Abstract

This study examines law enforcement and the grounds for judges' considerations regarding unlicensed mining criminal acts, focusing on the case study of Decision Number 376/Pid.Sus-LH/2024/PN Bls. Although the Minerba Law strictly regulates criminal sanctions, field implementation and supervision are deemed suboptimal due to the rampant occurrences of illegal mining across various regions. This unauthorized activity has broad impacts on ecological aspects (forest and environmental degradation, river pollution), economic aspects (state revenue losses), and social aspects (disruptions to public order). Utilizing a normative legal approach, this research aims to analyze law enforcement patterns and the judges' juridical arguments in rendering decisions based on the study of relevant regulations, literature, and court documents.
