Abstract

Despite universal recognition of child marriage as a fundamental violation of human rights, ratified by global instruments like the Convention on the Rights of the Child (CRC) and CEDAW, the practice persist significantly in India, China and Indonesia, challenging the efficacy of existing national legal frameworks. The paper critically analyze and compare the legal frameworks, enforcement mechanisms, and normative challenges surrounding child marriage prevention in India, China, and Indonesia, assessing their compliance with international human rights standards and identifying the effectiveness of legal interventions in mitigating socio-cultural drivers of early marriage. The paper employs a normative juridical approach, and through a comparative analysis of primary legal sources like statutes, constitutions, and secondary sources like court decisions, international conventions, and reports to analyze the differences and similarities in legal protection. It utilize a comparative analytical method to identify strengths and weaknesses in each country's approach. The consequences resulting from this are: to what extent does legal exemptions, personal laws, and rural customary practices in India, China, and Indonesia create inconsistencies between national legislation and international human rights obligations? What are the primary enforcement gaps and challenges in the implementation of anti-child marriage laws in each jurisdictions, specifically regarding legal age verification and prosecution of offenders? To what extent does the current legal frameworks in all three countries prioritize the best interests of the child over parental consent or religious and cultural norms? How does the different approaches to child marriage criminalization in India, administrative control in China, and modified consent in Indonesia affect the prevalence rates and legal rights of children in rural areas against urban settings? These questions form the basis of this paper. The paper reveals that despite the 2019 reform in Indonesia, significant legal gaps exist, as religious courts often grant exemptions for under-age marriages, particularly due to out-of-wedlock pregnancy. In India, a major issue is the conflict between the secular PCMA and personal laws, while China generally maintain higher minimum age standards than its neighbors, reducing the absolute number of child brides, though it still has significant numbers concentrated in rural, lower-income regions. It concludes that while India, China, and Indonesia have significantly strengthened their national legal frameworks to align with international human rights standards, the effective prevention of child marriage is currently hindered by a widening enforcement -norm gap.

Abstract

The purpose of this paper is to examine the challenges of enforcing the international legal framework on child soldiering. The paper reveals that, as the offense of child soldiering escalates, the multi-dimensional scope for protecting child soldiers spans various legal regimes under international law. It argues that, despite several prohibitive norms established in International Humanitarian Law (IHL), International Human Rights Law (IHRL), the International Labour Organization (ILO), and International Criminal Law (ICL), their application or enforcement against child soldiering remains ineffective and inadequate due to numerous impediments and challenges. This is because "law on paper," like a baby in the womb, must align with "law in action" to achieve adequate effectiveness. The methodology employed is doctrinal research. Major gaps were identified, and the paper provides comprehensive recommendations to enhance the enforcement of global treaties against child soldiering. The paper concludes with recommendations to address the technical and legal complexities associated with child soldiering.

Abstract

This study examines legal uncertainty in using customary land as collateral within Indonesia’s mortgage system. Legal pluralism under Basic Agrarian Law 1960 creates tension between customary tenure and the formal registration regime required by Law Number 4 of 1996 concerning Mortgage Rights. The study aims to assess whether customary land can meet the principles of publicity and speciality and to formulate a reconstruction model accommodating both systems. Using a normative juridical method with statutory, conceptual, and comparative approaches, the research analyzes legislation, doctrine, and case studies involving collateral disputes. Findings indicate that customary land, being communal and unregistered, cannot directly satisfy publicity and speciality due to lack of registration and unclear ownership boundaries, resulting in legal uncertainty for creditors, particularly regarding enforceability and priority rights. Nevertheless, adaptive reconstruction is possible through partial formalization, including recognition of communal rights within land administration and establishment of collective legal subjects representing indigenous communities. Comparative analysis with Rwanda shows that full formalization increases economic utility but risks eroding communal values. This study introduces the concepts of collective speciality and quasi-publicity as a hybrid framework bridging customary and formal systems, enabling customary land to function as collateral while preserving its communal character and ensuring balanced legal certainty and socio-cultural protection.   AbstrakPenelitian ini mengkaji ketidakpastian hukum dalam penggunaan tanah adat sebagai objek jaminan dalam sistem hak tanggungan di Indonesia. Pluralisme hukum dalam Undang-Undang Pokok Agraria 1960 menimbulkan ketegangan antara rezim tanah adat dan sistem pendaftaran formal yang disyaratkan oleh Undang-Undang Nomor 4 Tahun 1996 tentang Hak Tanggungan. Penelitian ini bertujuan menganalisis apakah tanah adat dapat memenuhi prinsip publisitas dan spesialitas serta merumuskan model rekonstruksi hukum yang mengakomodasi kedua sistem. Metode yang digunakan adalah yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan komparatif, melalui analisis doktrin, regulasi, dan studi kasus. Hasil penelitian menunjukkan bahwa tanah adat yang bersifat komunal dan tidak terdaftar belum dapat memenuhi prinsip publisitas dan spesialitas akibat ketiadaan pendaftaran serta ketidakjelasan batas dan subjek hak, sehingga menimbulkan ketidakpastian hukum bagi kreditor, khususnya terkait eksekusi dan hak preferen. Namun demikian, rekonstruksi hukum adaptif dimungkinkan melalui formalisasi terbatas, pengakuan hak komunal dalam administrasi pertanahan, serta pembentukan subjek hukum kolektif masyarakat adat. Perbandingan dengan Rwanda menunjukkan bahwa formalisasi penuh meningkatkan fungsi ekonomi tanah, tetapi berisiko menggerus nilai komunal. Kebaruan penelitian ini terletak pada konsep spesialitas kolektif dan quasi-publisitas sebagai kerangka hibrid yang memungkinkan tanah adat berfungsi sebagai jaminan tanpa menghilangkan karakter komunalnya.
