<![CDATA[A Notary is a public official authorized to create authentic deeds and is obligated to maintain professional confidentiality. In the performance of their duties, particularly when a legal issue arises leading to criminal proceedings that require the summoning of a Notary, the Notary Honorary Council (Majelis Kehormatan Notaris/MKN) must provide approval pursuant to Article 66 of the Law on Notarial Office (UUJN). This provision gives rise to legal issues due to differences in regulation between the UUJN and the Indonesian Criminal Procedure Code regarding the authority of investigators to summon and examine individuals. This study aims to analyze the urgency of obtaining MKN approval in the summoning of notaries in criminal cases, as well as the position and role of the MKN after a notary has been designated as a suspect. This research employs a normative legal method using statutory and conceptual approaches. The findings indicate that MKN approval is essential as a form of protection for the honor, independence, and confidentiality of the notarial profession, while also functioning as a procedural supervisory mechanism within the law enforcement process. The role of the MKN continues even after a notary has been named a suspect, insofar as the case is related to the execution of the notary’s official duties. However, once approval has been granted, the MKN is no longer involved in the substance of the investigation. Therefore, the MKN plays an important role in balancing the protection of the notarial office with the enforcement of criminal law.]]>
