Abstract

Perkembangan teknologi informasi di era digital telah mendorong peningkatan pemrosesan data pribadi dalam penyelenggaraan layanan publik, termasuk termasuk administrasi kependudukan melalui apilikasi sisstem infromasi kependudukan (SIAK) Dukcapil. Pemrosesan data pribadi tersebut melibatkan pengendali dan prosesor data pribadi yang memiliki peran dan tanggung jawab berbeda. Namun, dalam praktiknya, kedudukan hukum prosesor data pribadi seringkali belum memperoleh kepastian perlindungan hukum yang memadai, khususnya ketika terjadi dugaan kebocoran atau pelanggaran data pribadi, seperti kasus dugaan kebocoran data kependudukan pada juli 2023. Penelitian ini bertujuan untuk menganalilis bentuk perlindungan hukum bagi prosesor data pribadi dalam melaksanakan pemrosesan data pribadi melalui apilikasi sistem informasi kependudukan serta tanggung jawab hukum perdata prosesor data apabila terjadi pelanggaran data berdasarkan Undang-Undang No 27 Tahun 2022 tentang Perlindungan Data Pribadi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukan bahwa UU PDP telah memberikan dasar perlindungan hukum bagi prosesor data pribadi, namun implementasinya masih menghadapi berbagai kendala, seperti ketidakjelasaan pembagian tanggung jawab, lemahnya pengawasan dan belum optimalnya pengaturan teknis. Oleh karena itu, diperlukan penguatan regulasi dan mekanisme pertanggungjawaban yang proposional guna memberikan kepastian hukum bagi prosesor data pribadi serta meningkatkan perlindungan data pribadi masyarakat.

Abstract

The misuse of personal data provided for limited purposes, demonstrates a systemic vulnerability in legal protection for victims. Based on an analysis of the Nganjuk District Court Decision Number 240/Pid.Sus/2025/PN.NJK, this research identifies a normative gap between the preventive mechanisms regulated in Law Number 27 of 2022 concerning Personal Data Protection (PDP Law) and judicial practices that remain repressive-formal in nature. The judge only imposed criminal sanctions without ordering restitution or recovery measures for the victims, despite proven immaterial losses and financial risks. The key finding of the study indicates that a restorative approach—which positions victims as the primary subjects of their constitutional rights restoration—has not been adopted in the implementation of the PDP Law at the court level. The novelty of this research lies in its specific critique of the judge’s failure to apply victim recovery mechanisms despite the normative guarantees in the PDP Law, thereby emphasizing the disparity between the theory of personal data protection law and its enforcement practice.

Abstract

The development of information technology has encouraged the use of digital standard contracts through Terms of Use unilaterally drafted by service providers, including Netflix. This situation creates disparities in bargaining power because consumers can only accept or reject the entire agreement. This research aims to (1) analyze the imbalance of consumer positions in Netflix’s Terms of Use from the perspective of the principle of freedom of contract and (2) examine forms of legal protection for consumers. This research employs a normative legal method using statutory and conceptual approaches. Primary, secondary and tertiary legal materials are analyzed qualitatively using the deductive syllogism method. The results indicate that the Cancellation, Warranties and Limitations on Liability, Class Action Waiver and Changes to These Terms and Assignment clauses potentially create inequality between the rights and responsibilities of the parties involved by granting dominant authority to Netflix and limiting consumer rights. Normatively, consumer legal protection is provided under the Consumer Protection Law; however, its effectiveness still requires optimization to ensure a balance of positions between parties in digital standard contracts. Therefore, limitations on the principle of freedom of contract are necessary to establish a fair and balanced contractual relationship while providing legal certainty for consumers.
