formation of judges. The findings indicate that the Common Law tradition emphasizes case-based learning, Socratic dialogue, and experiential approaches that develop argumentative and pragmatic reasoning skills. In contrast, the Civil Law tradition prioritizes doctrinal analysis grounded in legal codification and the integration of academic education with professional judicial training to ensure interpretative consistency and legal certainty. Rather than demonstrating the superiority of one system, these differences highlight the importance of an integrative model of judicial education. The study argues that combining case-based reasoning with doctrinal coherence can provide the foundation for a hybrid judicial education model that supports both justice and legal certainty in contemporary judicial systems. Artikel ini menganalisis formulasi pendidikan hukum bagi calon hakim melalui kajian komparatif antara tradisi Common Law dan Civil Law. Kajian ini mengambil pelajaran institusional dari Harvard Law School dan Utrecht University School of Law sebagai representasi dua paradigma utama pendidikan hukum global. Penelitian menggunakan pendekatan library research dengan karakter yuridis-komparatif melalui analisis literatur akademik mutakhir dan studi tentang pendidikan yudisial untuk menelaah perbedaan epistemologis dan metodologis dalam pembentukan hakim. Hasil penelitian menunjukkan bahwa tradisi Common Law menekankan pembelajaran berbasis kasus melalui case method, Socratic dialogue, dan pendekatan berbasis pengalaman yang membentuk kemampuan argumentatif dan penalaran pragmatis. Sebaliknya, tradisi Civil Law lebih menekankan pendekatan doktrinal berbasis kodifikasi hukum serta integrasi pendidikan akademik dengan pelatihan profesi yudisial guna menjaga konsistensi interpretasi dan kepastian hukum. Perbedaan tersebut menunjukkan pentingnya model pendidikan hakim yang bersifat integratif. Penelitian ini menegaskan bahwa sintesis antara case-based reasoning dan doctrinal coherence dapat menjadi dasar bagi model pendidikan hakim hibrid yang mampu mendukung keadilan sekaligus kepastian hukum dalam sistem peradilan modern.

Abstract

Indonesia is characterized by profound religious diversity encompassing multiple religions, beliefs, and religious practices. While such plurality has the potential to function as social capital for strengthening national cohesion, recent decades have witnessed a significant rise in religion-based intolerance, including the rejection of houses of worship, the dispersal of minority religious activities, and various forms of social intimidation. These developments indicate persistent structural and normative deficiencies in the governance of freedom of religion or belief (FoRB) in Indonesia. This article critically examines the relationship between religious plurality, practices of intolerance, and weaknesses in the governance of FoRB, while proposing a more progressive normative alternative. Employing a qualitative dialectical analysis based on document review and literature studies, the study maps the patterns and actors of religious intolerance and reassesses the normative foundations of religious governance through the integration of the fiqh of tolerance and human rights principles. The findings demonstrate that the escalation of intolerance is driven not only by regulatory weaknesses and majoritarian bias but also by exclusive religious interpretations that are misaligned with constitutional values and international human rights standards. This study argues that reconstructing an inclusive normative framework—grounded in a dialectical engagement between fiqh of tolerance and human rights—is essential for strengthening the protection of religious minorities and fostering social cohesion in Indonesia. Indonesia dicirikan oleh keberagaman agama dan kepercayaan yang kompleks, yang secara teoretis merupakan modal sosial bagi kohesi nasional. Namun, meningkatnya praktik intoleransi dalam beberapa dekade terakhir—seperti penolakan rumah ibadah dan intimidasi terhadap kelompok minoritas—mengindikasikan adanya persoalan struktural dan normatif dalam tata kelola Kebebasan Beragama dan Berkeyakinan (KBB/FoRB). Artikel ini bertujuan menganalisis hubungan dialektis antara pluralitas keagamaan, praktik intoleransi, dan kelemahan tata kelola KBB di Indonesia, serta menawarkan kerangka normatif alternatif yang progresif. Menggunakan metode kualitatif melalui analisis dialektis berbasis studi literatur, penelitian ini memetakan pola serta aktor intoleransi, sekaligus meninjau kembali fondasi pengelolaan kehidupan beragama melalui integrasi konsep fiqh toleransi dan prinsip Hak Asasi Manusia (HAM). Temuan penelitian menunjukkan bahwa eskalasi intoleransi dipicu oleh bias mayoritarian dalam regulasi serta tafsir keagamaan eksklusif yang tidak selaras dengan nilai konstitusional dan standar HAM internasional. Artikel ini menyimpulkan bahwa rekonstruksi kerangka normatif yang inklusif—melalui dialektika fiqh toleransi dan HAM—merupakan prasyarat krusial untuk memperkuat perlindungan kelompok minoritas dan menciptakan kohesi sosial yang berkelanjutan di Indonesia.

Abstract

Sexual violence remains a persistent challenge in university environments, despite the implementation of various policies and task forces, including at Universitas Brawijaya. This study investigates the integration of fiqh sexuality in preventing sexual violence on campus. Employing a qualitative case study with a socio-legal approach, data were gathered through in-depth interviews, observations, and documentation of the Universitas Brawijaya's PPKS Task Force activities. The findings reveal that while educational efforts are underway, the approach predominantly focuses on legal and psychological aspects, with fiqh sexuality not yet systematically integrated. Crucially, from the perspective of maqāṣid al-syarī'ah, fiqh sexuality offers significant potential for preventing sexual violence through the principles of ḥifẓ al-nafs, ḥifẓ al-nasl, and ḥifẓ al-'aql. Therefore, mainstreaming fiqh sexuality education is essential in university sexual violence prevention strategies.
