Abstract

This study examines law enforcement practices or state responses to the crime of insulting the government and how this principle of ultimum remedium works in law enforcement of the crime of insulting the government in Indonesia. Through comparative study methods with countries outside Indonesia, literature studies, and interviews with law enforcement officials to see their law enforcement practices from the perspective of law enforcement. The results of the study show that although the 2023 Criminal Code has regulated insults against the government as an absolute complaint, the norm still leaves room for multiple interpretations between criticism and insults. Law enforcement practices in Indonesia show a tendency to use criminal law as the primary instrument (primum remedium), although normatively recognizing ultimum remedium so that clearer limits, strengthening non-criminal mechanisms, and procedural safeguards are needed to be in line with freedom of expression in a democratic country. This study aims to find out the practice of law enforcement and how this principle of ultimum remedium is present in law enforcement.

Abstract

Layanan darurat 112 memiliki peran strategis dalam menunjang efektivitas sistem peradilan pidana di Indonesia, khususnya pada tahap pra-adjudikasi. Sebagai titik awal pelaporan tindak kejahatan, layanan ini memungkinkan masyarakat untuk segera berinteraksi dengan aparat penegak hukum, sehingga proses identifikasi, penyelidikan, hingga penegakan hukum dapat berjalan secara sistematis. Dari perspektif kriminologi, layanan 112 berfungsi sebagai capable guardian dalam pendekatan situational crime prevention, yaitu strategi pencegahan kejahatan yang menekankan pada respons cepat dan penguatan kontrol sosial formal. Namun, implementasi layanan ini masih menghadapi berbagai kendala, seperti minimnya regulasi teknis, rendahnya kompetensi sumber daya manusia, serta lemahnya koordinasi antar-lembaga penegak hukum. Artikel ini bertujuan untuk mengkaji implementasi layanan 112 serta upaya penguatan sistem dan regulasi dalam mendukung penanganan street crime di kota besar. Penelitian ini menggunakan pendekatan yuridis normatif dalam mengumpukkan teori-teori dan studi literatur yang ada dari sudut pandang kriminologi dan sistem peradilan pidana. Oleh karena itu, dibutuhkan langkah strategis berupa penguatan regulasi, peningkatan infrastruktur, dan sinergi antarsektor agar layanan darurat 112 mampu berfungsi secara optimal. Dengan demikian, penguatan layanan ini diharapkan dapat menjadi instrumen penanggulangan street crime yang lebih efektif dan efisien di wilayah kota besar.
