Abstract

impeachment tidak diartikan sebagai sebuah turunnya, berhentinya atau dipecatnya Presiden dan/atau Wakil Presiden dari jabatannya. Putusan impeachment di MK sebagai proses politik tidak berarti dapat diberhentikan Presiden dan/atau Wakil Presiden karena harus tetap melalui keputusan MPR yang diberikan kewenangan dalam memberhentikan Presiden dan/atau Wakil Presiden. Penelitian ini bertujuan untuk menganalisis implikasi sifat putusan impeachment MK terhadap status hukum Presiden dan/atau Wakil Presiden yang telah dinyatakan telah melakukan pelanggaran secara konstitusional. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, yaitu penelitian yang dalam pengkajiannya dengan mengacu dan mendasarkan pada norma-norma dan kaidah-kaidah hukum. Tulisan ini dimaksudkan untuk mencari formulasi konstitusional yang bersifat fundamental sesuai dengan konsep supremasi hukum terhadap daya ikat putusan impeachment MK. Format mekanisme impeachment yang ideal tersebut harus menempatkan MK pada posisi yang menentukan, bukan hanya sekedar lembaga yang menjustifikasi pendapat DPR dalam proses impeachment.

Abstract

The lack of quantity of halal auditors has implications for the less than optimal implementation of halal product guarantee in Indonesia, so it is necessary to compare with Brunei Darussalam in standardizing halal auditors. The research method used in this research is normative juridical. The results of the study indicate that halal auditors still need to optimize the quantity of halal auditors so that they are more optimal in halal and there will be an increase in halal product guarantee in Indonesia. Comparative with Brunei Darussalam, apart from an adequate quantity of halal auditors, there is also a code of ethics for trainee auditors (halal auditors), Indonesia needs to optimize the number of halal auditors and also have a code of ethics for halal auditors. So the results are more optimal and in accordance with Law of the Republic of Indonesia Number 33 Year 2014 on Halal Product Guarantee.

Abstract

ABSTRAK Paling tidak ada tiga kewajiban yang harus dilakukan oleh negara dalam hak asasi nanusia, yaitu menghormati, melindungi, dan memenuhi. Ketiga hal ini wajib dilakukan oleh setiap negara agar negara tidak dianggap sebagai negara yang mengabaikan hak asasi manusia. Dari ketiga hal tersebut menuntut negara untuk menyediakan semua hal baik yang bersifat normatif maupun administratif untuk terpenuhinya kewajiban tersebut, dan jika tidak dilakukan maka negara tersebut dianggap telah melakukan pelanggaran hak asasi manusia. Dalam perkara ini apa yang dilakukan oleh para tersangka yang dengan sengaja membunuh empat orang dalam rumah tahanan negara serta menganiaya petugas Lembaga Pemasyarakatan Sleman merupakan perbuatan yang telah melanggar hak asasi manusia, dan terlebih lagi para tersangka merupakan anggota TNI aktif yang saat melakukan pembunuhan para tersangka sedang latihan, dan juga menggunakan senjata latihan untuk membunuh para korban. Dalam putusannya hakim menyatakan bahwa tersangka telah melakukan pembunuhan berencana secara bersama-sama dan telah melanggar perintah dinas, oleh karena itu dihukum dan dipecat dari dinas militer. Dalam perspektif pelanggaran hak asasi manusia dan tanggung jawab negara tidak terlihat begitu jelas yang dipertimbangkan hakim tersebut. Sehingga rumusan masalah dalam tulisan ini adalah bagaimanakah pertimbangan hak asasi manusia oleh hakim dalam putusan ini? Dan bagaimanakah tanggung jawab negara terhadap korban dalam putusan perkara ini? Dengan menggunakan metode penelitian hukum normatif yang memfokuskan kajian pada data sekunder, maka akan terlihat bagaimana sesungguhnya pertimbangan hakim dalam putusan ini. Hasil dari penelitian ini menunjukkan bahwa dalam putusan perkara ini tidak mempertimbangkan hak asasi manusia, baik pelanggaran hak asasi manusia maupun hak-hak korban.Kata kunci: tanggung jawab negara; impunitas; pengadilan militer; hak asasi manusia. ABSTRACT There are at least three obligations that must be carried out by a state in human rights, namely respecting, protecting, and ful lling. These three things must be done by every state so that the state is not considered as a state that ignores human rights. Of these three things, it requires the state to provide all things both normative and administrative in nature to ful ll these obligations and if those things are not applied then the state is considered to have committed human rights violations. In this case, what were done by the suspects who deliberately killed four people in the state detention house and abused the Sleman prison of cers were acts that had violated human rights and moreover the suspects were active members of the Indonesian military (TNI) who were joining a training when carried out the killings and also used training weapons to kill the victims. In his decision the judge stated that the suspects had committed premeditated murder together and had violated the service order, therefore, they were sentenced and dismissed from military service. From the perspective of human rights violations and state responsibility, it is not clear what the judge was considering. Thus, the issues of this study are: how is the human rights consideration from the judge in this case? And how is the state responsibility to the victims in this case? By using a normative legal research method that focuses on studies on secondary data, it will be seen how the judge’s consideration in this decision is. The result of this study indicates that the decision in this case did not consider human rights, both human rights violations and victims’ rights. Abstract

The problem of online land services by the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN) has several legal problems related to the nature of land registration to ensure legal certainty as its main substance. The problem to be discussed is regarding the online land service policy implemented by the National Land Agency with various obstacles and legal problems that arise against the policy. The research method used is normative legal research. The results showed that in terms of online land services, for the first time registration activities, especially in physical land measurement services, it could not be carried out online so that the substance of online land service policies could not be fully implemented. The lack of public knowledge about technology makes it difficult to access land services online, which becomes a separate obstacle in implementing online land service policies

Abstract

The problem has not been applied to the principles of sustainability, justice, legal certainty, accountability,  openness, effectiveness and efficiency, and professionalism must all be considered  in  providing guarantees of Halal Products. Theimplementation of Halal Product Guarantee aims to provide comfort, security, security, and certainty of the availability of Halal Products for the general public when consuming and using products, as well as increasing added value for Businesses that produce and sell Halal Products. The government is responsible for organizing halal product guarantees, implemented by BPJPH, to provide  excellent service to the  public. The research method used in this research is normative juridical. The results showed that the philosophy of bpjph was formed to carry out the implementation of halal product guarantees, so that BPJPH is responsible to the Minister of Religious Affairs. Comparison with the United States, Malaysia, and Thailand that  LPH in america is held through a private organization or legal entity that does not have the slightest affiliation with the government. Generally there are several institutions / organizations that issue halal certificates (HalalCertifier Bodies)in acountry. LPH in Malaysia is a Halal Axis Division under the Malaysian Department of Islamic Progress (JAKIM). JAKIM is an official government body  and its performance follows the rules of the Government of Malaysia. LPH in Thailand is  the Central Islamic Committee of Thailand  (CICOT) and the Islamic Committee of Province.

Abstract

In the 1945 Constitution there are two regulations regarding emergency situations (danger) which are regulated in two articles, namely Article 12 and Article 22. Article 12 of the 1945 Constitution states, "The President declares a state of danger, the conditions and consequences of a state of danger are determined by law". Then Article 22 paragraph (1) of the 1945 Constitution states, "In the event of a compelling urgency, the President has the right to stipulate government regulations in lieu of law". From the above provisions, it can be seen that there are two categories of circumstances according to the 1945 Constitution, namely (1) conditions of danger and (2) matters of compelling urgency. The terms (legal terms) used in the two articles are clearly different, the first term uses the term "danger" which is nothing but the same as the definition of an emergency. This research uses normative juridical research. The problem approach used in this research includes a legal approach, a conceptual approach, a case approach and a comparative approach. This research is a deductive research that describes legal events and legal consequences associated with the establishment of state emergencies in several countries. The data obtained were collected and analyzed qualitatively with a descriptive-analytical model. So that the results can be described comprehensively and systematically regarding the basic considerations in establishing the rule of law. The provisions regarding Article 12 and Article 22 paragraph (1) of the 1945 Constitution are basically also related to Article 10 and Article 11 paragraph of the 1945 Constitution. The problem in this research is how to regulate the legal basis for determining the status of a state emergency in Indonesia. with the United States? What is the President's authority in determining the state of emergency status in Indonesia with the United States?

Abstract

This study analyzed the implications of the enactment of Law Number 11 of 2020 concerning Job Creation on the Implementation of Halal Product Guarantee. This is normative juridical research. The data gathered through secondary data and the research specification wss descriptive-analytical. The data analysis was done qualitatively. This paper concludes that the enactment of Law Number 11 of 2020 concerning Job Creation has brought amendments to 22 articles and the addition of 2 new articles in Law Number 33 of 2014 concerning Halal Product Guarantee. There have been a number of significant changes in the implementation of the Halal Product Guarantee, including the matter of convenience for micro and small businesses, cutting the length of time for the application and the halal certification process, and changing a number of sanctions related to the regulation of halal product guarantees. The implications of this change are clearly visible in the halal certification business process, the cooperation between Halal Product Guarantee Agency (HPGA), the Halal Inspection Agency (HIA) and halal auditors, halal supervisors, community participation, halal certificates, halal labels, self-declare, and administrative sanctions.

Abstract

Land issues are not only related to land disputes, conflicts and cases, but are also related to gaps in land tenure and land conversion which are considered to be inhibiting factors in achieving land as the greatest source of people's prosperity. Arranging access to capital after land redistribution within the framework of agrarian reform is one of the government's steps to address the issue of land management in Indonesia which will be studied from an Islamic perspective. This study uses a normative legal research method using secondary data which is analyzed through content analysis with a statua approach. The results showed that the aspect of post-land redistribution capital has a correlation with economic activity in the view of Islam as a whole, which aims to: meet one's basic needs, meet family needs, meet long-term needs, provide for the needs of abandoned families, provide social assistance and donations in the way of Allah SWT. The fundamental value of Islamic teachings regarding the post-land redistribution capital aspect as stated above is in line with the basic nature of agrarian reform activities in Indonesia which are characterized by democracy, social justice for land. Arrangement of access to capital after land redistribution is a form of continuity and equality between asset arrangement in the form of equal distribution of land ownership and access arrangement in the form of community empowerment to access capital based on land rights so as to realize community welfare.

Abstract

The provisions of Article 48 number 10 paragraph (2) of the Copyright Law affirm,"The determination of the page of the Product as referred to in paragraph (1) is issued by MUI in the form of a Halal Product Determination Decree." Theissue of the Copyright Law does not change the authority of MUI in the determination of product page. Article 33 Undang-Undang Halal Product Guarantee stipulates that the determination of product idolatry is carried out by MUI through the implementation of the MUI Halal Fatwa Session. Undang-U's legal mandate  for Halal Product Guarantee and Work Copyright Law to MUI as the authority holder of halal determination of products is based on philosophical, historical and sociological factors. The research method used in this research is normative juridical. The results showed that the  position of the MUI Fatwa has moral power for groups that have aspirations to implement it, but cannot be used as a tool of force for other groups who disagree over it. Because the MUI Fatwa is not a positive law of the state that has coercive power. Halal  fatwa standards have an important role to play in order to provide protection and comfort for Muslim consumers.

Abstract

The increasing human need for electricity has led to an increase in various modes of electricity theft. The aim of this research was to determine the resolution of the crime of electric current theft at PT PLN Tanjungbalai city. The research method used is a normative juridical legal research method (normative law research), namely a legal research method by examining the implementation or implementation of positive legal provisions (legislation) and factual contracts in every legal event and achievement of goals in society. The data collection technique uses literature review as secondary data by discussing Law Number 30 of 2009 concerning Electricity and interviews as primary data to determine the resolution and prevention of acts of electricity theft in the city of Tanjungbalai. The steps taken by PT. PLN Tanjungbalai City in resolving the criminal act of electricity theft are based on the provisions stated in PT. PLN Directors Regulation Number 0028 to provide a deterrent effect and fear to the individuals who carry out the theft. PT. PLN Tanjungbalai city also carries out prevention by providing outreach about electricity to the community as an effort to increase understanding and awareness of sanctions for committing violations.
