Abstract

Penelitian ini bertujuan untuk menganalisis implementasi konsep keadilan restoratif (restorative justice) pada tahap penyidikan dalam penanganan tindak pidana pencurian yang dilakukan oleh anak di wilayah hukum Kepolisian Resor Kota Besar (Polrestabes) Makassar, serta untuk mengidentifikasi faktor-faktor yang menjadi hambatan dalam penerapannya. Metode yang digunakan adalah pendekatan yuridis empiris dengan pengumpulan data melalui wawancara, observasi, dan studi dokumen. Hasil penelitian menunjukkan bahwa penerapan keadilan restoratif di Polrestabes Makassar dilakukan melalui mekanisme mediasi antara pelaku anak, korban, dan pihak kepolisian, serta menekankan pada pemulihan hubungan sosial, tanggung jawab pelaku, dan pemulihan kerugian korban, tanpa harus melalui proses peradilan formal yang cenderung represif. Konsep ini dinilai mampu mengurangi dampak psikologis dan sosial terhadap anak pelaku, serta mendorong penyelesaian yang lebih humanis. Namun demikian, implementasi di lapangan masih menghadapi sejumlah kendala. Faktor internal penghambat meliputi keterbatasan kapasitas sumber daya manusia, kurangnya pelatihan khusus bagi mediator, serta karakter pelaku anak yang merupakan residivis. Sementara itu, faktor eksternal mencakup tingginya tekanan publik, ketidakpuasan korban terhadap hasil mediasi, ketidakpastian hukum, serta lemahnya koordinasi antar lembaga penegak hukum dan perlindungan anak. Temuan ini menunjukkan perlunya penguatan regulasi, peningkatan kompetensi aparat, serta edukasi publik dalam mendukung efektivitas penerapan keadilan restoratif bagi anak yang berhadapan dengan hukum. This study aims to analyze the implementation of the concept of restorative justice at the investigation stage in handling criminal acts of theft committed by children in the jurisdiction of the Makassar City Police (Polrestabes), and to identify factors that become obstacles in its implementation. The method used is an empirical legal approach with data collection through interviews, observations, and document studies. The results of the study indicate that the implementation of restorative justice at the Makassar Police is carried out through a mediation mechanism between child perpetrators, victims, and the police, and emphasizes the restoration of social relations, the responsibility of the perpetrators, and the restoration of the victim's losses, without having to go through a formal judicial process that tends to be repressive. This concept is considered capable of reducing the psychological and social impacts on child perpetrators, and encouraging a more humane solution. However, implementation in the field still faces a number of obstacles. Internal inhibiting factors include limited human resource capacity, lack of special training for mediators, and the character of child perpetrators who are recidivists. Meanwhile, external factors include high public pressure, victim dissatisfaction with the results of mediation, legal uncertainty, and weak coordination between law enforcement and child protection agencies. These findings indicate the need to strengthen regulations, improve the competence of officers, and educate the public in supporting the effectiveness of the implementation of restorative justice for children in conflict with the law.
