Abstract

This study analyzes the reasons behind the failure to establish a global plastics treaty during the fifth session of the Intergovernmental Negotiating Committee (INC-5) in 2024—an initiative mandated by the UN Environment Assembly (UNEA) as part of the process of creating an international regime. The research aims to identify the factors contributing to the failure of INC-5 by examining the influence of national interests, as well as political, economic, industrial, and diplomatic pressures that drove divisions among participating nations. The study employs international regime theory to explain the failure to establish a regime addressing global plastic pollution and utilizes the rational actor model to analyze the tendency of states to prioritize national interests over collective interests during negotiations. The analysis reveals that a flawed regime-formation process was a primary factor hindering the achievement of an agreement. Furthermore, divergent national interests significantly impacted the progress of regime formation. Consequently, this research is crucial for understanding the causes of this failure and identifying the necessary steps for establishing a global regime to address plastic pollution.
