Abstract

This study aims to examine the principles of gender justice within the Islamic inheritance system, based on Surah An-Nisa’ verses 11-12, which stipulate a 2:1 ratio (a male receives two shares of the inheritance compared to a female). However, in the modern era, with changing times and human mindsets, as well as demands for equal rights, this 2:1 stipulation is considered a problem of justice. This research is normative juridical research, employing the library research method. The legal materials used include literature studies, such as interpretations of sacred texts, fiqh books, books, journals, previous research results, websites, and other writings related to the issues being studied. The results of this research indicate that justice refers to fair and equal treatment for every individual in accordance with the principles of the Qur'an and Hadith. However, in the context of Islamic inheritance distribution, challenges arise due to social and cultural changes that affect its interpretation and application. Although the principles of justice remain, there needs to be a renewal in the interpretation and implementation of Islamic law to reflect social and economic developments and to advocate for gender equality. This adaptation is not an effort to oppose culture or religion but a step towards a more just society for all individuals, regardless of gender. In making this adaptation, religious values and cultural traditions must be reinterpreted in accordance with the spirit of inclusivity and justice inherent in Islam, so that Islam remains a relevant moral and legal guide for its followers.

Abstract

Inclusive education has become a fundamental principle within the Indonesian education system as an effort to ensure equal rights for all children, including those with special needs. However, the implementation of inclusive education policies at the regional level, particularly in Jombang Regency, reveals a gap between normative discourse and the reality of practice on the ground. The Jombang Regent Regulation No. 39 of 2014 serves as the legal basis for the implementation of inclusive education; however, its application does not fully reflect the principle of substantive justice for children with special needs. This study aims to critique the policy using philosophical and normative approaches to analyze the role of the state as the organizer of inclusive education. The methodology employed is a qualitative approach with textual analysis of legislation and observation of policy implementation in inclusive schools in Jombang. The research findings indicate that although inclusive education policies are legally and formally regulated, many deficiencies persist in practice, such as the lack of support teachers, unprepared curricula, and insufficient funding. These findings reflect the state's failure to uphold the principles of social justice and human rights for children with special needs. Inclusive education should be understood as an integral part of the state's obligation to achieve substantive justice, rather than merely an administrative requirement.

Abstract

Regional head officials are people chosen to carry out duties and authority, both at the provincial and city district levels. The appointment of regional head officials is usually chosen by the central goverment throught the president or minister of home affairs to fill vacancies due to the end of their term of office or if the previous official has died. According to law number 10 of 2016 concerning regional elections, the appointment of regional head officials is carried out through an election process by the community. However, in the event of a vacancy, the minister of home affairs has the right to appoint a temporary official to replace the position of the previous official. The filling in of regional head officials refers to artickel 86 of 2014 concerning regional government. The filling of regional haead officials do not go through a direct election mechanism by the people. This causes political domination and pasrty influence in making decisions. In relation to the decision of the minister of home affairs number 4 of 2023 regarding the appointment of regional head officials from active TNI members which if felt to have caused a lot of controversy which is contrary to the TNI Law. The aim of this research is to find out about the appointment af regional head officials according to the government of the minister of home affairs number 4 of 2023. The method used in this writing is normative by taking a case, conceptual and statutory approach. The result and discussion obtained were a legal review of the mechanism for regional head officials according to minister of home affairs regulation number 4 of 2023 article 3 paragraph (b) with the TNI Law article 47 paragraph (1) which contradicts and creates conflicting norms regarding the appointment of public officials from the military.

Abstract

Penelitian ini bertujuan untuk memahami secara mendalam tentang pengaturan mengenai perlindungan hak atas privasi sebagaimana diatur dalam Undang-Undang No.39 Tahun 1999 tentang Hak Asasi Manusia, serta untuk mengkaji hubungan, , batasan dan titik keseimbangan antara hak kebebasan berpendapat sebagaimana yang tercantum dalam Pasal 28E UUD 1945 dengan hak perlindungan privasi dalam sistem hukum Hak Asasi Manusia. Permasalahan penelitian ini berangkat dari munculnya ketegangan antara kebebasan berekspresi di ranah digital yang dijamin oleh konstitusi dan upaya perlindungan terhadap hak privasi individu, terutama dalam penerapan Undang-Undang Informasi dan Transaksi Elektronik. Fenomena tersebut memperlihatkan potensi konflik dan tidak jelasnya batas antara kedua hak yang sering kali menimbulkan pembatasan terhadap kebebasan berpendapat atau penyalahgunaan data pribadi. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan serta pendekatan konseptual. Analisis bahan hukum dolakukan secara preskriptif normatif untuk merumuskan pandangan dan rekomendasi yang sesuai dengan prinsip-prinsip perlindungan Hak Asasi Manusia. Hasil yang diharapkan adalah konstruksi hukum yang aplikatif dan proposional untuk menyeimbangi kebebasan berpendapat dan perlindungan privasi, dengan meninjau kembali yang ada agar tidak menghambat hak dasar setiap warga negara.Kebebasan Berpendapat, Perlindungan Privasi, Hak Asasi Manusia, dan Undang-Undang No. 39 Tahun 1999
