Abstract

Birth defects or congenital anomalies affect an estimated 1 in 33 infants, resulting in 3.2 million children with disabilities relating to birth defects every year. In addition, 11.3% of 2.68 million infant mortality caused by birth defects. South-East Asia region has the second highest prevalence of birth defects in the world, 9% of under-five deaths and 12% of newborn deaths in South-East Asia Region were due to congenital anomalies in 2015. In response to this, some countries have established law to prevent children from congenital anomalies. In fact, genetic is not the single factor causing the congenital anomalies. In many cases they were also the result of wrongful conduct of persons. The United Kingdom, for example, had passed a law to deal with the issue of congenital anomalies since 1976. Considering the above-mentioned statistic of birth defects in South-East Asia region, Indonesia have to take an action to prevent or reduce their occurrence. The paper aims to explore the possible ways to prevent the congenital anomalies in Indonesia. It is found that the prevention of congenital anomalies can be made through legal instruments. Unfortunately, the existing law, including the Child Protection Act, do not cover such an issue. With regard to this, the reform upon the law relating to it is urgent. For this purpose, learning from other countries such as the United States and the United Kingdom seems to be necessary.

Abstract

In 2020, the Coordinating Minister for Political, Legal, and Security Affairs of Indonesia, Mahfud MD, affirmed that any Indonesian citizen affiliated with ISIS would not be repatriated. However, Article 28D of the 1945 Constitution ensures that a person’s citizenship status is guaranteed as one of the human rights, as guaranteed in Article 15 of the Universal Declaration of Human Rights. For this reason, this research used a normative legal research method using statute and case approaches through literature review. The research raises the question of how is the protection of the rights to nationality for ex-ISIS based on international law? The research aims to discuss and analyze the rights to the nationality of ex-ISIS combatants under the implementation of international law, such as Article 1 (1) of the 1954 Convention Relating to the Status of Stateless Persons. The research results explain that the state’s discretion regarding nationality is particularly limited to conditions such as the prohibition of arbitrary deprivation, the duty to avoid statelessness, and the principle of discrimination, and everyone has a right to a nationality.

Abstract

Pendidikan bagi anak-anak, pemuda, dan masyarakat di sebagian daerah merupakan hal yang kerap kali luput dari perhatian pemerintah. Dengan kesadaran yang penuh, tim pengabdian serta kepedulian dari pemuda dan masyarakat Indragiri Hilir, provinsi Riau, maka tim pengabdian dan Indragiri Hilir Connect (Inhil-Connect) berusaha menyediakan akses pendidikan kepada masyarakat yang tidak mampu dengan cara memberikan pembelajaran dan pelatihan-pelatihan kepada seluruh anak-anak, remaja, serta para pemuda dan masyarakat Indragiri Hilir. Hal tersebut dilakukan tentunya dalam rangka untuk memperbaiki kualitas pendidikan dan pengetahuan serta meningkatkan taraf hidup masyarakat Indragiri Hilir kedepannya. Bentuk pelatihan dan pembelajaran yang dilakukan adalah sistem belajar, baik secara online maupun offline mengenai materi-materi yang telah disusun oleh tim pengabdian dan Inhil Connect di Rumah Belajar Bersama (RBB). Tenaga pengajar dalam program ini terdiri dari tim pengabdi, para pemuda dan para mahasiswa serta alumni perguruan tinggi di seluruh Indonesia yang berasal dari kabupaten Indragiri Hilir. Pendekatan yang digunakan adalah berbasis partisipasi aktif dan interaktif menggunakan model participatory learning atau role play yang memudahkan seluruh peserta untuk memahami dan menyenangi pembelajaran bersama ini. Luaran dari pengabdian masyarakat ini adalah para peserta mampu mengoperasikan komputer dan alat teknologi yang berkaitan dengan aktifitas belajar mengajar, yaitu Microsoft Office, utamanya PowerPoint, serta memiliki rasa percaya diri mempraktikkan public speaking dengan menggunakan bahasa Inggris.

Abstract

This paper aims to analyze how the perspective of International Humanitarian Law and The 1949 Geneva Conventions are related to the armistice case between Russia and Syria involving civilians as victims of war crimes. By analyzing the applicable international law as the legal basis for the armed conflict case, it is possible to produce an explanation regarding the legal protection provided to civilians as victims of the armistice carried out by Russia in Syria. The type of writing used in this paper is a normative legal study that contains comments, summaries, and thought from several sources written based on the data collected and explained in a statement, not in the form of numbers. The research method used in writing this paper is a normative legal research method that refers to several laws and regulations as guidelines in solving a problem. In the case of the armed conflict in Syria, which has not yet been resolved, even though it has been resolved through an armistice which in fact still result in conflict, the United Nations, as one of the supporters of the world security forum, seeks to resolve it through diplomatic negotiations in order to realize the agreement in the 1949 Geneva Convention as a point of departure clearly related to the resolution of the armed conflict in Syria.

Abstract

Privacy should become a key component in the IT system. It is not something to be considered at last but from the very early stages. Almost no nation has a greater sense of personal data security which could be equivalent to the European level. Since 9/11, the United States has declared to utilize PNR as a method for combating terrorism by associating PNR data with criminal records. Nevertheless, in fact, the majority of data found in the PNR is immense and most of this data is of a confidential nature. The paper used doctrinal legal research methodology utilizing the case and comparative law approach. It elaborates particular cases in relation to data protection issues. It also explores the differences between EU and US law which hinder the idea of data protection in particular on PNR. The study revealed that security is one of the most critical issues which hinder the agreement between the EU and the US on PNR data protection. As the EU promotes the highest standard to the data protection referring to the European community history and GDPR provisions, while the US places national security as a main priority beyond the privacy issues.

Abstract

Tujuan penelitian ini adalah untuk mengetahui alasan yang melatarbelakangi pekerja migran Indonesia di Taiwan kabur dari pekerjaannya. Di sisi lain, penelitian ini juga menganalisis upaya Pemerintah Indonesia dan Taiwan untuk melindungi pekerja migran Indonesia kaburan. Penelitian ini bersifat deskriptif dengan jenis yuridis normatif, menggunakan data primer dan sekunder, melalui pendekatan perundang-undangan. Pengumpulan data dilakukan melalui metode wawancara untuk mengkonfirmasi alasan pekerja migran Indonesia kaburan dan studi literatur, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa terdapat faktor-faktor yang mengakibatkan pekerja migran kabur, yaitu kondusifitas lingkungan kerja dan profesionalitas pekerja. Selain itu, penelitian ini menunjukkan bahwa upaya Pemerintah Indonesia dan Taiwan masih belum maksimal dalam mencegah dan menanggulangi kasus pekerja migran Indonesia kaburan di Taiwan sehingga membutuhkan upaya perlindungan yang jelas dalam menanggulangi kasus tersebut.

Abstract

Children are frequently turned into child soldiers or used as human shields in armed conflicts. The use of child soldiers is condemned by all nations and is regarded as a grave breach of both children's rights and international humanitarian law. The paper aims to discuss pertinent provisions of international legal norms, particularly those that relate to child soldiers in the sequence of their adoption. Additionally, it presents the issue of the implementation of several international conventions on the issue of using child soldiers and its atrocities in the international community. As the result, when it comes to addressing the issue of child soldiers, the international legal sources do not present a consistent picture. There has been a various provision in the determination of minimum age of a child that led to major debates among international communities. The situation is further exacerbated by the fact that, while some countries have accepted the convention as binding on themselves, their implementation faces significant challenges, such as the fact that the majority of international treaties lack sanctioning power, limiting their ability to properly accomplish the preventive purpose.

Abstract

This study explores the policy and regulatory frameworks concerning cyber espionage within Indonesia and Germany. Given the considerable threats cyber espionage poses to national security and economic interests, it is crucial for nations to formulate thorough strategies to mitigate such risks. Through a comparative analysis of Indonesia and Germany—two countries with distinct geopolitical stances and methodologies regarding cybersecurity and espionage—the research delves into the legal, political, and technological factors influencing their cyber espionage policies. The methodology includes a comprehensive review of legislative measures, governmental strategies, and the response of institutions to cyber espionage in both nations. The objective is to discern the similarities, differences, and effectiveness of the policies and regulations of these countries. This comparison sheds light on the adequacy of Indonesian legislation in combating cybercrime, especially cyber espionage. The study reveals that Indonesia's legal infrastructure for cybercrime is markedly underdeveloped compared to Germany's, where stringent and well-articulated regulations are in place, facilitating precise and efficient management of cyber issues. Thus, the study underscores an urgent need for Indonesia to reform its cybercrime laws, focusing on cyber espionage, among other cyber threats, while continuing to enhance the quality of its human resources.DOI: https://doi.org/10.22304/pjih.v11n1.a6

Abstract

The prevalence of hoaxes in Indonesia is not a new phenomenon. Over the past three years, there has been a consistent increase in the dissemination of hoaxes across various platforms in the country. Furthermore, with the onset of the pandemic, the spread of hoaxes related to Covid-19 has become particularly rampant. In 2021 itself, the Ministry of Communications and Informatics identified and debunked a total of 723 hoaxes pertaining to Covid-19. This research paper aims to examine the current state of hoax dissemination in Indonesia and identify the key factors contributing to their spread. The study adopts a normative legal research approach, drawing on data derived from books, journals, relevant laws, and regulations. The findings reveal that social media platforms play a significant role in the proliferation of hoaxes throughout Indonesia. The presence of numerous anonymous or fake accounts facilitates the easy dissemination of hoaxes via social media. Moreover, the lack of due diligence in verifying and fact-checking information creates a loophole that allows hoaxes to circulate within the community. In order to address this issue effectively, it is crucial to implement measures that target the root causes of hoax dissemination. This includes the development of stricter regulations and enforcement mechanisms to combat the creation and spread of hoaxes, particularly on social media platforms. By comprehensively understanding the dynamics and factors influencing the spread of hoaxes in Indonesia, policymakers, law enforcement agencies, and the general public can work together to combat this pressing issue.
