Abstract

Penelitian ini mengulas tentang konsumsi minuman keras tradisional “bobo” yang masih populer di masyarakat Nabire, Papua, terutama pada acara adat dan penyambutan tamu. Meskipun termasuk dalam warisan budaya tak benda, penyuluhan hukum diperlukan untuk meningkatkan kesadaran hukum masyarakat. Tujuan pengabdian ini adalah memberikan pemahaman tentang warisan tak benda yang dilindungi oleh Perpres No 78/2007, termasuk bobo agar masyarakat dapat melestarikan budaya dengan bijak dan mencegah kejahatan di masyarakat. Metode pengabdian yang digunakan adalah ceramah dengan narasumber dan audien diberikan kesempatan untuk bertanya. Kegiatan penyuluhan hukum ini memberikan dampak positif bagi masyarakat sekitar, memungkinkan Tridharma di lingkungan STIH Biak Papua berjalan sesuai dengan permasalahan yang terdapat di masyarakat. Diharapkan dengan cara ini, warisan budaya bobo dapat terjaga dan dilestarikan, dan masyarakat dapat taat hukum untuk menciptakan lingkungan yang damai dan mencegah tindak kriminalitas yang terjadi secara berlebih.

Abstract

Desa Warsa, Distrik Biak Utara, Kabupaten Biak Numfor merupakan bagian dari sistem penyelenggaraan pemerintahan nasional yang berada dalam struktur pemerintahan daerah. Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah menegaskan pentingnya peningkatan kesejahteraan masyarakat melalui penyelenggaraan pemerintahan yang efektif, pelayanan publik yang baik, serta kinerja yang optimal dan transparan. Otonomi daerah memberikan ruang bagi pemerintah daerah untuk meningkatkan pemerataan pembangunan, termasuk di wilayah pedesaan dan terpencil, khususnya dalam bidang pertanian dan pendidikan. Namun, pengawasan terhadap penyelenggaraan pemerintahan dan pelayanan publik di tingkat desa masih perlu diperkuat melalui partisipasi masyarakat. Meskipun telah terdapat Badan Permusyawaratan Desa (BPD) atau Badan Musyawarah Kampung (Bamuskam), diperlukan pemahaman dan keterlibatan masyarakat yang lebih optimal. Pengabdian kepada masyarakat ini dilaksanakan melalui kegiatan sosialisasi dengan metode ceramah untuk meningkatkan pemahaman masyarakat mengenai pentingnya pengawasan, partisipasi, dan pelayanan publik dalam mewujudkan pemerintahan desa yang transparan, akuntabel, dan responsif.

Abstract

Pengabdian ini bertujuan untuk meningkatkan pemahaman masyarakat tentang perlindungan hukum bagi perempuan dan anak dari kekerasan. Metode yang digunakan meliputi sosialisasi hukum, diskusi interaktif, dan pendampingan bagi korban. Hasil kegiatan menunjukkan bahwa rendahnya kesadaran hukum, budaya patriarki, serta kurangnya respons aparat penegak hukum menjadi hambatan utama dalam perlindungan perempuan dan anak. Pengabdian ini berhasil meningkatkan kesadaran masyarakat tentang hak-hak hukum serta pentingnya pelaporan kasus kekerasan. Diharapkan kolaborasi lebih lanjut dapat memperkuat sistem perlindungan hukum yang lebih efektif dan berpihak pada korban.

Abstract

The development of Food, Energy, and Water Self-Sufficiency Areas in South Papua may conflict with the ulayat rights of customary law communities that continue to exist and have been exercised across generations. This study aims to analyze the protection of ulayat rights and to formulate an appropriate legal protection model. It employs a normative legal research method using statutory, conceptual, and historical approaches. The findings indicate that ulayat rights are recognized under the Constitution, agrarian law, and Papua’s Special Autonomy framework, but their implementation continues to face challenges concerning territorial recognition, community consent, land use, and project oversight. Legal protection must therefore operate from the planning stage through restoration by incorporating the mapping of customary territories, community consent, legal certainty regarding land use, benefit-sharing, monitoring, dispute resolution, and environmental restoration. This model is necessary to ensure that development can proceed without severing the relationship between customary law communities and the land and natural resources that constitute their living territories.

Abstract

This study analyzes the legal certainty of registering land subject to the hak ulayat of customary law communities following the enactment of Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency No. 14 of 2024. It employs normative legal research using statutory and conceptual approaches. The primary legal materials consist of legislation and judicial decisions, while the secondary legal materials comprise relevant literature and research findings. The study finds that ATR/BPN Ministerial Regulation No. 14 of 2024 establishes a multi-tiered framework for the administration and registration of Tanah Ulayat through inventory and identification, surveying and mapping, recording in the Daftar Tanah Ulayat (Customary Land Register), and optional registration as Hak Pengelolaan (Right of Management) for a Kesatuan Masyarakat Hukum Adat or as Hak Milik (Right of Ownership) over collectively held land for a Kelompok Anggota Masyarakat Hukum Adat. This framework strengthens legal certainty regarding the legal subject, land object, procedures, and legal consequences of registration. However, such certainty remains affected by the formal recognition of customary law communities, potential overlapping claims to land, and communities’ access to land administration. The study concludes that legal certainty concerning Tanah Ulayat must integrate administrative and substantive legal certainty so that registration does not diminish the communal character of customary tenure, the authority of customary institutions, or the continuing applicability of customary law.

Abstract

Changes in mining policy under Law Number 3 of 2020 introduced a priority mechanism for granting Mining Business License Areas (WIUP) alongside the auction system. This policy raises constitutional issues concerning limitations on equal opportunity principles and potential deviations from the state's right of control. This normative legal research analyzes the legal construction of priority WIUP allocation and evaluates its constitutionality based on the State's Right of Control standards articulated in Constitutional Court Decision Number 36/PUU-X/2012. The findings indicate that granting priority without measurable merit criteria risks reducing the constitutional essence of state control intended for the greatest prosperity of the people. This study formulates constitutional criteria for priority WIUP allocation, comprising legitimate affirmative purposes, technical and financial capacity, transparency, and continuous oversight, ensuring that such preference remains aligned with the principles of fair legal certainty.

Abstract

This study analyzes legal protection and equitable carbon benefit sharing for customary forest holders within forestry-sector carbon trading under Presidential Regulation No. 98 of 2021 and Minister of Environment and Forestry Regulation No. 7 of 2023. It employs normative legal research using statutory, conceptual, and case approaches. The findings show that customary law communities holding a formal determination of customary forest status are recognized as actors in carbon trading, although such protection operates through conditional inclusion due to reliance on administrative formalization. Furthermore, tenure rights over customary forests do not automatically confer ownership of tradable Carbon Units. Regarding benefit sharing, current regulations mandate free, prior, and informed consent (Padiatapa), agreed benefit-sharing plans, reporting, evaluation, and grievance mechanisms, yet fail to establish substantive parameters to evaluate equitable distribution. To ensure comprehensive legal protection and substantive justice, this study proposes a rights-and-contribution-based carbon benefit-sharing framework built on four core parameters: recognition, consent, contribution, and distribution.

Abstract

Government Regulation No. 20 of 2021 establishes State General Reserve Land (TCUN) from abandoned land. Under Articles 27–28 juncto Articles 74 and 87 of ATR/BPN Ministerial Regulation No. 20 of 2021, the Minister holds discretionary authority to determine TCUN allocation. However, broad discretion risks arbitrary land distribution. This study analyzes the legal limits of ministerial discretion in TCUN utilization post-Job Creation Law and formulates control parameters using normative legal research. The study reveals that discretion cannot operate autonomously; it must align with Good Governance Principles (AUPB), the social function of land under Article 6 of the Basic Agrarian Law (UUPA), and agrarian reform goals. This paper proposes a five-stage control model: authority review, discretionary purposes and social function review, agrarian reform relevance review, objectivity and due-care review, and procedural accountability review. Agrarian reform serves as a mandatory consideration whenever TCUN characteristics relate to land redistribution.

Abstract

Constitutional recognition of customary law communities does not, by itself, guarantee the protection of ulayat land when the state is preparing to issue administrative decisions that enable third parties to use such territories. This issue is particularly significant in Papua because the Special Autonomy regime requires the provision of ulayat land to be conducted through deliberation aimed at reaching agreement with the relevant customary law community. This study examines the legal position of recognition of customary law communities and Free, Prior and Informed Consent (FPIC) in decision-making concerning the use of ulayat land and formulates a legal framework that places the protection of ulayat rights before authorization is granted. This study employs normative legal research, using statutory, conceptual, and case approaches. The findings demonstrate that land administration and registration contribute to legal certainty for ulayat rights but cannot be treated as the sole basis for the existence of rights that positive law also links to the continuing factual existence of the community and its ulayat relationship with the land. The study proposes a recognition-before-authorization framework based on the principle of protective sequencing, comprising preliminary examination of indications of ulayat rights, temporary administrative safeguards, participatory inventory and mapping, strengthened recognition, substantive consent, and authorization only after land status and community consent have been resolved. This framework seeks to prevent delays in the administrative recognition of customary law communities from allowing third-party legal interests to be established ahead of ulayat rights over Indigenous territories.
