Abstract

Sexual abuse is committed not only by adults but also by minors. The legal process upon children who have committed sexual abuse refers to the Law Number 11 of 2012 on the Juvenile Court System. The purpose of this study is to find out the factors to be considered by the panel of judges in imposing penalty upon the perpetrators. The study employs both normative and empirical approaches. It is found with regard to the liability issue, the panel of judges relies on both juridical and non- juridical consideration. In sexual abuse case that was tried in Kebumen District Court, beside imposing imprisonment, the panel of judges also ordered the perpetrators to undergo work training as a substitute of fine.

Abstract

Although medical malpractice is not really new phenomenon in Indonesia, nevertheless dealing with medical malpractice cases is confusing to some extent. The absence of statutory definition of medical malpractice leads to confusion on how to handle it. This paper aims at elaborating the concept of medical malpractice and its liability. In addition, misconception on medical malpractice liability will also be evaluated. This normative legal research relies on secondary data and employes both statutory and comparative approaches. It is found that there has been misconception on medical malpractice in Indonesia. The misconception takes place not only to the lay persons, but also among academicians and law enforcement agencies. This misconception has led to confusion on how to establish medical malpractice liability.

Abstract

The Juvenile Criminal Justice System is established to uphold justice for children who engage in criminal proceedings, especially those who perpetrate criminal offense. The System sets up various measures in order to protect the rights of these children. This article aims at evaluating the operation of the Juvenile Criminal Justice System in Indonesia with special concern on the fulfilment of the rights of children who are in conflict with the law. The type of research is that of normative legal research which relies on secondary data in the form of primary and secondary legal material. This normative legal research employs statutory approach. It is found that the rights of children who are in conflict with the law is primary protected through the employment of diversion, the initial step for settling the criminal case outside the judicial system. The operation of the Juvenile Criminal Justice System comes across some obstacles in field, including with regard to the employment of diversion. Therefore, improvement in employing diversion seems to be necessary to achieve better quality of children rights protection.

Abstract

Social media initially created as a means of communication and interaction, has also evolved into a medium for transactions and expression. Social media users come from various backgrounds, including those in the health care sector. The use of social media as a means of expression by healthcare workers has the potential to harm patients, particularly concerning privacy violations. Several health care workers have faced public criticism due to their social media posts, which are deemed to infringe upon patient privacy. This paper discusses the importance of legally protecting patient privacy against the misuse of social media by healthcare workers in Indonesia. The research employs normative legal research methods with a statutory and comparative approach. The author has reviewed statutory regulations in the healthcare sector and other relevant rules. The research findings indicate that current laws and regulations in Indonesia do not offer sufficient legal protection to patients against the potential misuse of social media by healthcare workers that violates their privacy. The author recommends the implementation of special provisions to safeguard patient privacy against the misuse of social media by healthcare workers. This can be achieved by creating new or amendments to existing regulations, including legal regulations and codes of ethics. AbstrakMedia sosial yang pada awalnya diciptakan sebagai sarana komunikasi dan interaksi, dalam perkembangannya telah dimanfaatkan pula sebagai media transaksi maupun sarana berekspresi. Pengguna media sosial berasal dari berbagai kalangan, termasuk mereka yang bekerja di bidang pelayanan kesehatan. Penggunaan media sosial sebagai sarana berekspresi oleh tenaga kesehatan berpotensi menimbulkan kerugian pada pihak pasien, khususnya terkait pelanggaran privasi. Beberapa tenaga kesehatan mendapatkan kecaman publik karena unggahannya di media sosial yang dianggap melanggar privasi pasien. Artikel ini membahas pentingnya perlindungan hukum privasi pasien terhadap penyalahgunaan media sosial oleh tenaga kesehatan di Indonesia. Artikel ini menggunakan metode penelitian hukum normatif dengan pendekatan undang-undang dan perbandingan. Penulis telah mengkaji peraturan perundang-undangan di bidang kesehatan dan peraturan lain yang relevan. Hasil penelitian menunjukkan bahwa peraturan perundang-undangan yang ada di Indonesia saat ini belum memberikan perlindungan hukum yang memadai kepada pasien dari potensi penyalahgunaan media sosial oleh tenaga kesehatan yang bersifat melanggar privasi. Penulis merekomendasikan perlunya dibuat ketentuan khusus untuk melindungi privasi pasien dari penyalahgunaan media sosial oleh tenaga kesehatan, baik dengan cara menyusun peraturan baru atau mengamendemen peraturan yang telah ada, baik peraturan hukummaupun kode etik.

Abstract

This study explores the policy and regulatory frameworks concerning cyber espionage within Indonesia and Germany. Given the considerable threats cyber espionage poses to national security and economic interests, it is crucial for nations to formulate thorough strategies to mitigate such risks. Through a comparative analysis of Indonesia and Germany—two countries with distinct geopolitical stances and methodologies regarding cybersecurity and espionage—the research delves into the legal, political, and technological factors influencing their cyber espionage policies. The methodology includes a comprehensive review of legislative measures, governmental strategies, and the response of institutions to cyber espionage in both nations. The objective is to discern the similarities, differences, and effectiveness of the policies and regulations of these countries. This comparison sheds light on the adequacy of Indonesian legislation in combating cybercrime, especially cyber espionage. The study reveals that Indonesia's legal infrastructure for cybercrime is markedly underdeveloped compared to Germany's, where stringent and well-articulated regulations are in place, facilitating precise and efficient management of cyber issues. Thus, the study underscores an urgent need for Indonesia to reform its cybercrime laws, focusing on cyber espionage, among other cyber threats, while continuing to enhance the quality of its human resources.DOI: https://doi.org/10.22304/pjih.v11n1.a6

Abstract

Introduction to the Problem: Black money has a detrimental impact on a nation's macroeconomic and microeconomic, financial system, and international markets. The first idea to surface in the international literature when looking at the historical evolution of black money is money laundering. Criminal organizations employ various tactics to launder illicit funds, aiming to prevent the confiscation of the proceeds of their criminal activities. Purpose/Objective of Study: This research delves into international perspectives on countering money laundering, a growing concern that poses threats to the security and stability of nations worldwide, and causes economic uncertainty. The study also investigates the progress and regulations surrounding this matter, along with the efforts of international organizations. Design/Methodology/Approach: The research used doctrinal legal research with employing statutory and conceptual approaches. Findings: This legal research underscores the importance of countries revisiting their domestic legal frameworks in light of the current scenario. The research stresses the importance of global cooperation between countries in effectively addressing money laundering. It urges nations to establish bilateral agreements to enable a seamless flow of information for this purpose. Paper Type: Research Article

Abstract

Marijuana legalization remains a contentious public health issue in Indonesia. Despite public debates sparked by a mother's appeal for medicinal marijuana last June, Indonesia maintains strict anti-drug measures under its Narcotics Law, which prohibits the use of all elements of marijuana in medical treatments. However, medicinal marijuana has gained recognition in other jurisdictions for its potential to treat various chronic illnesses. This study employs a doctrinal legal research methodology, relying on secondary sources, legislation, and scholarly analyses. The findings emphasize the urgent need to legalize medicinal marijuana as a critical intervention for specific medical conditions. While possession and use of marijuana remain illegal, Indonesia's ratification of the Single Convention on Narcotic Drugs 1961 allows for research and the controlled use of medicinal marijuana. By examining the experiences of nations with established medical marijuana legislation and emphasizing further research on its applications, this study advocates for the legalization of medicinal marijuana in Indonesia under stringent regulations.

Abstract

Perpetrators of narcotics crimes are not only adults, but can also be children. Handling of children who commit narcotics crimes refers to the provisions of Law Number 35 of 2009 concerning Narcotics, however the criminalization process is still based on the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This aims to provide protection for children who are in conflict with the law. This research aims to analyze the resolution of narcotics crime cases by children using a restorative justice approach at the Batang Police Station. The type of research carried out is normative-empirical legal research. The results of the research show that the resolution of narcotics crime cases with child perpetrators at the Batang Police has been carried out in accordance with Perpol Number 8 of 2021, Law Number 35 of 2009, and Law Number 11 of 2012. The position of the concept of restorative justice is seen as standing alone as alternative case resolution, so that solutions to narcotics crimes committed by children can be sought through restorative justice by fulfilling material and formal requirements. While handling narcotics crime cases committed by children, Batang Police Investigators act as facilitators and mediators.
