Abstract

This research aimed at finding out the implementation of the rights of royal residents and the constraints faced by the residents to obtain their rights. This study was conducted in Royal Apartment in Makassar and Government building office, Makassar. The quantitative method was applied to investigate the implementation of the rights of Royal Residents as well as the constraints faced by the residents to obtain their rights. The results showed that the rights of Royal Residents are implemented well although undeniably some other rights of the Royal residents are not well-implemented. Moreover, the certain rules which regulate the apartment, no socialization regarding the residents’ rights, and no the Association of unit owners and occupants of flats (Perhimpunan Pemilik dan Penghuni Satuan Rumah Susun) become the constraints of Royal Residents, Makassar.

Abstract

This study aimed at determining the implementation of duties and authority of Consumer Dispute Settlement Agency (BPSK) Makassar in the supervision of inclusion of standard clauses and settlement of disputes between consumers and business actors in Makassar. This research was conducted in Makassar at BPSK Office in Makassar. The method used was the empirical normative approach. The purpose of this approach was to analyze the extent to which law or regulation is effective in the community regarding the role of the Consumer Dispute Settlement Agency in providing legal protection for consumers in Makassar. The results of this study indicated that the implementation of supervision of raw clauses by BPSK Makassar was effective, BPSK Makassar only limited to the supervision after the complaints of consumers. The implementation of consumer dispute resolution by BPSK Makassar applies the conciliation, mediation, and arbitration. Based on the data obtained from 2010-2015, every year the number of cases received and resolved by BPSK Makassar is increased approximately 179 cases as alleged violations complained to BPSK Makassar.

Abstract

The purpose of this study was to determine the extent of drug control carried out by the National Narcotics Agency of South Sulawesi Province and the working relationship between the National Narcotics Agency of South Sulawesi Province and the Directorate of Narcotics in the South Sulawesi Regional Police. The data related to the task of the National Narcotics Agency of South Sulawesi Province in the Control of Drug Abuse are then analyzed using qualitative analysis, which describes the data that has been obtained and then concludes it. In the handling of drug abuse carried out by the National Narcotics Agency of South Sulawesi Province has been carried out as it should but in its implementation there are various kinds of obstacles or constraints and employment relationships of the National Narcotics Agency of South Sulawesi Province and the Directorate of Narcotics of the South Sulawesi Regional Police are regulated in 8 (eight) rooms scope and lack of coordination between the National Narcotics Agency of the Province of South Sulawesi and the Directorate of Narcotics Narcotics in South Sulawesi can lead to the emergence of sectoral ego that can make less optimal drug abuse control in the province of South Sulawesi

Abstract

This study aims to determine the regulation of a single Regional Election for Regional Head Election simultaneously after the decision of the Constitutional Court Number 100 / PUU-XIII / 2015 in South Sulawesi Province, and the implementation of the selection of a single regional head candidate in South Sulawesi Province. This research was conducted in the Makassar City KPU, Enrekang Regency and Bone Regency. The research method used is normative law. The results obtained by the author from this study, namely 1). Regulation of the Single Candidate for Regional Head Election Simultaneously regulated in the Constitutional Court Decision Number 100 / PUU-XIII / 2015, Law no. 10 of 2016 and PKPU No. 13 of 2018.2). Implementation of Election of Candidates for Regional Heads in the Province of South Sulawesi consisting of; a). Requirements for Nominating a Single Candidate, b). Single Candidate Selection Dispute Process, c). Regulatory Standard for Inauguration of Single Candidate Candidates and, d). Single Candidate Selection Results in South Sulawesi Province.3). Abstract

Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menyebabkan terjadinya kejahatan di pelabuhan Bajo’e Kabupaten Bone, dan upaya kepolisian untuk mengatasi kejahatan Premanisme di pelabuhan Bajo’e Kabupaten Bone. Penelitian ini dilaksanakan di Polsek Pelabuhan. Metode penelitian yang digunakan adalah hukum empiris yaitu merupakan penelitian hukum sosiologis, yaitu mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataanya di masyarakat, dan menggunakan berbagai data primer dan sekunder adapun data primer yang digunakan yaitu melalui wawancara langsung kepada narasumber yang berkaitan dengan tulisan ini dan membagikan angket kepada responden, adapun data sekunder dengan mengumpulkan data dari berbagi literatur yang ada, berupa buku, artikel-artikel yang diperoleh dari penelusuran internet, termasuk aturan perundang-undangan yang terkait dengan permasalahan dalam penelitian ini. Hasil penelitian menunjukkan bahwa: (1) faktor-faktor penyebab terjadinya kejahatan premanisme yaitu faktor lingkungan, factor ekonomi, dan faktor rendahnya pendidikan. (2) Upaya kepolisian untuk mengatasi kejahatan premanisme di pelabuhan Bajo’e kabupaten bone yaitu, dalam upaya pre-emtif pihak kepolisian melakukannya dengan cara menanamkan nilai-nilai/norma-norma yang baik kepada masyarakat melalui penyuluhan hukum dan keagamaan. Dalam upaya preventif pihak kepolisian melakukan patroli dan pengawasan secara rutin dan berkelanjutan. Sedangkan dalam upaya represif pihak kepolisian melakukan penyelidikan, penangkapan dan pembinaan psikologis dan penyadaran disertai latihan-latihan keterampilan kerja dalam masa hukuman agar punya modal untuk mencari pekerjaan. This study aims to determine the factors that led to the occurrence of crime in the Bajo'e district of Bone port, and the police efforts to overcome the crime of thuggery in the port of Bajo'e Bone. This research was conducted at the Port Police Station. The research method used is empirical law which is a sociological legal research, which examines the applicable legal provisions and what happens in reality in the community, and uses a variety of primary and secondary data while the primary data used is through direct interviews with sources related to writing this and distributing questionnaires to respondents, as for secondary data by collecting data from sharing existing literature, in the form of books, articles obtained from internet searches, including legislation related to the problems in this study. The results of the authors obtained from this study, namely (1) factors that cause the occurrence of thuggery namely environmental factors, economic factors, and educational factors. (2) Police efforts to overcome the crime of thuggery in Bajo'e regency bone port, namely: In the pre-eminent effort the police did it by instilling good values / norms with the community through legal and religious counseling. In preventive efforts the police conduct regular and ongoing patrols and supervision. Whereas in repressive efforts the police conduct investigations, arrests and psychological coaching and awareness accompanied by work skills training in the period of punishment so that they have the capital to find work.

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas peran Pembimbing Kemasyarakatan dalam pelaksanaan restorative justice terhadap anak pelaku tindak pidana dan untuk mengetahui faktor-faktor yang menghambat. Penelitian ini dilaksanakan di Balai Pemasyarakatan Klas I Makassar, dengan menggunakan teknik pengumpulan data berupa penelitian kepustakaan dan studi lapangan. Hasil penelitian ini menunjukkan bahwa peran pembimbing kemasyarakatan dalam penerapan restorative justice, terhadap pendampingan, pembimbingan, Pengawasan  anak pelaku tindak pidana belum efektif,  disebabkan masih terdapat kendala sehingga  perlu  dilakukan  peningkatan kualitas dalam penerapan restorative justice. Faktor-faktor yang menghambat peran pembimbing kemasyarakatan dalam penerapan restorative justice adalah kurangnya sumber daya manusia pembimbing kemasyarakatan, jangkauan wilayah kerja Bapas, kurangnya sarana dan prasarana, dukungan masyarakat dalam penerapan Restorative Justice, kurangnya partisipasi  korban, orang tua dan pelaku, dan lambatnya koordinasi antar lembaga yang menangani masalah anak pelaku tindak pidana. This study aims to determine the role of Parole and Probation Officers in the implementation of restorative justice against children who are dealing with the law and to determine the factors that inhibit the role of social counselors in the implementation of restorative justice against children who commit criminal acts at Bapas Kelas I Makassar. This research was conducted at the Balai Pemasyarakatan Kelas I Makassar, by using data collection techniques in the form of literature research and field studies by conducting direct interviews with relevant parties. The results of this study indicate that: (1) The role of Parole and Probation Officers is very important in the implementation of restorative justice, providing assistance, guidance, supervision as well as conducting research and reporting through (LITMAS) to have a significant influence on children who are dealing with the law and the victims in implementing restorative justice. (2) Coordination between institutions that deal with the problem of children in conflict with the law, limited number of Parole and Probation Officers, incompatible tasks performed with what should be done, lack of understanding from the perpetrators and victims regarding restorative justice manifested in the form of diversion, and determination of agreements on compensation victims who can be accepted by children who are dealing with the law.

Abstract

Tujuan penelitian ini adalah untuk mengetahui efektifitas fungsi pengawasan ombudsman terhadap pelaksanaan tata kelola administrasi di Pengadilan Negeri Mamuju serta untuk mengetahui apa saja kendala yang menjadi kendala dalam menjalankan fungsi pengawasan Ombudsman terhadap tata kelola administrasi di Pengadilan Negeri Mamuju, Penelitian ini dilakukan di Ombudsman Republik Indonesia Perwakilan Sulawesi Barat dan di Pengadilan Negeri Mamuju. Metode penelitian yang digunakan adalah penelitian kualitatif yaitu penelitian yang bertujuan menjelaskan fenomena dengan melalui pengumpulan data dengan pendekatan yuridis normatif dan yuridis empiris. Maksudnya  pendekatan yang dilakukan untuk menganalisa tentang fungsi pengawasan Ombudsman terhadap pelaksanaan tata kelola administrasi Pengadilan Negeri Mamuju. Hasil penelitian ini menunjukkan bahwa fungsi Pencegahan dan Pemeriksaan Laporan Oleh Ombudsman terhadap pelaksaaan Tata Kelola Administrasi Pengadilan Negeri mamuju kurang efektif, sedangkan penerimaan dan verifikasi laporan cukup efektif namun secara umum Ombudsman Perwakilan Sulawesi Barat cukup efektif namun dalam pelaksanaannya terdapat beberapa kendala yaitu kendala mengenai Regulasi, Sumber Daya Manusia, Anggaran dan factor Sosialisasai terhadap Masyarakat. The purpose of this study is to determine the effectiveness of the ombudsman oversight function on the implementation of administrative governance in the Mamuju District Court and to find out the problems that become obstacles in carrying out the Ombudsman's supervision function of administrative governance in the Mamuju District Court. This research was conducted at the Ombudsman Republic of Indonesia Representative in West Sulawesi and in the Mamuju District Court. The research method used is qualitative research, which is research that aims to explain the phenomenon by collecting data through normative and juridical approaches. That is the approach taken to analyze the Ombudsman's oversight function of the administration of the Mamuju District Court administration. The results of this study indicate that the function of the Prevention and Examination of Reports by the Ombudsman on the implementation of the District Court Administration is less effective,  while receiving and verifying reports are quite effective but in general the West Sulawesi Representative Ombudsman is quite effective although in its implementation there are several obstacles namely the constraints regarding Regulation, Human Resources, Budget and Socialization factors towards the Community.

Abstract

Penelitian ini bertujuan untuk mengetahui peran Pembimbing Kemasyarakatan sebagai penegak hukum dalam melakukan bimbingan terhadap Klien Pemasyarakatan serta mengetahui faktor-faktor penghambat yang dihadapi Pembimbing Kemasyarakatan terkait pelaksanaan tugas dalam hal mencegah pengulangan tindak pidana oleh Klien Pemasyarakatan. Observasi yang dilakukan dalam penelitian ini adalah di Kantor Balai Pemasyarakatan (BAPAS) Kelas I Kota Makassar. Metode yang digunakan penulis adalah pendekatan normatif empiris. Maksudnya pendekatan yang dilakukan untuk menganalisa tentang sejauhmanakah suatu peraturan perundang-undangan atau hukum yang sedang berlaku secara efektif dalam masyarakat mengenai peran Pembimbing Kemasyarakatan sebagai penegak hukum serta mengamati tingkah laku para narapidana dan pembimbing kemasyarakatan di dalam Kantor Balai Pemasyarakatan Kelas I Makassar. Hasil penelitian ini menunjukkan bahwa pelaksanaan peran pembimbing kemasyarakatan sebagai penegak hukum sangat penting dalam pencegahan pengulangan tindak pidana bagi klien yang ditandai dengan berkurangnya jumlah residivis dalam dua tahun terakhir. This study aims to determine the role of Community Supervisors as law enforcers in conducting counseling to Correctional Clients and to find out the inhibiting factors faced by Community Supervisors related to the implementation of tasks in terms of preventing the repetition of criminal acts by Correctional Clients. The observations made in this study were in the Penitentiary Class I Makassar. The method used by the author is an empirical normative approach. The purpose of the approach taken is to analyze the extent to which a statutory regulation or law that is effectively applied in society regarding the role of Community Supervisors as law enforcers as well as observing the behavior of prisoners and community counselors in the Penitentiary Class I Makassar. The results of this study indicate that the implementation of the role of social counselors as law enforcers is very important in preventing the repetition of criminal acts for clients which is marked by the reduced number of recidivists in the last two years.

Abstract

Korupsi sebagai salah satu kejahatan yang bersifat luar biasa (Extra Ordinary Crime) dikarenakan begitu sulit dalam membuktikan kejahatan tersebut oleh penegak hukum, maka dari itu dibutuhkan kinerja extra untuk memberantas tindak pidana korupsi tersebut. Olehnya itu, mengenai pemberantasan Tindak Pidana Korupsi dengan menggunakan ketentuan-ketentuan yang ada dalam Undang Undang hal itu diterapkan dalam Undang Undang Nomor 31 Tahun 1999. Undang Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi, dimana beberapa pasalnya menganut tentang sistem pembuktian terbalik terbatas/berimbang. Pasal pasal yang mengatur tentang sistem pembuktian terbalik lebih jelas diatur dalam Pasal 12B, 12C, 37A, 38A, dan 38B. Pemberlakuan sistem pembuktian terbalik dalam perkara delik korupsi terhadap terdakwa meskipun hanya terbatas pada perkara suap (Gratifikasi) di atas Rp. 10 jt. Namun dengan adanya kewajiban terdakwa untuk membuktikan delik korupsi yang didakwakan kepadanya serta harta benda yang patut diduga berasal dari tindak pidana korupsi dan tidak bertumpuh lagi kepada jaksa penuntut umum, maka diharapkan dapat menjadi solusi dalam pemberantasan tindak pidana korupsi tersebut sebab perampasan terhadap harta benda terdakwa dapat dilakukan jika terdakwa tidak dapat membuktikan delik korupsi yang didakwakan kepadanya. Corruption is one of extraordinary crimes because it is so difficult in proving these crimes by law enforcement, and thus it requires extra performance to eradicate corruption. Therefore, regarding the eradication of corruption by using the provisions contained in the Law, this is applied in Law Number 31 Year 1999. Law Number 20 of 2001 concerning the Eradication of Corruption Crime, in which several articles adhere to a reversed proof system is limited/balanced. Articles governing the reverse proof system are more clearly regulated in Articles 12B, 12C, 37A, 38A, and 38B. The implementation of the reversed proof system is in the case of corruption offenses against the defendant even though it is only limited to bribery cases (Gratification) over Rp10 million. However, with the defendant's obligation to prove the corruption offense charged with him and property that is reasonably suspected of originating from criminal acts of corruption and no longer rests on the public prosecutor, then it is expected to be a solution in eradicating these criminal acts of corruption because the confiscation of the assets of the defendant can be done if the defendant cannot prove the corruption offense charged with him.

Abstract

Otoritas Jasa Keuangan merupakan lembaga yang independen dan bebas dari campur tangan pihak lain, dibentuk dengan salah satu tujuan yaitu untuk mengawasi lembaga keuangan. Pengawasan OJK dilakukan agar lembaga keuangan yang diawasi tidak melakukan pelanggaran dan terus berkembang serta tidak merugikan masyarakat. Penelitian ini bertujuan untuk mengetahui pelaksanaan tugas pokok Otoritas Jasa Keuangan di Kota Makassar dalam pengawasan aktifitas perbankan, meliputi kelembagaan bank, kesehatan bank dan aspek kehati-hatian bank. Penelitian ini dilaksanakan di Kota Makassar pada Kantor Otoritas Jasa Keuangan Regional 6 Sulawesi Maluku Papua (SULAMPUA) Kota Makassar. Metode yang digunakan adalah pendekatan normatif empiris. Maksudnya pendekatan yang dilakukan untuk menganalisa tentang sejauh manakah suatu peraturan atau perundang-undangan atau hukum yang sedang berlaku secara efektif kepada publik mengenai peranan Otoritas Jasa Keuangan. Hasil penelitian ini menunjukkan bahwa pelaksanaan pengawasan oleh Otoritas Jasa Keuangan sangat penting dalam pengawasan aktivitas perbankan yang meliputi kegiatan usaha, tingkat kepatuhan, serta hal yang berdampak kepada masyarakat terkait krisis integritas sebuah lembaga keuangan. Financial Services Authority (OJK) is an independent institution and free form other parties’ interference, which was formed with one of the objectives of a joint financial institution. OJK supervision is carried out so that the supervised financial institutions do not commit violations and continue to develop as well as do not harm the public. This study aims to see the implementation of the main duties of the financial services authority in Makassar City in monitoring banking activities which include aspects of banking, bank health and banking prudence. This research was conducted in Makassar City at the Regional Financial Services Authority Office 6 Sulawesi Maluku Papua (SULAMPUA) Makassar City. The method used is empirical normative approach. This means that the approach is to analyze the extent to which a regulation or statute is appropriate and effective for the public regarding the roles of Financial Services Authority. The results showed that the implementation of supervision by the Financial Services Authority is very important in the supervision of banking activities, including business activities, the level of supervision, as well as matters that have an impact on society related to the integrity of a financial institution.
