Abstract

ABSTRACT There are at least three obligations that must be carried out by a state in human rights, namely respecting, protecting, and ful lling. These three things must be done by every state so that the state is not considered as a state that ignores human rights. Of these three things, it requires the state to provide all things both normative and administrative in nature to ful ll these obligations and if those things are not applied then the state is considered to have committed human rights violations. In this case, what were done by the suspects who deliberately killed four people in the state detention house and abused the Sleman prison of cers were acts that had violated human rights and moreover the suspects were active members of the Indonesian military (TNI) who were joining a training when carried out the killings and also used training weapons to kill the victims. In his decision the judge stated that the suspects had committed premeditated murder together and had violated the service order, therefore, they were sentenced and dismissed from military service. From the perspective of human rights violations and state responsibility, it is not clear what the judge was considering. Thus, the issues of this study are: how is the human rights consideration from the judge in this case? And how is the state responsibility to the victims in this case? By using a normative legal research method that focuses on studies on secondary data, it will be seen how the judge’s consideration in this decision is. The result of this study indicates that the decision in this case did not consider human rights, both human rights violations and victims’ rights. Keywords: state responsibility; impunity; military court; human rights.

Abstract

ABSTRACT In the criminal justice system, the handling of a case starts since the claim arises, then is handled by the police, until the final process of law enforcement, which lies in the judge's decision. Judges' decisions can be in the form of sentencing or acquitting a defendant. The ability of a judge to construct a case will appear in the decision from the time the indictment is read until the plea is pronounced. In these considerations, it will be seen whether the judge's decision violates the code of ethics or not. Two judges' decisions issued by the Tobelo District Court reflect the problem in which a defendant was twice sentenced by the same panel of judges for violating the same law. This is what then becomes the formula of the problem, whether the decision violates the Code of Ethics and Code of Conduct of Judges or not. By using normative legal research method focusing on secondary data construing, it will expose the fact of these two decisions. The results of this analysis indicate that there are violations of the Code of Ethics and Code of Conduct of Judges been committed by the panel of judges examining the case. Keywords: code of ethics and code of conduct of judges; criminal justice system; professionalism.

Abstract

Judicial decisions should reflect legal certainty, utility, and justice as objectives to be achieved through the law enforcement process. Such decisions are based not only on legal facts established during the proceedings but also on legal knowledge, morality, and values of justice prevailing in society. These elements are reflected in judicial reasoning throughout the examination of the case until the final judgment is rendered. In this case, the Supreme Court exercised its authority to conduct judicial review of a sub-statutory regulation (a regulation below the level of a statute) issued by the General Elections Commission. Judgment Number 23 P/HUM/2024 was heard and decided by a panel of justices in the state administrative chamber of the Supreme Court. This study aims to analyze whether the judgment removed the General Elections Commission’s authority and whether the judges acted beyond the scope of their authority in conducting judicial review of sub-statutory regulations. This study employs normative legal research using a case approach. The findings indicate that the judges held that the General Elections Commission regulation was contrary to the statute and that the ages of regional head and deputy regional head candidates should be calculated as of the date of inauguration of the elected candidates. The study finds that the judgment has the effect of removing the General Elections Commission’s authority to determine the age limit for regional head and deputy regional head candidates. Furthermore, the study indicates that the judgment exceeded the scope of the judges’ authority in conducting substantive judicial review of regulations below the level of a statute.
