Abstract

Brandu or porak is a tradition of slaughtering sick or dead livestock and selling the meat to reduce losses for livestock owners. The problems of this research include, firstly, why do people in Gunungkidul Regency still carry out the brandu tradition even though it has been prohibited by positive law in Indonesia, secondly what the brandu problem is if analyzed using sociological jurisprudence, thirdly, what should the government's efforts to overcome this problem be if linked to analysis using sociological jurisprudence. Research Method uses a doctrinal approach and constructivist paradigm. People in Gunungkidul Regency still carry out the brandu tradition because the poverty rate is still high, besides that, the people of Gunung Kidul are known to have a high level of empathy towards each other, especially if their neighbors experience difficulties and suffering due to the death of livestock. In the Brandu case, if analyzed using the sociological jurisprudence school, it shows that positive law and the traditions that live in society are equally important, so it is hoped that in the formation of law and law enforcement, positive law and law in society must be taken into account in harmony. The government's efforts to overcome this problem should be that the government needs to form legal policy products to overcome brandu.

Abstract

As a non-structural institution is independent and free from political interferencethenstrengthening the position and role of State Civil Apparatus Commission (KASN) is indispensable in realizingbureaucratic reform. The topic being examined includes how the position and role of ASN is currently in realizing the reform of the bureaucracy and what efforts should be made to strengthen the position and role in realizing KASN current bureaucratic reforms.This is a normative legal research, the approach used in this research is a conceptual approach.The results of the discussion concludes the position and rolehas been regulated bythe law number 5 on 2014 about  the state civil apparatus, the establishment of KASN in the region, authority to set a national policy on employment development.

Abstract

ABSTRAK Revitalisasi Manajemen Aparatur Sipil Negara atau Manajemen ASN melalui pemberhentian tindak dengan hormat bagi pegawai negeri sipil yang terlibat tindak pidana korupsi perlu dilakukan karena selama ini pemberhentian tidak dengan hormat yang merupakan bagian dari Manajemen ASN ini belum dilaksanakan secara maksimal dibuktikan dengan masih banyaknya kasus PNS yang belum diberhentikan dengan tidak hormat dalam melakukan kasus tindak pidana korupsi. Masalah yang diteliti adalah bagaimana seharusnya bentuk revitalisasi terhadap Manajemen PNS jika dikaitkan dengan pemberian sanksi administratif pada PNS yang melakukan tindak pidana korupsi? Penelitian ini merupakan penelitian hukum normatif, pendekatan yang digunakan dalam penelitian ini adalah pendekatan konseptual. Adapun hasil pembahasan menyimpulkan bahwa revitalisasi dilakukan dengan dikeluarkannya beberapa instrumen oleh pemerintah dan perlunya pengawasan dari lembaga pengawas yang berwenang.

Abstract

AbstractLegal protection related to the rights of persons with disabilities still causes problems due to various regulations concerning persons with disabilities in the Special Region of Yogyakarta (DIY) are still not harmonious. This research tries to xpolre the question, is the regulation regarding employment rights for persons with disabilities relate to fulfilling qootas to become civil servants in DIY harmonious? And what kind of legal remedies should be done as a form of harmonization of laws and regulations regarding the rights of persons with disabilities related to employment rights in DIY? This research is a normative research, that is the research object of study in the form of legal norms. Primary and secondary materials is obtained through literature study, and analysis of the data will be analyzed legally. The result of the study concluded, the regulation of employment rights for person with disabilities relating to minimum amout of recruitment quota in the government agencies in DIY is not harmonius, and legal remedies can be made with legislative review.Key Words: Persons with disabilities, employment rights, harmonization AbstrakPerlindungan hukum terkait dengan hak penyandang disabilitas masih menimbulkan permasalahan, disebabkan oleh berbagai peraturan tentang penyandang disabilitas di Daerah Istimewa Yogyakarta (DIY) masih belum harmonis. Penelitian ini mencoba menggali pertanyaan yaitu, apakah pengaturan mengenai hak kepegawaian bagi penyandang disabilitas terkait pemenuhan kuota untuk menjadi pegawai negeri di DIY sudah harmonis? dan seperti apa upaya hukum yang harus dilakukan sebagai bentuk harmonisasi peraturan perundang-undangan mengenai hak-hak penyandang disabilitas terkait dengan hak kepegawaian di DIY? Penelitian ini merupakan penelitian normatif, yakni penelitian yang obyek kajiannya berupa norma hukum. Bahan primer dan sekunder diperoleh melalui studi kepustakaan. Analisa data akan dianalisis secara yuridis. Hasil penelitian menyimpulkan bahwa, pengaturan hak pekerjaan bagi penyandang disabilitas yang berkenaan dengan besarnya minimal kuota penerimaan pegawai di instansi pemerintahan di DIY belum harmonis dan upaya hukum yang dapat dilakukan dengan legislative review.

Abstract

ABSTRACT The aim of this research is to provide an analysis of the arrangement of Non-Asn Employees after the enactment of Law no. 20 of 2023 from the perspective of prophetic legal science which theoretically can be useful for the academic field and government as well as the wider community, as well as being practically useful for the government in making policies. Types of legal research can be distinguished, including normative legal research. The research approach used is the statutory regulatory approach. The data analysis method used is qualitative analysis, namely research that refers to legal norms contained in statutory regulations and court decisions as well as norms that live and develop in society. The results of this research are, The first results of this research are from ontology studies, so this will be related to the pillars of humanization. In this case, the government must make planning and mapping first before structuring, which will later produce humanist policies. Second, from the epistemological study it will be related to liberation. Here the government must pay attention to the guidelines for making rules or policies so as not to harm non-ASN employees. Third, from axiological studies, this will intersect with the pillar of transcendence. The government must set an example as a policy maker that provides justice and legal protection for non-ASN employees. The conclusion of this research is an ontology study which is based on structuring planning, an epistemology study, where the government makes policies that do not harm non-ASN employees, and an axiology study, the government must provide examples of policy makers who provide legal protection Keywords: arrangement, Government Contract Employees, prophetic law Abstrak Tujuan penelitian ini adalah untuk memberikan telaah mengenai penataan Pegawai Non-Asn pasca lahirnya Undang-Undang No. 20 Tahun 2023 tentang Aparatur Sipil Negara dalam prespektif ilmu hukum profetik yang secara teoretik dapat berguna bagi bidang akademik dan pemerintah maupun masyarakat luas, serta secara praktis berguna bagi pemerintah untuk membuat kebijakan. Jenis penelitian hukum dapat dibedakan antara lain penelitian hukum normatif, Pendekatan penelitian yang digunakan adalah pendekatan peraturan perundang-undangan. Metode analisis data yang dipergunakan adalah analisis kualitatif yaitu penelitian yang mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan dan putusan pengadilan serta norma-norma yang hidup dan berkembang dalam masyarakat. Hasil penelitian ini adalah, Hasil penelitian ini adalah Pertama dari kajian ontologi, maka ini akan berkaitan dengan pilar humanisasi. Dalam hal ini pemerintah harus membuat perencanaan dan pemetaan terlebih dahulu sebelum adanya penataan, yang mana nantinya penataan tersebut akan menghasilkan kebijakan yang humanis. Kedua, dari kajian epistimologi maka akan terkait dengan liberasi. Disini pemerintah harus memperhatikan pedoman untuk dalam membuat aturan atau kebijakan agar tidak merugikan Pegawai Non-ASN tersebut. Ketiga, dari kajian aksiologi, maka ini akan bersinggungan dengan pilar transedensi. Pemerintah harus memberikan contoh sebagai pengambil kebijakan yang memberikan keadilan serta perlindungan hukum bagi Pegawai Non-ASN. Kesimpulan penelitian ini adalah Kajian ontologi yang didasarkn pada perencnaan penataan, kajian epistimologi, dimana pemerintah membuat kebijakan yang tidak merugikan Pegawai Non-ASN, dan kajian aksiologi, pemerintah harus memberi contoh pengambil kebijakan yang memberikan perlindungan hukum Kata Kunci : Penataan, Pegawai Non-ASN, Hukum Profetik

Abstract

This study analyzes the use of Kasultanan land as a residence in Wonokerto Village for 63 years without legality. The method used is empirical law with primary and secondary data collection through literature studies, field observations, and interviews with the community, Wonokerto Village Office, and Panitiksmo. The use of Kalurahan land as a residence violates Governor Regulation Number 24 of 2024, but is based on historical aspects where there was a mandate from Sri Sultan Hamengkubuwono IX in 1961 to move the community group from the disaster-prone area of ​​Mount Merapi. This creates a lack of legal certainty for the community group. As a result, the community group cannot carry out legal acts such as Liyer and Lintir. The results of the study show that the Sultanate can release the rights of Anggaduh Kalurahan Wonokerto to become the Sultanate's land, so that the community can submit Serat Kekancingan for legality and be used as legal protection for the community group. Although there are regulations, the resolution refers more to the Sultanate's policy. More explicit and legally binding regulations are needed, such as the Governor's Regulation on resolving the status of village land that has been used by the community as a residence, so that the community can obtain clear legal certainty.
