Abstract

The utilization of pledged goods (rahn) in informal Muslim community transactions in Indonesia remains widely practiced yet legally unexamined, creating a normative gap between community convention and classical Islamic jurisprudence. This study aims to analyze Imam Shafi'i's precise legal reasoning on the utilization of pledged goods and to comparatively situate his position against the Hanafi, Maliki, and Hanbali schools. Employing a qualitative approach with a case study design, data were collected through library research on classical fiqh texts and analyzed using the interactive model of Miles, Huberman & Saldaña. The study finds that Imam Shafi'i categorically prohibits any creditor utilization of pledged goods, classifying it as riba regardless of mutual consent, asset type, or pledge duration, grounded in the principle that ownership and its benefits remain exclusively with the pledgor. Comparatively, the Hanafi school permits utilization upon explicit consent, the Maliki school allows limited animal use proportionate to maintenance, and the Hanbali school grounds animal-use permissibility in prophetic authority. These divergences reflect fundamental differences in jurisprudential methodology across the four schools. The findings provide doctrinal clarity essential for protecting economically vulnerable communities from exploitative informal financial arrangements, directly contributing to SDG 1, SDG 10, and SDG 16.

Abstract

This study examines the halal tourism potential and maqasid al-shariah-based development strategy of the Natuna Geopark, a National Geopark encompassing 27,233.85 square kilometers of land and sea in Ranai, Natuna Regency, Indonesia's northernmost maritime border territory. The study aims to analyze the natural resource, cultural heritage, and infrastructure potential of the geopark as a halal tourism destination, and to construct a maqasid al-shariah-based strategy for its sustainable and Muslim-friendly development. Employing a qualitative approach with a case study design, data were collected through in-depth interviews, participant observation, and documentation, and analyzed using the interactive model of Miles, Huberman, and Saldaña. The findings reveal that the geopark possesses an exceptional convergence of 200-million-year-old geological formations, Srivijaya civilizational heritage, and living Malay Islamic cultural identity, yet remains structurally underdeveloped as a halal destination due to the absence of halal certification, Muslim-friendly geosite infrastructure, and any deliberate Islamic development framework. In response, this study constructs a five-pillar maqasid al-shariah-based development strategy encompassing hifz al-din, hifz al-nafs, hifz al-aql, hifz al-nasl, and hifz al-mal, offering a transferable model aligned with SDG 8, SDG 10, SDG 11, and SDG 16 for sustainable halal geoheritage tourism development in Muslim-majority border communities.

Abstract

This study aims to examine the influence of nazhir human resource capacity on the effectiveness of productive waqf land management in Sepempang Village and to identify which capacity dimension carries the most dominant contribution. A quantitative explanatory approach was employed, with data collected through a structured Likert-scale questionnaire administered to nazhir members and relevant stakeholders using a total sampling technique. Data analysis utilized simple linear regression preceded by classical assumption tests, with hypothesis testing conducted via t-test at a 95% confidence level. The results indicate that nazhir human resource capacity exerts a significant and positive influence on the effectiveness of productive waqf land management, with a t-count of 7.43 exceeding the t-table value and a coefficient of determination (R²) of 0.71, meaning 71% of management effectiveness variance is explained by nazhir human resource capacity. Among the three dimensions examined, managerial competency emerged as the most dominant contributor, followed by skills and knowledge. These findings confirm that village-level nazhir functioning as competent managerial agents are capable of realizing waqf land's productive potential, with direct implications for SDG 1, SDG 8, and SDG 10 through the generation of sustained community welfare outcomes derived from professionally managed waqf assets.
