Abstract

This study aims to examine the baganyi tradition from the perspective of fikih munakahat, with an emphasis on social and legal dynamics in Minangkabau culture. The initial aim is to understand how baganyi affects the position of wives and children and how Minangkabau customs apply customary values with Islamic legal principles to resolve disputes within the family. This research uses a qualitative descriptive methodology by interviewing family members and looking at how Minangkabau families resolve conflicts. The results show that the baganyi tradition is a form of peaceful effort made by the women of the wife's family to return the husband who left home. This process involves several stages, starting from individual problem solving between husband and wife, then solving between two families with the help of ninik mamak and bundo kanduang. This research also found that the manjapuik sumando yang baganyi custom has a philosophy behind picking up the husband, which is to perfect or repair the rift in the husband-wife relationship. The implication of this research is the importance of integration between customary values and the principles of Islamic law in resolving husband-wife conflicts. Minangkabau custom with the baganyi tradition shows that the intervention of ninik mamak and bundo kanduang can help restore harmony in the household. It also shows that the status of the wife and children must be prioritized in the process of resolving husband-wife problems, so as to reduce the divorce rate and improve family welfare. Thus, this research contributes to a deeper understanding of the baganyi tradition and the importance of Minangkabau customs in overcoming marital problems, as well as its legal implications in the context of fiqh munakahat.

Abstract

This paper explores the issue of mubdil on Badal Hajj. A mubdil is a person who replaces the entire series of Hajj from Mubdal Minhu (a person being replaced). The narration of the hadith explains that a mubdil is a child or sibling of a person the person being replaced. In reality, many practices of hajj badal are carried out by people who do not have a descendant relationship with mubdal minhu, even the mubdil does not know the person he has replaced absolutely, and vice versa. there were also cases of misapplication of responsibility and fraud of hajj badal by replacing more than one mubdal minhu. The practice of hajj badal is based on the hadiths of Rasulullah which inform about replacing others in the Hajj because of physical conditions or because of death. The hadiths will be examined using the fiqh al-hadith method by studying the hadiths based on their relationship with the verses of the Qur'an and other hadith and through the textual and contextual approach of the hadith. Based on this method, it can be explored how the characteristics that must be possessed by a mubdil. The realization of these characteristics can minimize the occurrence of misuse of responsibility and trust in Badal Hajj

Abstract

The inheritance system in Minangkabau, known for its matrilineal lineage, offers a unique perspective on property distribution, especially when contrasted with the patrilineal structure of Islamic inheritance law. This research delves into the historical and cultural evolution of the Minangkabau inheritance system, examining how it has adapted over time due to various social, legal, and religious influences. While Minangkabau customary law (adat) traditionally prioritizes female heirs, particularly through maternal lines, Islamic inheritance law advocates a more balanced approach, emphasizing the rights of both male and female heirs based on predetermined shares. The contrast between these two systems raises important questions about gender justice and the equitable distribution of wealth. Through a detailed exploration of Minangkabau customs and Islamic jurisprudence, this study investigates how these systems have coexisted and the efforts made by scholars and legal authorities to reconcile the differences. A significant focus is placed on the role of reformist thinkers within the Minangkabau community, who have sought to align local practices with the broader principles of Islamic inheritance law while preserving cultural identity. The research also examines the practical implications of these reform efforts, particularly in light of the evolving role of women in Minangkabau society and the growing calls for gender equality. The findings offer valuable insights into the potential for developing an inheritance model that respects both cultural traditions and Islamic values of justice, ultimately contributing to a broader discourse on gender equity in inheritance laws across diverse Muslim societies.
